SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5
Acquisition Plan Action ID: 36C248-25-AP-1885
1. Contracting Activity:
Department of Veterans Affairs, Network Contracting Office (NCO) 8, 8875 Hidden River Pkwy., Tampa, FL 33637, in support of the James A. Haley Veterans’ Hospital (JAHVH) at 13000 Bruce B. Downs Blvd., Tampa, FL 33612, 2237# 673-25-2-231-0049.
2. Nature and/or Description of the Action Being Processed:
The James A. Haley Veterans’ Hospital (JAHVH) Health Administration Services (HAS) has an urgent and compelling need for Basic Life Support (BLS), Advanced Life Support (ALS), Critical Care Transport (CCT), and Specialty Care Transport (SCT) services in support of its associated Community-Based Outpatient Clinics (CBOCs) in Hillsborough and surrounding counties.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Contractor shall furnish 24-hour Basic Life Support (BLS), Advanced Life Support (ALS), Critical Care and/or Specialty Critical ambulance transport services, to beneficiaries of JAHVH 13000 Bruce B. Downs Blvd., Tampa, Florida 33612, and outlying Clinics located in Hillsborough, Pasco, Polk, and Citrus County, in accordance with contract terms and conditions. The contractor shall provide all manpower, equipment, materials, supplies, vehicles, fuel and supervision necessary to perform all tasks. Contractor shall furnish these services for five (5) months from effective date.
4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this -procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition
Requires the Use of the Authority Cited Above (applicability of authority):
American Medical Response (AMR) can provide emergent and non-emergent services for JAHVH Veterans at a moment’s notice. AMR has COPCN in Hillsborough and Pasco and Hernando County, the primary service areas for JAHVH. If JAHVH encounters a break in service for AMR ambulance services, Veterans in need of urgent or emergent transport and Veterans with debilitating disabilities, would be in jeopardy of not being able to access their care. This break in service would also force veterans to use private insurance to pay for transport themselves or force the VA to pay more for non-contracted transportation rates.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
The proprietary nature of this service restricts other vendors from being able to provide required services with such short notice. In addition, the COR and program manager for Beneficiary Travel sent out an (RFI) Market Research to the following local ambulance companies, Medfleet, Americare, and Trans care/Crisis Center of Tampa Bay on 8/08/2024.
None of these vendors responded to their request.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable:
The estimated cost for a 5-month contract bridge for AMR services is $750,000. The CO determined the anticipated cost to the government will be fair and reasonable based on a comparison of the current in-place contract #36C24820D0023 and similar services that have been procured within both VHA and the Federal Government. The CO was able to confirm that multiple VA Medical Centers across the United States have procured/awarded similar services that JAHVH is requesting.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
On 01/27/2025, limited market research was conducted amidst the urgency and proprietary nature of the requirement. This agency is committed to the competitive spirit of all procurement regulations. It is our policy to seek full and open competition to the largest extent possible while fulfilling the necessary requirements. The proprietary nature of this equipment restricts other vendors from being able to provide support.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
As indicated above, there are no vendors with the required expertise, experience, and record documentation to enable them to fully support services of this type – that have expressed interest in serving JAHVH.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
None, as limited market research was conducted due to the urgency and proprietary nature of this emergency service request.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any
Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
VHA is committed to the competitive spirit of all procurement regulations. It is our policy to seek full and open competition to the largest extent possible while fulfilling the necessary requirements. Currently there is no anticipated competition for emergent and non-emergent ambulance services.
12. Requirements Certification:
I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
