About this file
This document contains a justification and approval for other than full and open competition along with an associated acquisition plan. The Department of Veterans Affairs requires 1,000 boxes of Dexcom G6 glucose sensors to be procured on a non-competitive basis due to the items being medically necessary and only available from the original manufacturer. The estimated value for the supplies is $1,694,931.20 with delivery required within 10 days. The acquisition plan identifies the requirement for med-surg supply items including glucose sensors from the VA CMOP in Leavenworth, Kansas. A request for quotation was posted on April 20th with a response due date of April 21st and planned award by April 23rd. The justification deems subcontracting opportunities not feasible due to regulatory restrictions.

Date: April 16, 2020
From: Julian Lake, Contracting Officer
Subj: Determination and Findings: No Subcontracting Opportunities
A review of the procurement was conducted to determine if subcontracting opportunities existed. Solicitation 36C77020Q0417 is for the procurement of MedSurg Supply items, with delivery to CMOP Chelmsford, MA, 761, listed in the RFQ.
Because of the nonmanufacturing rule (NMR) and the time it takes to attain a wavier for the NMR, it is not feasible to wait and attempt to attain a waiver. As a onetime buy, it is not expected that subcontracting opportunities exist. Therefore, a subcontracting plan is not required for this procurement.
Please note the contracting officer is Julian Lake as indicated in the market research and 2268. As indicated in FAR 19.705-2 as a Branch Chief I am one level above the Contracting Officer.
