About this file
This document is a Justification and Approval (J&A) for a sole source contract with Aviate Enterprises Incorporated by the Department of Veterans Affairs, Long Beach Veterans Affairs Healthcare System (LBVAHCS). The contract is for an emergency one-year bridge contract to provide quarterly preventative maintenance and sterilization services for approximately 40 ice machines throughout the facility. The services are critical to ensure compliance with Veterans Health Administrative (VHA) Directive 1061(2), which aims to prevent Legionella Disease and scald injuries by maintaining water systems.
The sole source award is being made to a Service-Disabled Veteran Owned Small Business (SDVOSB) under statutory authority 41 USC §3304(a)(5) and 38 U.S. Code § 8127(c). Market research determined Aviate Enterprises Incorporated was the only vendor capable of performing the required services immediately, with 160 total maintenance services needed in the next year. The contract is valued under the $5 million threshold, and the vendor is certified in VetCert. The urgent nature of the requirement and the need to avoid a service gap justified the non-competitive procurement approach.
