Clauses
52.202-1 Definitions. (NOV 2013)
52.203-17 Contractor Employee Whistleblower Rights and Requirement To Inform Employees of Whistleblower Rights. (APR 2014)
52.212-1 Instructions to Offerors - Commercial Items. (APR 2014)
(End of provision)
52.212-2 Evaluation - Commercial Items. (JAN 1999)
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. All evaluation factors other than price are equal to price. Offers will be evaluated based on the factors listed below. Factors A through C are of equal importance. In addressing the evaluation factors below, the offeror shall demonstrate:
Factor A: Technical Capability of Offeror’s Employees – Offerors shall provide evidence of employee’s experience and certifications in order for the Government to determine whether the offeror is capable of meeting the Government’s requirement. The Bus Drivers must possess a valid Class B Commercial Driver’s License (CDL) with passenger and air brake endorsement and Department of Transportation (DOT) Physical Certificate and have a minimum of one (1) year experience operating a Commercial Motor Vehicle (CMV) and be capable of logging shuttle runs. The Automotive Worker must possess a valid Class B CDL with passenger air brake endorsement and DOT Physical Certificate and must have a minimum of five (5) years experience in the make-up, operation, service and routine repair of the components, assemblies, and systems of trucks, vans, and buses such as gasoline and diesel engines, transmissions, front and rear assemblies, power steering, hydraulic and air brake mechanisms, air conditioning, and electrical hydraulic and hydrostatic systems, and be capable of using test equipment appropriate to the level of work required. The Automotive Worker must have the knowledge to determine when and the extent of repairs, what parts are repairable or should be replaced, and the type and extend of adjustments that are necessary.
Automotive Workers must have the ability to interpret manufacturer’s service and repair manuals, diagrams, schematics, etc. and document replacement parts. The Automotive Worker must be capable of maintaining equipment logs in order to track service mileage, services, and repairs. All Contractor employees must be United States born or naturalized citizens and must speak fluent English.
Factor B: Experience of Offerors - Offerors shall provide an overview of their experience related to the Government’s requirement and evidence of knowledge of regulations as they apply to this requirement.
https://www.fbms.doi.net/prsmprd/clauses/far/FAR12.htm#12.301
Factor C: Past Performance – Offerors shall provide at least three (3) references from same or similar contracts. Evaluation of this factor will be based not only on the information provided by references, but also the Government’s knowledge of offeror’s past performance. The Government will assess a neutral rating if offeror lacks past performance.
Factor D: Price
Factors A and B will be rated using a numerical rating system as follows: 1-fails to qualify; 2-poor; 3-fair; 4-good; 5-excellent. The proposed price will be evaluated but not scored. Price evaluation will determine whether the proposed pricing is realistic and reasonable in relation to the solicitation requirements. The Government reserves the right to make an award to other than the lowest priced offeror if the Contracting Officer determines that to do so would result in the best value to the Government.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 Offeror Representations and Certifications-Commercial Items. (MAY 2014)
As prescribed in 12.301(b)(2), insert the following provision:
OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS (MAY 2014)
An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
