About this file
This is an Acquisition Plan Action justifying restricted competition for a commercial item procurement under RFO 12.102 Simplified Acquisition Procedures.
The Department of Veterans Affairs, Network Contracting Office 08 (Orlando, FL) seeks to procure eight (8) Surfacide Triple Emitter UV-C whole room Decontamination System Helios units for disinfecting hospital rooms at VISN 08 VA Health Care System. The procurement is justified as a sole-source award based on a determination that only one responsible source exists capable of meeting agency requirements. Competition is restricted under the statutory authority of 41 U.S.C. § 1901 and RFO 12.102(b). Market research identified only two FDA 510(k)-cleared UV-C disinfection devices available; Surfacide's Helios+ is the sole provider of continuous UV-C light technology (as opposed to pulsed xenon systems). Pulsed xenon technology operates at frequencies (5–30 Hz) known to trigger photosensitive epileptic seizures in approximately 3% of individuals with epilepsy and may exacerbate PTSD symptoms, making it incompatible with VA clinical environments where at-risk patients are regularly present. The justification notes that a synopsis posted on Contract Opportunities from August 18–26, 2026 generated no responses from the commercial marketplace. Price reasonableness was established through comparison with historical pricing from existing contract VA PO # 36C24826P1080, which procured three towers at a specific unit price; the current action procures eight towers at a lower unit price, resulting in a $46,000 savings. Delivery is 60 days or less after receipt of order, with no option years or additional services included. The requirement is certified as a bona fide need, and approval has been obtained from the Contracting Officer and one level above.

DEPARTMENT OF VETERANS AFFAIRS
RESTRICTING COMPETITION USING SIMPLIFIED PROCEDURES
FOR COMMERCIAL ITEMS IN ACCORDANCE WITH RFO 12.102
Acquisition Plan Action ID: 36C248-26-AP-5187
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 08, located at
13800 Veterans Way Orlando, FL 32827, in support of VISN 08 VA Health Care System at 13800 Veterans Way Orlando, FL 32827. Purchase Request number: 675-26-4-6440-0100.
2. Nature and/or Description of the Action Being Processed: This procurement is for ultraviolet disinfection/sanitizing system in accordance with RFO Part 12 Acquisition for Commercial Products and Commercial Services and specifically RFO 12.102 Restricting Competition, where acquisitions conducted under Simplified Acquisition Procedures over the simplified Acquisition Threshold (SAT) require a justification as described in RFO 6.104. This action will be awarded as a new firm fixed-priced purchase order.
3. Description of Supplies/Services : The ultraviolet disinfection/sanitizing system will be used to disinfect hospital rooms to destroy germs/microbes/bacteria on surfaces. The Surfacide Triple Emitter UV-C (Ultraviolet-C) whole room Decontamination System Helios uses three ultraviolet light emitting towers that can work together or individually, based on room size, shape, or need. System is operated by tablet for staff safety. This item is peculiar to one manufacture, Surfacide. Delivery is 60 days or less after receipt of order (ARO). No option years are included in the order, no service request other than delivery of product.

4. Statutory Authority Permitting Restricted Competition:
RFO 12.102 Restricting Competition. The statutory authority for applying the Simplified Acquisition Procedures is 41 U.S.C. § 1901 and is implemented by RFO 12.102(b) for Restricting Competition using Simplified Acquisition Procedures for Commercial Products and Services. Competition is restricted on this procurement for the reason below:
(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert
Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
5. Demonstration that the C Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Surfacide is the only one responsible source that offers an FDA-cleared continuous UV-C disinfection system capable of whole-room microbial reduction through simultaneous or independently controlled emitters that operate as a unified system. This disinfection system combines multiple emitters into one single system, operating together or as single emitters operating independently. This disinfection system maximizes the effectiveness of each emitter to significantly reduce shadows in a single operation.
The system incorporates a process for control of the emitters, including starting/stopping the system & reporting the operations status; thus, allowing operators to control the system from outside the room while the system is operating.
In addition, market research indicates that only two FDA 510(k)-cleared devices exist in this product category. Among them, the Helios+ UV-C Whole Room Microbial Reduction System is the only solution providing continuous UV-C light rather than pulsed xenon. Pulsed xenon devices emit rapid flashing light at frequencies (5 30 Hz) known to trigger photosensitive epileptic seizures in approximately 3% of individuals with epilepsy and may exacerbate PTSD symptoms. Because patient care areas regularly include individuals at risk, the safety profile of pulsed xenon systems is incompatible with deployment in VA clinical environments. Continuous UV-C output is therefore an essential, non-negotiable requirement.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
source contract with Surfacide, LLC was posted to Contract Opportunities on 08/18/2026 through 08/26/2026 and generated no responses from the commercial marketplace. Based on this research, has concluded that soliciting additional offers is not practicable, as Surfacide, LLC is the only responsible source capable of providing OEM-authorized full-service maintenance for the Constellation Vision System.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: A comparison of historical prices from existing contracts has been conducted and
(A detailed copy of the best value determination resides in the contract file. Reference VA PO # 36C24826P1080 purchased (3) UV-C disinfection towers at a unit price of each. This action procures (8) UV-C disinfection towers at a unit price of each; a saving of $46,000.00).
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: A review of the Small Business Administration (SBA) certification database on the SBA Veteran Small Business Certification Program (*VetCert) portal did not identify any capable Service-Disabled, Veteran-Owned Small Business (SDVOSBs), Veteran- Owned, Small Business (VOSBs), or Small Business (SB) manufactures of UV-C disinfection system
SDVOSBs, VOSBs, or SBs possess the capability to meet applicable Limitations On Subcontracting (LOS) when the requirement necessitates a product manufactured exclusively by a large business.
As described in Section 6 above, market research, in accordance with RFO Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
