The work will consist of providing all labor, qualified supervision, material, tools, equipment, supplies, and incidentals necessary for remodeling of 2 bathrooms as described in the scope of work (see page 11). The bathrooms are approximately 35 and 40 square feet. The work will include demolition including remediation/disposal of mold and asbestos, framing, drywall installation, plumbing, electrical, flooring, fixtures, and painting. The resulting contract is expected to be awarded on/about

January 16, 2015. Work is expected to begin within 10 days of award.

The government will publish an amendment to the solicitation following the scheduled site visit to clarify specifications and answer questions if necessary.

52.225-10 Notice of Buy American Requirement - Construction Materials. (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American-Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers. (1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance

P15PS00171 Remodel Residence Bathrooms – Mount Rushmore Page 8 of 40 with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested-

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

52.232-5 Payments Under Fixed-Price Construction Contracts. (MAY 2014)

(a) Payment of price. The Government shall pay the Contractor the contract price as provided in this contract.

(b) Progress payments. The Government shall make progress payments monthly as the work proceeds, or at more frequent intervals as determined by the Contracting Officer, on estimates of work accomplished which meets the standards of quality established under the contract, as approved by the Contracting Officer.

(1) The Contractor's request for progress payments shall include the following substantiation:

(i) An itemization of the amounts requested, related to the various elements of work required by the contract covered by the payment requested.

(ii) A listing of the amount included for work performed by each subcontractor under the contract.

(iii) A listing of the total amount of each subcontract under the contract.

(iv) A listing of the amounts previously paid to each such subcontractor under the contract.

(v) Additional supporting data in a form and detail required by the Contracting Officer.

(2) In the preparation of estimates, the Contracting Officer may authorize material delivered on the site and preparatory work done to be taken into consideration. Material delivered to the Contractor at locations other than the site also may be taken into consideration if -

(i) Consideration is specifically authorized by this contract; and

(ii) The Contractor furnishes satisfactory evidence that it has acquired title to such material and that the material will be used to perform this contract.

(c) Contractor certification. Along with each request for progress payments, the Contractor shall furnish the following certification, or payment shall not be made: (However, if the Contractor elects to delete paragraph (c)(4) from the certification, the certification is still acceptable.)

I hereby certify, to the best of my knowledge and belief, that -

(1) The amounts requested are only for performance in accordance with the specifications, terms, and conditions of the contract;

(2) All payments due to subcontractors and suppliers from previous payments received under the contract have been made, and timely payments will be made from the proceeds of the payment covered by this certification, in accordance with subcontract agreements and the requirements of chapter 39 of Title 31, United States Code;

(3) This request for progress payments does not include any amounts which the prime contractor intends to withhold or retain from a subcontractor or supplier in accordance with the terms and conditions of the subcontract; and

(4) This certification is not to be construed as final acceptance of a subcontractor's performance.

(d) Refund of unearned amounts. If the Contractor, after making a certified request for progress payments, discovers that a portion or all of such request constitutes a payment for performance by the Contractor that fails to conform to the specifications, terms, and conditions of this contract (hereinafter referred to as the unearned amount), the Contractor shall -

(1) Notify the Contracting Officer of such performance deficiency; and

(2) Be obligated to pay the Government an amount (computed by the Contracting Officer in the manner provided in paragraph (j) of this clause) equal to interest on the unearned amount from the 8th day after the date of receipt of the unearned amount until -

(i) The date the Contractor notifies the Contracting Officer that the performance deficiency has been corrected; or

(ii) The date the Contractor reduces the amount of any subsequent certified request for progress payments by an amount equal to the unearned amount.

(e) Retainage. If the Contracting Officer finds that satisfactory progress was achieved during any period for which a progress payment is to be made, the Contracting Officer shall authorize payment to be made in full. However, if satisfactory progress has not been made, the Contracting Officer may retain a maximum of 10 percent of the amount of the payment until satisfactory progress is achieved. When the work is substantially complete, the Contracting Officer may retain from previously withheld funds and future progress payments that amount the Contracting Officer considers adequate for protection of the Government and shall release to the Contractor all the remaining withheld funds. Also, on completion and acceptance of each separate building, public work, or other division of the contract, for which the price is stated separately in the contract, payment shall be made for the completed work without retention of a percentage.

(f) Title, liability, and reservation of rights. All material and work covered by progress payments made shall, at the time of payment, become the sole property of the Government, but this shall not be construed as -

(1) Relieving the Contractor from the sole responsibility for all material and work upon which payments have been made or the restoration of any damaged work; or

(2) Waiving the right of the Government to require the fulfillment of all of the terms of the contract.

(g) Reimbursement for bond premiums. In making these progress payments, the Government shall, upon request, reimburse the Contractor for the amount of premiums paid for performance and payment bonds (including coinsurance and reinsurance agreements, when applicable) after the Contractor has furnished evidence of full payment to the surety. The retainage provisions in paragraph (e) above shall not apply to that portion of progress payments attributable to bond premiums.

(h) Final payment. The Government shall pay the amount due the Contractor under this contract after -

(1) Completion and acceptance of all work;

(2) Presentation of a properly executed voucher; and

(3) Presentation of release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically excepted from the operation of the release. A release may also be required of the assignee if the Contractor's claim to amounts payable under this contract has been assigned under the Assignment of Claims Act of 1940 (31 U.S.C. 3727 and 41 U.S.C. 6305).

(i) Limitation because of undefinitized work. Notwithstanding any provision of this contract, progress payments shall not exceed 80 percent on work accomplished on undefinitized contract actions. A contract action is any action resulting in a contract, as defined in FAR Subpart 2.1, including contract modifications for additional supplies or services, but not including contract modifications that are within the scope and under the terms of the contract, such as contract modifications issued pursuant to the Changes clause, or funding and other administrative changes.

(j) Interest computation on unearned amounts. In accordance with 31 U.S.C. 3903(c)(1), the amount payable under subparagraph (d)(2) of this clause shall be -

SCOPE OF WORK

PROJECT TITLE: Remodel Two Residential Bathrooms at Residence #45 at the Mount Rushmore National Memorial Housing Complex

SUMMARY:

Remodeling work is needed at the Residence #45 Master Bathroom and Front Bathroom, located within the Mount Rushmore National Memorial Housing Complex.

Master Bathroom Area: (Approximately 35 sq. feet) Front Hall Bathroom: (Approximately 40 sq. feet) Please note that the two bathrooms are located adjacent to each other inside residence #45. The interior partition / wall separates the two bathrooms, while plumbing and electrical serve each bathroom from inside the wall cavity.

The contractor shall furnish all labor, equipment, materials, transportation, supervision, and sufficient personnel for selected work as stated in this scope of work. Work will include but is not limited to:

residential bathroom construction demolition including mold and asbestos removal / disposal, interior wall partition construction, drywall installation, scraping and preparation of wood surfaces for primer and paint application, priming and painting, replacement of rotten wood base plates / sills, plumbing, electrical, rough and finish carpentry work, and fixture installation.

Park facilities and resources (both natural and cultural resources) that are near and adjacent to work locations must be protected before and during the work taking place to prevent damage. All damage resulting from work operations shall be repaired to its original condition or to the satisfaction of the COR at no additional cost to the Government.

Contractor must provide portable restroom facilities at the work location for use by contractor only.

Lead Based Paint Hazards:

This building and building materials in this project are known to contain lead based paint. All paint and painted surfaces shall be considered as lead paint containing, and the contractor will be responsible for following lead safe renovator / work practices and for complying with OSHA Safety and Health Regulations for Construction, Part 1926.62, Lead.

SCOPE:

A. Residence #45

A.1 Asbestos / Mold Remediation:

The work covered by this section includes furnishing all labor, equipment, materials, transportation, supervision, certification, and licensing necessary for the proper and safe removal, handling, and disposal of suspect asbestos / mold containing / contaminated materials in this project. For any other areas suspected to contain asbestos or mold, which would be impacted by the work involved and are not previously identified in the scope, the contractor shall immediately notify the Contracting Officer. Any additional areas identified as Asbestos Containing Materials (ACM) (friable and /or non-friable) shall be approved in advance for removal by the contracting officer. The contractor will be responsible for following Title 29, Code of Federal Regulations, U.S. Department of Labor, Occupation Safety, and Health Administration (OSHA) Standards: Part 1910.13 Respiratory Protection, Part 1926.1101 Asbestos; Part 1910.20 Access to Employee Exposure and Medical Records.

Available Asbestos survey reports: One Asbestos Survey has been performed at this facility; please see additional report attachment, conducted by Anderson Environmental Services, dated November 20, 2014.

Mold Remediation shall follow OSHA safety guidelines, as found at https://www.osha.gov/dts/shib/shib101003.html as well as Title 29, Code of Federal Regulations, U.S.

Department of Labor, Occupation Safety, and Health Administration (OSHA) Standards: Part 1910.13 Respiratory Protection.

A.1.1 Asbestos / Mold Disposal:

The contractor shall dispose of all asbestos-containing and or mold contaminated material in an EPA-approved landfill and upon completion of asbestos abatement, the contractor shall submit proof to the Contracting Officer that all of the asbestos containing materials have been disposed of in accordance with all applicable regulations. The government’s asbestos containing material shall not be mixed with asbestos containing contaminated waste generated by other entities. Manifests must reflect only material which was abated from this facility.

The classification, removal, and storage of any hazardous materials, if applicable, shall be performed by workers trained in accordance to the OSHA Hazardous Waste Operations and Emergency Response (HAZWOPER) standard in Section 120 of Chapter 1910 of Title 29 of the Code of Federal Regulations (29

CFR 1910.120).

A.1.2 Asbestos Quantities:

The quantities of suspect containing asbestos-containing building materials reported in this document are provided only as approximations. The following represents those quantities of suspect asbestos containing material that is in need of removal and disposal. Material: Tar / Mastic used for flooring adhesive:

(Approximately 25 sq. feet Master Bathroom) and (Approximately 40 sq. feet Front Bathroom)

A.2 Mold Mitigation / Removal:

A.2.1 Master Bathroom: Both dimensional lumber (2”x4” and 2”x6” stud walls) framing and drywall (gypsum board) are contaminated with Mold from a prolonged and unknown plumbing leak. The area of Mold that is visible is approximately 8 sq. feet. The interior wall partition located between the Front Hall Bathroom and Master Bathroom must be removed (complete). Any rotted wood framing or drywall (gypsum board) material must be removed including base plates surrounding the framework of the existing shower base (rotted) in the Master Bathroom. The Master Bathroom shower has been removed recently.

The entire interior bathroom partition wall shall be removed and disposed to allow for construction of a new partition wall.

A.2.2 Front Hall Bathroom: Unknown quantity of mold located in interior wall cavity, between Master Bathroom and Front Hall Bathroom. Partition wall is shared with the Master Bathroom Wall. Follow A.2.1 for removal of entire partition (complete).

A.3 Demolition / Debris Removal:

A.3.1 Master Bathroom Carefully remove the existing medicine cabinet, lighting fixture, vanity, sink, and toilet for re-use later in this project. Demo and remove interior bathroom wall partition (complete). Use caution during demolition to ensure electrical wiring and plumbing connections are not damaged. Support existing wall(s) with temporary supports / beams if necessary.

All building materials called for removal from this project shall be disposed of at the contractor’s expense, in an approved landfill.

A.3.2 Front Hall Bathroom:

Remove and dispose the vanity, toilet, sink, medicine cabinet, lighting fixture, tile flooring, and trim from this bathroom. These fixtures will be replaced with new in section A.9. Existing bathtub shower to remain unchanged in this project.

All building materials called for removal from this project shall be disposed of at the contractor’s expense, in an approved landfill.

A.4 Wall Replacement / Construction / Wood Framing / Drywall Installation:

A.4.1 Master Bathroom:

Provide a new wood frame wall using common dimensional lumber (2”x4” and 2”x6”) to match existing partition wall in kind. Anchor wall to concrete floor every 24 inches using concrete anchors. (Anchors to be

Install 5/8” drywall per manufacturers recommendations over complete partition (both sides of new partition) after plumbing and electrical work have been completed. Drywall finish shall provide a smooth transition to match existing drywall on each wall side. Repair all drywall cracks in entire bathroom to provide a smooth finish to match existing wall finish. Provide all wood framing coordination for A.5 shower installation below. Replace all deteriorated / rotted base plates under wood frame wall around shower base. (Shower has been removed)

A.4.2 Front Hall Bathroom:

Provide a 16” high x 24” wide plumbing access panel on Front Hall Bathroom side for access when plumbing repairs are needed to the Master Bathroom Shower. Plumbing access should be installed in the wall where existing access opening is located, unless plumbing to new shower needs re-configured due to new wall construction. Coordinate location with COR during construction.

A.5 Plumbing / Shower Installation:

A.5.1 Master Bathroom Replace all plumbing supply lines (hot and cold water) to existing fixtures using soldered copper pipe of equal size as existing. Make connections to existing supply lines above floor level inside new wall partition. Replace angle stop valves and provide new supply hoses for all fixtures. Provide escutcheon plates on wall for all plumbing protrusions to provide a smooth, neat appearance without any air gaps.

Install new drain, waste, and vent plumbing using PVC pipe, size to match existing. Replace Wet Vent in its entirety through existing roof vent, size to match existing. Install existing toilet and provide new wax ring. Ensure proper operation of all plumbing fixtures. Provide new fiberglass shower (glass doors not accepted) to be centered in existing shower space. Frame and coordinate with A.4 above for new shower installation. Ensure proper drain connection per manufacturer recommendation to existing floor drain (cast iron). All plumbing shall meet the laws of South Dakota Plumbing Code, SDCL 36-25. Plumbing fixtures (Toilets, faucet, showerhead) must meet EPA Criteria under the Water Sense label.

A.5.2 Front Hall Bathroom:

Provide new toilet and wax ring and install per manufacturers recommendation. Provide and install new vanity faucet, install per manufacturers recommendation. Make connections to all existing supply lines above floor level inside new wall partition. Replace angle stop valves and provide new supply hoses for all fixtures. Provide escutcheon plates on wall for all plumbing protrusions to provide a smooth, neat appearance without any air gaps. Ensure proper operation of all plumbing fixtures. All plumbing shall meet the laws of South Dakota Plumbing Code, SDCL 36-25. Plumbing fixtures (Toilets, faucet, showerhead) must meet EPA Criteria under the Water Sense label.

A.6 Finish Coatings

A.6.1 Master Bathroom Paint complete bathroom (130 sq. feet). Apply 2 coats of primer and 2 coats of paint per manufacturer’s recommendation. Primer and Paint shall be latex and not contain hazardous constituents such as lead.

A.6.2 Front Bathroom:

Paint complete bathroom to include closet and shelving (215 sq. feet). Apply 2 coats of primer and 2 coats of paint per manufacturer’s recommendation. Primer and Paint shall be latex and not contain hazardous constituents such as lead.

A.7 Flooring

A.7.1 Master Bathroom Remove all existing flooring tile and asbestos mastic, replace with vinyl flooring. Provide transition strip 28” between bathroom floor and bedroom carpet. A.7.2 Front Bathroom:

Remove all existing flooring tile and asbestos mastic, replace with vinyl flooring. Provide transition strip 28” between bathroom floor and hallway carpet. New vinyl flooring and underlayment to be installed per manufactures recommendation and per ASTM F1700 Standards. New ½ inch water / moisture resistant underlayment shall be installed over complete floor. Include closet flooring. Finished Flooring material must be produced out of recycled content. (no minimum percentage required).

A.8 Trim Molding

A.8.1 Master Bathroom Replace all base trim / molding to match existing. Base trim / molding to be primed and painted to match existing. Base trim / molding to be approved in advance by the COR.

A.8.2 Front Bathroom:

Replace 13 lineal feet of base trim / molding to match existing. Base trim / molding to be primed and painted to match existing. Base trim / molding to be approved in advance by the COR.

A.9 Fixtures / Cabinets

A.9.1 Master Bathroom Re-use and re-install existing vanity and existing medicine cabinets. Mount and install in existing position to replicate existing conditions before demolition.

A.9.2 Front Bathroom:

Provide and install new vanity to closely match existing (31”wide x 32”high x 22” deep). Provide and install new medicine cabinet with mirror to match existing, 24” tall x 16” wide.

A.10 Electrical:

A.10.1 Master Bathroom Coordinate replacement of all existing electrical wiring for all fixtures affected by this project. Install new wiring where needed to ensure proper operation of all lighting, ventilation, receptacles, and switches. All electrical work shall conform with NFPA 70: National Electrical Code.

A.10.2 Front Bathroom:

Provide new bar light / vanity light to closely match existing. Coordinate replacement of all existing electrical wiring for all electrical fixtures affected by this project. Install new wiring where needed to ensure proper operation of all lighting, ventilation, receptacles, and switches. All electrical work shall conform with NFPA 70: National Electrical Code.

B. FIELD VERIFICATION

The contractor shall field verify all new and existing measurements and provide all coordination of all disciplines and trades work affecting this contract.

D.1 Door / Hardware Replacement:

The contractor shall furnish all labor, equipment, materials, transportation, supervision, and sufficient personnel for the following door removal, disposal, and replacement.

Exterior Doors and Hardware

1. Front Door (36”) and Sidelight (Replace with 6 panel metal exterior insulated door; no window;

color white; replace sidelight in kind)

2. House to Garage Door (32”) (Replace with 6 panel metal exterior insulated door; no window, color white)

3. Garage to Outside Door (32”) (Replace with 6 panel metal exterior insulated door; no window, color white)

4. Kitchen to Outside Door (32”) (Replace with 6 panel metal exterior insulated door; include window, color white)

5. Kitchen to Outside Storm Door (32”) (Replace with aluminum storm door; color white, include window. )

6. All Exterior Door Hardware shall be installed with fully functioning round knob locksets (on interior and exterior of door) and deadbolts that must accept Government Owned “BEST” Brand Cylinder / Lock Cores. Contractor to coordinate with government to ensure proper compatibility.

Contractor Must Provide Corbin Russwin round knobs or approved equal, and the color shall be “Brushed Aluminum”. All door hardware to be installed per manufactures recommendation.

1. Furnace Room Door (28”) (Replace with Oak, 6 panel pre-finished door, color, golden oak)

2. Bathroom Entrance Doors, quantity 2, 28” each (Replace with Oak, 6 panel pre-finished door color, golden oak)

3. Front Bathroom Closet Door, quantity 1, 24” (Replace with Oak, 6 panel pre-finished door color, golden oak)

5. All interior door hardware shall be Schlage Model Numer F40 GEO 609 or approved equal, and shall be installed per the manufacture’s specifications. Color shall be “Bright Brass”.

D.2 Bi-Fold Closet Doors:

The contractor shall furnish all labor, equipment, materials, transportation, supervision, and sufficient personnel for the following closet door removal, disposal, and replacement: Remove all existing hardware including tracks and metal frames.

Provide new Bi-Fold closet doors at the following locations:

Master Bedroom, 1 set, 8’ x 80”

Other Bedrooms (2) and Hallway Closet (1), all are approximately 4’ x 80”

Contractor to provide framing as needed to install new Bi-Fold Doors per Manufacturers Specification.

Coordinate all drywall, taping, mudding, and finish work to provide a smooth transition to existing adjacent walls. Prime and Paint to match existing walls.

E - Inspection and Acceptance

52.246-12 Inspection of Construction. (APR 1996)

(a) Definition. "Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

(c) Government inspections and tests are for the sole benefit of the Government and do not -

(1) Relieve the Contractor of responsibility for providing adequate quality control measures;

(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.

(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

(g) If the Contractor does not promptly replace or correct rejected work, the Government may -

(1) By contract or otherwise, replace or correct the work and charge the cost to the Contractor; or

(2) Terminate for default the Contractor's right to proceed.

(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor.
