About this file

This is a Justification for Single Source Awards document from the Department of Veterans Affairs for a procurement action over the micro-purchase threshold but not exceeding the simplified acquisition threshold (SAT). The Erie, PA VA Medical Center requires De Mayo surgical positioning systems manufactured exclusively by Innovative Medical Products, Inc. to support its newly authorized Total Joint Program initiative for orthopedic surgical procedures including knee, hip, and shoulder cases. The systems are essential for safely positioning patients during total and partial joint replacement and repair procedures, with the goal of expanding surgical capabilities, reducing Care in the Community (CITC) referrals, and improving timely access to surgical care for Veterans. The contracting activity is Department of Veterans Affairs, VISN 04, Erie Medical Center (Acquisition ID# 36C244-26-AP-1308).

Market research included a Sources Sought posting (36C24426Q0200) from January 23, 2026 to February 3, 2026, which received only one response from BHPE LLC, a Service-Disabled Veteran-Owned Small Business (SDVOSB), with no evidence of capability to provide the products. Searches of VetBiz, SBA, GSA eLibrary, and ADDS UP found zero alternative vendors capable of supplying the requirement. The contracting officer intends to award a sole source contract under FAR 6.302-1 authority to Innovative Medical Products, Inc. (Large Business), citing that no other responsible source and no other supplies or services will satisfy agency requirements. The Rule of Two was not met, and no Non-Manufacturer Rule waiver was located. The contracting officer certification indicates the purchase is approved in accordance with FAR 13.106-1(b), effective December 30, 2025.
