About this file

This document is a Change Order Notice issued by the Illinois Department of Natural Resources (IDNR) for a contract (P-12959) with Kash Helicopter to provide aerial application of herbicide to control bush honeysuckle in Pere Marquette State Park. The change order extends the contract termination date from June 30, 2020 to December 30, 2020 due to unforeseen early freezes in the region that caused the honeysuckle to go dormant before the herbicide could be applied. Extending the contract term by six months will allow for the herbicide application to occur during the proper fall timeframe when the honeysuckle is actively photosynthesizing. The original contract was established through the BidBuy procurement system, reference number 19-422DNR-LNDMG-P-12959.

The total cost of this contract is under $20,000, so a formal written contract was not issued. The contract term and modification terms are outlined in the BidBuy Purchase Order. The change order is being issued pursuant to the Illinois procurement code which allows for modifications to contracts due to unforeseeable circumstances. This change is germane to the original contract scope and its approval will enable IDNR to complete the invasive species control measures at Pere Marquette State Park.

Change Order Notice Agency: Illinois Department of Natural Resources Title of Procurement: Pere Marquette Helicopter Aerial Applicator for Invasives BidBuy Reference Number: 19-422DNR-LNDMG-P-12959

The Illinois Department of Natural Resources (IDNR) requires a change order to a contract P-12959 with Kash Helicopter to extend the contract termination date to Dec. 30, 2020. The Agency requires the change order as defined in 30 ILCS 500/1-15.12 and 720 ILCS 5/33E.

The contract to acquire and apply herbicide to designated areas within Pere Marquette State Park for the control of bush honeysuckle requires an extension in expiration date from June 30, 2020 to December 30, 2020, due to unforeseen conditions delaying the application of the herbicide. (Total cost is under $20,000 so no written contract exists. Contract term is stated on the Bid Buy Purchase Order. Were a Standard Stand Alone contract issued, the contract term being changed would appear in Section 3.1, page 8; modifications are authorized by Section 4.21, page 14.) The following conditions were the cause for delay:

This type of application can only be done in the fall after the oaks have lost their leaves and the honeysuckle is still actively photosynthesizing. When contract was written in August, DNR did not anticipate early freezes in November in southern Illinois. The honeysuckle went into dormancy (would not uptake chemical) before we could get it completed this year due to the heavy freezes we had in early Nov. In a typical year, we do not have those hard freezes so early in the year.

Extending the contract term by six months will allow sufficient time to apply herbicide during the proper window in Fall 2020.

The circumstances were unforeseeable at the time the contract was executed and changes are germane to the original contract.
