About this file

This document is a Limited Sources Justification for the Department of Veterans Affairs, specifically the Tucson Consolidated Mail Outpatient Pharmacy (CMOP), seeking to procure 143,678 Recycled Jean Coolers (11.5"x 10"x 6") from USVETSERV, LLC, a service-disabled veteran-owned small business (SDVOSB). The justification is based on FAR 8.405-6(a)(1)(B), which allows sole sourcing when only one source can provide supplies at the required quality level, with the primary rationale being the need to ensure stock while a new National IDIQ package is being established.

The procurement is urgent, with the first delivery needed by 09/23/2025, to prevent interruption of medication shipping to veteran patients. USVETSERV is the only known small business/veteran-owned business with a Federal Supply Schedule contract that has previously provided coolers meeting the Tucson CMOP's temperature sustainability requirements. The solicitation for the new IDIQ package is expected to go out on 08/01/2025, with an estimated award date of 09/01/2025, and will support all seven CMOP locations. An Intent to Sole Source was posted on SAM.gov on 07/09/2025, and the coolers are confirmed to be domestic end products.

(3) Description of Supplies:

Recycled Jean Coolers (11.5"x 10"x 6")

CMOP ID#: 14124.

Quantity: 143,678/bx.

3456 boxes delivered daily. This is approximately a 52 day supply.

The process of maintaining the correct temperature for these medications from the manufacturer to the patient is known as the "cold chain," and it's a critical component of the pharmaceutical industry. Many medications, including vaccines, insulin, and certain antibiotics, are highly sensitive to temperature fluctuations. Specialized packaging, such as insulated coolers with ice packs or gel packs, is used to maintain the required temperature during transport. Refrigerated transportation is vital for distributing essential medicines.

(4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized: This requirement is to ensure stock while a new National IDIQ package (36C77025R0002) is currently being established. The solicitation is expected to go out on 08/01/25.

Vendor USVETSERV, a VETCERT registered, SDVOSB, is the only known SB/VOSB vendor with a FSS contract, that has provided coolers that meet the required sustainability to hold the temperature for the minimum required time to the Tucson CMOP previously. The Tucson CMOP requires a delivery by 09/23/2025 so the CMOP will not run out of coolers to ship the required medications to the Veterans.

Soliciting and requesting samples for approval in that timeframe would at this time cause a hardship on the CMOP, due to shortage of staff at the CMOP primarily due to the DRP (Deferred Retention Program.

With the National IDIQ for this item having an estimated award date of 09/01/25, soliciting and testing for this requirement would be an unneccessary burden on the CMOP.

FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

FAR 8.405-6(b): Items peculiar to one manufacturer:

A patent, copyright or proprietary data limits competition. The proprietary data is:

These are “direct replacements” parts/components for existing equipment.

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.

(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination:

USVetServ, LLC, a VIP listed SDVOSB, has successfully provided the requested item in the past. Most recently for the Tucson CMOP on 07/11/25; contract #47QSWA22D0012 36C77025F0053.

The cost was determined to be fair and reasonable based off the lastthreeawards(contracts #36C77025F0025,36C77025F0034,and36C77025F0053).

(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.

Based on historical procurements that have been awarded to “USVETSERV” and IAW VAAR 819.7008(a)(1)&(3) & (4), a contracting officer may award a contract to a VIP-listed service-disabled veteran-owned small business (SDVOSB) using other than competitive procedures provided the anticipated award price of the contract (including options) will not exceed $5 million; USVETSERV has been determined to be a responsible contractor with respect to performance and in the estimation of the contracting officer, awarding a short term sole source contract to USVETSERV, represents the best value to the Government as USVETSERV has successfully provided the requested item in the past. Most recently on contracts #36C77025F0025,36C77025F0034,and36C77025F0053.
