About this file

This document is a Request for Limited Sources Justification for the Department of Veterans Affairs (VA) Regional Procurement Office. The Eastern Oklahoma VA Health Care System requires computerized linen and scrub management equipment from L1 Enterprise, a Service-Disabled Veteran-Owned Small Business, for a total estimated value of $430,658.46. The specific equipment includes 2 ScrubEx 2.0 LV Dispensers, 2 ScrubEx 2.0 LV Remote Receivers, and 8 AlEx 2.0 LC-D Dispensers, all manufactured by Innovative Product Achievements LLC.

Market research conducted through multiple platforms revealed L1 Enterprise as the exclusive authorized distributor for these proprietary systems, which utilize unique Clearview software with an Authority to Operate (ATO) and are TRM approved. The procurement will be made against Federal Supply Schedule Contract 36F7971D0097, and the equipment is manufactured in America and compliant with the Trade Agreements Act (TAA). The justification cites FAR 8.405-6(a)(1)(B) as the basis for limiting sources, noting that only L1 Enterprise can provide these unique and highly specialized medical equipment systems.

FAR 8.405-6(a)(1)(B): Only one source can provide the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized: L1 Enterprises, a Service- Disabled Veterans Owned Small Business is (IPA)

Revision: 01 Effective Date: 09/01/2024

FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

FAR 8.405-6(b): Items peculiar to one manufacturer:

A patent, copyright or proprietary data limits competition. The proprietary data is:

These are “direct replacements” parts/components for existing equipment.

The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.

(5) Describe Why You Believe the Order Represents the Best Value: consistent with FAR

8.404(d) to aid the contracting officer in making this best value determination: Prices, Supplies offered on the schedule are listed and fix price for performance of specific task (e.g. installation, maintenance, and repair) GSA has already determined the prices fair and reasonable. By placing an order against a schedule contract using the procedures in 8.405, the ordering activity has concluded that the order represents the best value and results in lowest overall cost alternative to meet the government needs.

(6) Describe the Market Research Conducted: Market research was conducted following

FAR Part 10 using the NAICS Code 339112 for Surgical and Medical Instrument Manufacturing, alongside the keyword "Computerized Linen and Scrub Management Equipment." The search was executed utilizing several platforms, including SBA DSBS/Vet Cert, SEWP-V, GSA eBuy, FPDS, and the National Acquisition Center (NAC). Additionally, the Analytics, Data, and

Support Unified Platform (ADDS UP) was utilized, and the results are summarized below.

A search through the SBA DSBS/Vet Cert with the NAICS code 339112 and the keyword

"Computerized Lines" yielded no results. An RFI 1754817 was posted on GSA eBuy from April

20 to April 25, 2025. Two vendors responded: L1 Enterprise Corporation and Geo-Med, LLC. Geo-

Med, a service-disabled veteran-owned small business (SDVOSB), is an authorized distributor of

Medline products. They indicated via email that they could provide a scrub management system equivalent to the requested scrubEx items mentioned in the notice. However, they do not have a solution for the AlEx 2.0 secured linen cart requested in the notice.

The FPDS search revealed numerous results for the AlEx 2.0 and Scrubex systems. However, upon review, it was found that most of these purchases were made either by L1 Enterprise Corporation or by Innovative Product Achievements, the original equipment manufacturer.

Additionally, a source sought notice was posted on the Government Point of Entry under notice

ID (36C24W-25-AP-01) from April 20 to April 25, requesting that Exhibit A be completed and returned. Only one response was received, which came from L1 Enterprise. Details of the response from L1 Enterprise can be found in Exhibit A under P02 in the file. An email/RFI was also sent to SEWP-V to inquire about procurement no responses were received. Market research revealed there were no vendors available to provide the requested AlEx 2.0 and Scrubex systems.

A search of the NAC yielded no results, and a check of ADDS UP revealed twelve results under the L1 Enterprise contract number (see P02 in the file). The ScrubEx and AlEx units are proprietary equipment of (Innovative Product Achievements, LLC), as they both utilize the

Clearview software to function and are unique devices. The Clearview has an ATO and is TRM approved. The units communicate utilizing this software and reporting functions. No other equipment is compatible and therefore no other product or company can provide this equipment or solution.

(7) Any Other Facts Supporting the Justification: The requirement is manufactured in

America and is (TAA) compliant the procurement is on FSS contract 36F7971D0097.

(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made N/A

(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this sole source justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
