About this file
This is a Sole Source Justification document submitted by the Department of Veterans Affairs (VA), Network Contracting Office (NCO) 20, for a bridge contract to provide Legionella Water Testing Services at the Boise VA Medical Center (BVAMC).
The acquisition covers water testing services across ten buildings at BVAMC, including water sample collection, laboratory analysis, reporting of analytical results, documentation, and recommendations necessary to maintain compliance with VA directives, infection prevention requirements, and public health standards. The justification cites unusual and compelling urgency as the basis for restricting competition under RFO 12.102 and simplified procedures under RFO 12.201-1. The incumbent contractor, Analytical Laboratories, Inc., possesses detailed knowledge of the facility's domestic water systems, sampling locations, testing schedules, and reporting requirements, along with necessary personnel, laboratory capability, certifications, and operational readiness to continue performance without interruption. The anticipated contract price is $10,349.02, determined to be fair and reasonable based on previously competed contract pricing and historical prices paid. The Government plans to conduct a full and open competitive follow-on acquisition consisting of a one-year base period and four one-year option periods. No additional sources expressed written interest in the bridge requirement, and no additional market research was conducted due to the need to prevent service interruption. The justification was certified by Contract Specialist Craig Brown and Contracting Officer William E. Havens on July 21, 2026, with JOFOC #FY26 - NCO 20 - 1841.

VHAPG Part 813.5 Simplified Acquisition Procedures for Certain Commercial Items Attachment 1: Request for Sole Source Justification Template >SAT-SAP under FAR13.5
Effective Date: 12/30/2025 Page 1 of 3 Revision: 02 Acquisition ID#: 36C260-26-AP-1556
DEPARTMENT OF VETERANS AFFAIRS
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH RFO 12.102
Acquisition Plan Action ID: 36C260-26-AP-2795
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 20, VISN 20 / Boise VA Medical Center, 531-26-3-5044-0098
2. Nature and/or Description of the Action Being Processed: This action is for a bridge contract to provide Legionella Water Testing Services at the Boise VA Medical Center (BVAMC). These services are required to ensure compliance with applicable Department of Veterans Affairs (VA) directives, infection prevention requirements, and public health standards governing domestic water systems. The bridge contract will provide continuity of these critical services while the Government completes acquisition planning, solicitation, and award of a competitive follow-on contract.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The contractor shall provide Legionella Water Testing Services for domestic water systems throughout the Boise VA Medical Center campus. Services include water sample collection, laboratory analysis, reporting of analytical results, documentation, and recommendations necessary to maintain compliance with applicable VA directives, infection prevention requirements, and industry standards designed to protect patients, staff, and visitors from exposure to waterborne pathogens.
4. Statutory Authority Permitting Restricted Competition: This acquisition is conducted in accordance with RFO 12.102, Restricting Competition; RFO 12.201-1, Simplified Procedures;
and RFO 6.104. The statutory authority for using Simplified Procedures for Commercial Services under RFO 12.201-1 is 41 U.S.C. § 1901, as implemented by RFO 12.102(b) for restricting competition on this procurement.
Competition is restricted under the following authority:
☒ Unusual and Compelling Urgency
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The Boise VA Medical Center (BVAMC) requires ongoing Legionella Water Testing Services across ten (10) buildings to ensure continued compliance with VA directives, infection prevention requirements, and public health standards. Any interruption in these services could delay the detection of waterborne pathogens, increase the risk of exposure to patients, staff, and visitors, and result in noncompliance with applicable VA requirements.

Legionella testing is a critical component of the Medical Center’s water management program and is essential to protecting the health and safety of Veterans, employees, contractors, and visitors.
Analytical Laboratories, Inc., the incumbent contractor, is currently performing these services and possesses detailed knowledge of the facility’s domestic water systems, sampling locations, testing schedules, and reporting requirements. The contractor has the personnel, laboratory capability, certifications, and operational readiness necessary to continue performance immediately without interruption.
Transitioning to another contractor during this short-term bridge period would create unacceptable delays in service continuity and increase the risk of noncompliance with infection prevention and public health requirements.
The bridge contract is necessary to ensure uninterrupted Legionella Water Testing Services while the Government completes the competitive acquisition for the long-term requirement, consisting of a one-year base period and four one-year option periods. Due to the urgent need to prevent a lapse in these critical services, the incumbent contractor is the only source capable of immediately continuing performance without interruption.
6. Description of Efforts Made to Ensure Offers Are Solicited from as Many Potential Sources as Deemed Practicable: The Government is actively preparing competitive follow-on procurement for the long-term requirement. Because this action is a short-term bridge contract intended solely to prevent a lapse in essential services, soliciting additional sources for the bridge requirement would result in unacceptable delays and increase the risk of interruption of critical Legionella Water Testing Services.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government Will Be Fair and Reasonable: The Contracting Officer has determined the anticipated price of $10,349.02 to be fair and reasonable based on previously competed contract pricing, historical prices paid, and the proportional value of the bridge period. The bridge pricing reflects no significant increase over the competitively established contract rates.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research supporting the long-term competitive acquisition has been conducted through previous competitive procurements and evaluation of commercial sources capable of performing Legionella Water Testing Services.
Because this action is a short-term bridge contract necessary to prevent a lapse in critical services, additional market research specific to this bridge acquisition was not conducted.
Conducting further market research would delay contract award and increase the risk of interruption of essential testing services. The incumbent contractor is currently performing the requirement and possesses the necessary familiarity, certifications, and operational readiness to continue performance without interruption.

Acquisition ID#: 36C260-26-AP-1556
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No additional sources expressed written interest in this bridge requirement.
11. Statement of the Actions the Agency May Take to Remove or Overcome Barriers to Competition Before Subsequent Acquisitions: The Government intends to conduct a full and open competitive acquisition for the follow-on requirement consisting of a one-year base period and four one-year option periods. Acquisition planning is currently underway to ensure adequate competition, sufficient lead time for prospective offerors, and uninterrupted continuation of these critical services.
12. Requirements Certification: I certify that the requirement outlined in this justification is a bona fide need of the Department of Veterans Affairs and that the supporting data under my cognizance included in this justification is accurate and complete to the best of my knowledge and belief.
