About this file
This justification document outlines a brand name sole source procurement by the Department of Veterans Affairs for a Philips physiological monitoring system upgrade at the Fayetteville Veterans Affairs Medical Center. The procurement includes Philips monitoring equipment, accessories, installation services and training. Key details include a firm-fixed-price solicitation scheduled to be issued on August 5, 2021 as a Service Disabled Veteran Owned Small Business set-aside. The brand name justification is based on the Philips system being the incumbent equipment across VISN 6 which utilizes proprietary hardware and software, and services for the turnkey installation needing to be done by Philips North America LLC certified technicians. Market research identified two potential SDVOSB contractors, Four Points Technology LLC and Alliant Enterprises LLC, as authorized Philips distributors. The total value was not specified.

4. Statutory Authority Permitting Other than Full and Open Competition:
( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
( ) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;( ) ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;
( ) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4 ( ) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5;( ) ( ) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;
( ) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Veterans Integrated Service Networks (VISN) 6 uses Philips Physiological Monitoring systems across the entire healthcare system. Per Biomedical the Philips Intellivue system utilizes proprietary hardware and software.
Equipment or software of a different manufacturer would not interface with the existing system and would not be compatible and would require the replacement of existing equipment. This would cost the Fayetteville VAMC more than the savings gained from open competition, as Fayetteville VAMC would require a forklift upgrade. Purchasing a different brand name would require facility-wide changes to infrastructure (data cabling), new servers, hardware, etc. The services provided for the turnkey installation need to be done by Philips North America LLC certified technicians. Services from another source would void any OEM warranty.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Correspondence was sent to National Director Government Channels with Philips North America LLC on 6/30/2021 requesting Service-Disabled Veteran Owned Small Business partnerships able to meet the Governments requirements. The Philips Director confirmed that Alliant Enterprises LLC and Four Points Technology LLC are both authorized distributors and they encourage Veterans Affairs to use their SDVOSB partnerships to the maximum extent possible.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The CO will determine that pricing will be fair and reasonable based on competition. Prior to award price analysis of the proposed contract price will be performed and documented to sufficiently determine that the cost to the Government of the proposed acquisition will be fair and reasonable.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: The following market research was conducted to identify potential sources to fulfill the requirement for Fayetteville VAMC.
a. A search was conducted querying Government-wide database of contracts, other procurement instruments, and commercial databases. The requirement was not available via VA inventories including the VA supply stock program and VA excess, excess from other agencies, Federal Prison Industries (FPI), AbilityOne Program, Wholesale Supply Sources, and Medical Surgical Prime Vendor program.
b. Authorized distributor letters for Four Points Technology LLC and Alliant Enterprises LLC from
Philips North America LLC are on file.
c. Veterans Information Pages (VIP): Search conducted on 7/6/2021 utilizing NAICS code 334510 showed 3 SDVOSBs and 2 VOSBs. However, these vendors were not contacted because there was sufficient evidence that an SDVOSB set-aside would be possible.
d. A search conducted on VIP, Four Points Technology LLC and Alliant Enterprises LLC were both listed as a Service-Disabled Veteran Owned Small Business.
e. In a review of the System for Award Management (SAM) website, Four Points Technology LLC (Duns No. 089896737) and Alliant Enterprises LLC (Duns No. 121170653) are listed as a small business under this requirement’s NAICS code 334510 – Electromedical and Electrotherapeutic Apparatus Manufacturing with Size Standard of 1,250 employees.
f. There is a Small Business Administration class waiver for Electromedical and electrotherapeutic apparatus equipment under NAICS code 334510.
g. Deliverables for this requirement will be for domestic end products in compliance with the Buy American Act FAR 52.225-1(d).
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: NCO 6 will continue to conduct market research to ascertain if there are changes in the marketplace that would enable competition for future actions.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona
Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
