Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C257-25-AP-3079 JOFOC Tracker Number: FY25 - NCO 17 - 1295
1. Contracting Activity:
Department of Veterans Affairs, Regional Procurement Office West, Network Contracting Office (NCO 17) on behalf of the Texas Valley Coastal Bend Health Care System (TVCBHCS) Corpus Christi Outpatient Clinic (CCOPC), 925 S Padre Island Dr, Corpus Christi, TX 78405, proposes to enter into a contract on the basis of other than full and open competition to provide labor and materials for the emergency construction services for the replacement of HVAC Units RTU #5 and #6.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Work performed will be performed at the Corpus Christi Outpatient Clinic (CCOPC) at the address listed in number 1 above. The contractor shall be responsible for providing labor, materials and equipment for the construction services required for the replacement of HVAC Roof-Top Unit (RTU) 5 & 6.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The proposed emergency contract is for the urgent replacement of HVAC RTU #5 & #6. These HVAC units malfunctioned due to a power surge caused by a recent severe storm, posing a threat to the health and safety of patients and staff. Furthermore, this issue could lead to service disruptions, hindering the VA's mission. Immediate action is necessary to ensure the well-being of all individuals within the facility.
Due to this unusual and compelling urgency (FAR 6.302-2) affecting patient and employee safety, we needed to find a local contractor to complete the emergency requirement.
4. Description of market research conducted and results or statement why it was not conducted:
Market research was conducted immediately through SBA quick market search, and the local COR.
The market research shows there were multiple SDVOSB options in Texas. However, we needed a local contractor who can respond immediately. Market research showed there was 1 Service Disable veteran owned small business (SDVOSB) in the area that could complete the repairs. The identified company can respond immediately to the emergency requirement. The lead time for the equipment is 4 weeks for this identified company. Our market research showed other companies lead times were 10 weeks. Sole sourcing this emergency to the identified local SDVOSB is in the best interest of the Government.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
