About this file

This is a Justification and Approval (J&A) document for other than full and open competition issued by the Department of Veterans Affairs, Network Contracting Office 16, for a sole-source contract with King Albert JV, LLC under the unusual and compelling urgency authority (41 USC §3304(a)(2)).

The requirement is for a comprehensive building-envelope investigation and environmental assessment of the St. John VA Community-Based Outpatient Clinic in Reserve, Louisiana. The contractor must provide professional services including visual inspections, moisture mapping, infrared thermography, water-infiltration testing, air and bulk sampling, destructive testing under engineered containment, and root-cause analysis. The final deliverable is a comprehensive report documenting findings, identified water intrusion sources and pathways, corrective remediation recommendations, repair priorities, and associated cost estimates. The period of performance is 30 calendar days from issuance of Notice to Proceed, with an estimated value of $176,587.40. The J&A justifies the sole-source award based on the urgent need to address ongoing moisture intrusion and suspected mold contamination that threatens facility operations and patient safety. Market research identified 149 SDVOSB/VOSB firms under NAICS 541350, but none possessed the specialized expertise, immediate availability, and capability to meet the urgent 30-day timeframe. King Albert JV, LLC is a Service-Disabled Veteran-Owned Small Business certified firm. No public notice will be provided pursuant to RFO 5.202, as the unusual and compelling urgency exception applies. The document is signed by the Contracting Officer Representative (Kenneth Ward, General Engineer) and Senior Contracting Officer (Jennings Herbst).

Acquisition ID#: 36C256-26-AP-4794 the EPDM roofing system, exterior walls, canopies, wall-to-roof interfaces, penetrations, windows, doors, and representative interior spaces. Services include visual inspections, moisture mapping, infrared thermography, water-infiltration testing, air, surface, and bulk sampling, selective destructive testing under engineered containment, root-cause analysis, and assessment of structural and weatherproofing performance. The contractor shall provide a comprehensive final report documenting findings, identified sources and pathways of water intrusion, corrective remediation recommendations, repair priorities, and associated cost estimates.

Period of Performance (POP) for this project is 30 calendar days from issuance of Notice to Proceed (NTP).

Estimated Value: $176,587.40

4. Statutory Authority Permitting Other than Full and Open Competition:

( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by

RFO 6.103-1;

(X) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by RFO 6.103-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by RFO 6.103-3;

( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by RFO 6.103-4

( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by RFO 6.103-5;

( ) (6) National Security per 41 USC §3304(a)(6) as implemented by RFO 6.103-6;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by RFO 6.103-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

This requirement is justified under RFO 6.103-2, Unusual and Compelling Urgency, due to ongoing moisture intrusion, suspected mold contamination, and building-envelope deficiencies at the St. John Community Based Out-Patient Clinic (CBOC).

Previous assessments identified water infiltration and moisture-related conditions requiring immediate investigation to prevent further facility deterioration and potential impacts to patient care operations.

Market research conducted under NAICS 541350 identified 149 SDVOSB/VOSB firms; however, no multiple sources were identified that possessed the combination of specialized expertise, immediate availability, and capability required to meet the Government's urgent timeframe. This requirement necessitates specialized

Acquisition ID#: 36C256-26-AP-4794 experience in building-envelope investigations, moisture intrusion analysis, mold assessment, industrial hygiene, destructive testing, and healthcare facility operations.

Due to the urgency of the requirement and the need for rapid mobilization of qualified professionals to complete the assessment within 30 calendar days while maintaining environmental controls and occupant safety, use of the cited authority is warranted.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies):

Market research conducted with Small Business Administration Dynamic Small Business Search (SBA DSBS) demonstrates that 149 SDVOSB/VOSB certified with NAICS 541350 with potential capabilities to perform this work. However, due to the unusual and compelling urgency regarding this requirement, this will be sole sourced to King Albert JV, LLC, as to not affect patient safety.

Pursuant to RFO 5.202, the Contracting Officer is not required to provide the public notice otherwise required by RFO 5.201 when the proposed contract action is conducted under the conditions described in RFO 6.103-2 and the Government would be seriously injured if the agency complied with the time periods specified in RFO 5.203. Due to the unusual and compelling urgency of this requirement, the contract action will not be publicly posted.

7. Determination by the CO that the Anticipated Cost to the Government will be

Fair and Reasonable:

Based on historical data, there is reasonable expectation that a fair and reasonable cost can be negotiated. In addition, the Contracting Officer anticipates cost will be considered fair and reasonable based on comparing finalized cost to the Independent Government Cost Estimate (IGCE).

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Limited market research was performed using SBA DSBS for SDVOSB using NAICS 541350 and with FPDS. The recommended sole source award to King Albert JV, LLC, an SBA certified SDVOSB, was able to immediately diagnose and provide market research pricing for the work. There are no known Buy American Act exceptions to this requirement.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None at this time.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

11. A Statement of the Actions, if any, the Agency May Take to Remove or

Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

The Government will use the results of this assessment to better define future requirements and develop a comprehensive scope of work that can be competed among qualified sources. Upon completion of the investigation and identification of the moisture intrusion, mold, and building-envelope deficiencies, any subsequent remediation, repair, design, construction, or maintenance requirements will be acquired through full and open competition, or through appropriate small business set-aside procedures, as market conditions permit. Additionally, market research will be conducted sufficiently in advance of future procurements to identify qualified sources and maximize competition to the extent practicable. This urgent assessment requirement is intended to identify and mitigate immediate risks, while future corrective actions will be planned and procured competitively based on the findings and mission requirements.
