About this file

This is a Justification and Approval (J&A) document for Other Than Full and Open Competition (OTFOC) issued by the Department of Veterans Affairs, Network Contracting Office 21, on behalf of VA Palo Alto Health Care System (VAPAHCS).

The procurement concerns an upgrade of existing AutonoMe Hospital Environmental Control Unit (ECU) systems within the Spinal Cord Injury (SCI) Center. The requirement includes 43 AutonoMe ECU hospital systems (Item A10000F), one installation package that encompasses system installation, train-the-trainer training, unlimited remote technical support, and a two-year warranty (Item Install), and four annual preventive maintenance plans for AutonoMe systems (Item SERV0102). The acquisition is being conducted as a sole source procurement under the authority of 41 USC §3304(a)(1)—Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements—as implemented by FAR 6.103-1. This is a firm fixed price Open Market contract for a new requirement. Market research confirmed that AutonoMe systems are proprietary to Accessibility Services Inc, the original equipment manufacturer, and no alternative sources or distributors could be identified. Only Accessibility Services Inc possesses the proprietary technical data, configuration control, and integration rights necessary to install, calibrate, and verify systems to VA clinical and biomedical standards. The sole source contractor is Accessibility Services Inc (LPYHTAXSUDB8), located at 6241 S TEX PT, Homosassa, FL 34448-5923, classified as a Small Business. Past procurement history on SAM.GOV identified two previous awards to Accessibility Services Inc: Award 36C24W25P0031 ($1,006,250.00, March 17, 2025) and Award 36C25723P0743 ($467,450.00, September 8, 2023). Fair and reasonable pricing will be determined by comparison to an Independent Government Cost Estimate and past procurement history. The J&A was approved by the Contracting Officer (Matthew Czeshinski), Director of Contracting (Nicholas Kluch), and Executive Director of the Regional Procurement Office West/Head of Contracting Activity (Curtis M. Jordan) on May 4-6, 2026.

1. Contracting Activity: Department of Veterans Affairs (VA), Network Contracting

Office 21 on behalf of Veterans Integrated Service Network (VISN) 21, VA Palo Alto Health Care System (VAPAHCS).

Purchase Request: 640-26-2-394-0045.

2. Nature and/or Description of the Action Being Approved:

This procurement is for the AutonoMe Hospital Environmental Control Unit (ECU) systems within VAPAHCS in accordance with FAR 12.102 Restricting Competition for the Acquisition of Commercial Products and Commercial Services, where acquisitions conducted are exempt from the requirements of FAR Part 6, but still requires a justification using the format of FAR 6.104-1.

The action will not be competed and will be procured as a sole source. The contract will be a firm fixed price Open Market contract. This is a new requirement.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

VAPAHCS requires an upgrade of the existing AutonoME Hospital ECU systems within the Spinal Cord Injury (SCI) Center. (X) (1) Only One Responsible Source and No Other Supplies or Services Will

Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by

RFO 6.103-1;

( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by RFO 6.103-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by RFO 6.103-3;

( ) (6) National Security per 41 USC §3304(a)(6) as implemented by RFO 6.103-6;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by RFO 6.103-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

AutonoMe is the only responsible source capable of meeting the VAPAHCS requirements for upgrading existing ECU systems in the SCI Center. The current veteran rooms are fully outfitted with AutonoMe hardware, software, integration cabling, and room-specific mounting infrastructure. The AutonoMe systems are a proprietary platform, and only the original manufacturer Accessibility Services Inc can provide compatible replacement components, firmware, software updates, device-level integrations, and the required functional interoperability with the existing system architecture.

Accessibility Services Inc is also the only source with proprietary technical data, configuration control, and integration rights necessary to install, calibrate, and verify the systems to VA clinical/biomedical standards. No other vendor can maintain, modify, or replace AutonoMe components without violating proprietary restrictions or compromising system functionality or veteran safety. To consider another manufacturer would create substantial duplication of cost to the government that is not expected to be recovered through competition.

7. Determination by the CO that the Anticipated Cost to the Government will be

Fair and Reasonable:

Fair and reasonable pricing will be compared to the Independent Government Cost Estimate, and Past procurement history.
