About this file
This is a Justification and Approval (J&A) document for a sole source contract procurement by the Department of Veterans Affairs.
The VA's Network Contracting Office 17, located in El Paso, Texas, seeks to award an urgent, short-term fixed price contract to EVT, Inc. for certified clinical perfusionist services at the Audie L. Murphy VA Medical Center in San Antonio, Texas. The services include autotransfusion, ECMO support, and weekday, weekend, and holiday on-call coverage to support cardiothoracic surgical procedures. The estimated contract value for the six-month base period is $177,430.00, with purchase request number 671-26-3-066-0338 and acquisition plan action ID 36C257-26-AP-3833.
The procurement is justified under the authority of Unusual and Compelling Urgency per 41 USC §3304(a)(2), as implemented by RFO 6.103-2. EVT, Inc. is the sole source because it is already performing these services at the facility, with personnel fully trained, credentialed, and embedded in the clinical environment. The VA determined that immediate action is necessary to prevent risks to patient safety and ensure continuity of surgical operations, as any delay associated with onboarding or credentialing alternative sources would create unacceptable clinical risk. No other sources expressed interest in the acquisition in writing. The short-term contract is intended as a bridge requirement to sustain patient care while the facility completes a competitive acquisition for long-term services. The contracting officer and one-level supervisor above the contracting officer have certified the justification as accurate and meeting requirements for other than full and open competition.

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C257-26-AP-3833
1. Contracting Activity:
The Department of Veterans Affairs (VA), Network Contracting Office (NCO) 17, at 11495 Turner Road, El Paso, TX, 79936-1372, intends to enter into a sole source contract based on this Justification for Other Than Full and Open Competition for the South Texas Veterans Health Care System (STVHCS), Audie L. Murphy VA Medical Center (ALMVAMC), 7400 Merton Minter Street, San Antonio, TX 78229-4404. The purchase request number is 671-26-3- 066-0338.
2. Nature and/or Description of the Action Being Approved:
This procurement is an urgent, short-term Fixed Price (FP) contract required to maintain uninterrupted perfusionist support at the Audie L. Murphy VA Medical Center (ALMVAMC). Immediate action is necessary to ensure continuity of cardiothoracic surgical operations, which cannot safely proceed without qualified perfusionist staff. EVT, Inc., the current provider, is fully trained, credentialed, and embedded in the clinical environment and can continue performing these services without delay. This short-term action is strictly a bridge requirement to sustain patient care while the facility completes the competitive acquisition for long-term services.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The ALMVAMC requires certified clinical perfusionist services, including autotransfusion, ECMO support, and weekday, weekend, and holiday on-call coverage, to support ongoing and emergent cardiothoracic surgical procedures. Failure to secure immediate coverage would create unacceptable risk to patient safety and disrupt surgical operations.
A short-term FP contract is required to ensure continuous availability of qualified perfusionists until a fully competitive solicitation can be executed. EVT, Inc. is the only provider capable of performing without onboarding delays, training requirements, or credentialing gaps, and can immediately fulfill the full scope of perfusionist services. The estimated value for the six-month base period is $177,430.00.
4. Statutory Authority Permitting Other than Full and Open Competition:
Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by RFO 6.103-2.
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Immediate availability of qualified perfusionist support is essential to prevent risks to patient safety and continuity of cardiothoracic surgical services. EVT, Inc. is already performing at the facility, is fully trained in the ALMVAMC clinical environment, and meets all competency standards required by the VA, CDC, Department of Health, and The Joint Commission. EVT’s personnel can continue services without delay, making them the only practical and responsible source capable of meeting the urgent requirement.
