About this file

This justification and approval document outlines a sole-source, firm-fixed-price blanket purchase agreement between the Transportation Security Administration and Science Applications International Corporation. The agreement is for $40 million to provide operational test and evaluation support services for checked baggage, checkpoint, risk-based security, information technology, and cybersecurity programs over an 18-month period from 2020 to 2021. It represents a logical follow-on to the previous competitively awarded blanket purchase agreement with Engility Services, which was acquired by SAIC in 2019. The services include ongoing test planning, execution, analysis and reporting to support various TSA programs. This noncompetitive award is intended to ensure continuity of operations and minimal disruption to in-progress deliverables and testing activities until the recompete for these services is completed in April 2021. Market research is currently being conducted for the recompeted requirement.

SECTION I: Introduction

The Transportation Security Administration (TSA), Acquisition Program Management (APM)/ Test and Evaluation (T&E) Division and Contracting and Procurement propose to issue a Blanket Purchase Agreement (BPA) that restricts the number of sources considered (FAR 8.405-6)

The procurement request number is 2120200AP6414, and Contracting and Procurement’s J&A tracking number is

JA-2020-04-0509.

Per FAR 8.405-6(c), this acquisition is conducted under the authority of the Multiple Award Schedule Program.

SECTION II: Description of Action Being Approved TSA intends to issue a sole-source, Firm-Fixed-Price (FFP), Blanket Purchase Agreement (BPA) under the authority of FAR 8.405-6(a)(1)(i)(C) for work that is a “logical follow-on” to an original BPA. The value of the BPA is anticipated to be $40M with a period of performance of no more than eighteen (18) months (one-year base period and six-month option period) from the date of award.

(a) Contractor Name: Science Application International Corporation (SAIC)

(b) Type of action: Firm Fixed-Price BPA

(c) Amount: $40,000,000.00

(d) Type of funding: Operations and Support (O&S); Capital (X), Procurement, Construction and Improvements (PC&I) funds; (funding varies on project and program being supported)

(e) Year of funding: FY2020 and FY2021(varies on project and program being supported)

(f) Period of Performance: One-year base period and one (1) six (6) month option period

(g) Other brief descriptive words and phrases (e.g., sole source, name and address of contractor, etc.). This action is a Sole-Source, logical follow-on BPA to the previously competitively awarded Operational Testing and Evaluation Support Services (OTSS) BPA HSTS04-16-A-CT6037 in accordance with FAR 8.405-6(a)(1)(i)(C). Services to be provided by OTSS incumbent: SAIC, 12010 Sunset Hills Road Reston, VA 20190, formerly Engility Services, LLC, who successfully delivered testing services under the OTSS BPA for the last four (4) years. SAIC has the experience and knowledge, and is the only potential vendor with the ability to provide the urgent, ongoing T&E support required by TSA priority programs with minimal disruption of TSA mission needs.

SECTION III: Description of Supplies or Services

TSA requires Operational Test and Evaluation support services for Checked Baggage, Checkpoint, Risk Based Security (Threat Injects), Information Technology and Cybersecurity, and other field data collection activities as assigned.

OTSS provides ongoing test planning, execution, analysis and reporting support for these activities as well as other airport-based data collection and test activities supporting project teams within APM, Requirement and Capabilities and Analysis (RCA) and Security Operation (SO). The total estimated value of this contract action is $40M, which was based on the projected projects expected for the next 18 months; the breakdown is as follows:

Base Period (12 months from date of award) $27,578,920.36 Option Period One (6 months) $11,525,735.37

SECTION IV: Identification of the Limited Source Consideration Rationale

FAR 8.405-6 (a)(1)(i)(A) Urgent and compelling need exists and following the procedures would result in

Limited Source Justification FAR Part 8 unacceptable delays.

FAR 8.405-6 (a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized

FAR 8.405-6(a)(1)(i)(C) The new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

♦ Original BPA: HSTS04-16-A-CT6037

FAR 8.405-6 (b) Items peculiar to one manufacturer.

SECTION V: Description of Limited Source Rationale

The current Blanket Purchase Agreement HSTS04-16-A-CT3067, provided Operational Testing and Evaluation Support Services (OTSS) for Acquisition Program Management Test and Evaluation Division. That contract was awarded, via competition, on TASC on 4/5/2016. On 5/10/2016, TSA issued an administrative action to change the name on the award from TASC to Engility, due to Engility’s acquisition of TASC. Then, in 2019, SAIC acquired Engility and in April of 2020, SAIC submitted their novation request to TSA.

Due to the expiration of the original awardee from the GSA Federal Supply Schedule (FSS) Professional Engineering Services (PES) – 871 there is no longer a contracting vehicle to maintain T&E services, thus triggering this contracting action. Ongoing test planning and reporting activities, as well as pending test execution activities with an associated 20+ in-progress deliverables, makes a “logical follow-on” award to SAIC the course of action in best interest of the Government. This requirement is to continue existing support for OTSS until the recompete for these services is completed, which is expected to be awarded in April 2021.

SECTION VI: Contracting Officer’s Determination that the BPA Represents the Best Value

The contracting officer has determined that the anticipated price of this contracting action will be fair and reasonable based on comparison to historical pricing and previous price analysis/negotiations under BPA HSTS04- 16-A-CT6037. TSA is proposing to use GSA and GSA pricing has already been determined fair and reasonable.

TSA will also seek to negotiate rates that are equal to or below the rates that were on the now expired BPA.

SECTION VII: Market Research Description

Market research is currently ongoing for the recompete of this effort. A Request for Information was issued for the combined effort of Operational and Acceptance Testing Support Services (OATSS) on March 3, 2020 Additionally, forty-five (45) minute Technical Exchanges were conducted via face to face meetings and teleconference where TSA asked detailed questions to assess the capability of the market. There were a total of eight (8) technical exchanges conducted from March 11, 2020 - March 12, 2020. There were a total of eight (8) responses to the RFI.

Responses consisted of (5) small businesses and three (3) large business, of which it was determined that only two

(2) large business were capable of successfully supporting this requirement. Additionally, TSA researched the available GSA schedules from SAIC to determine the appropriate GSA schedule to utilize for this action.

SECTION VIII: Other Facts Supporting the Limited Sources Justification

The facts support the use of other than full and open competition under the authority of FAR 8.405-6(a)(1)(i)(C) for work that is a “logical follow-on” to an original order and as an immediate solution to maintain the 20+ in-progress BPA order deliverables critical to the TSA acquisition process and evaluation of innovative technology solutions and emergent threats. The proposed contracting action provides for minimal interruption to continuity of service while TSA continues the planning for a competitive award in for these services in FY21 that would allow for enough lead time for a smooth transition of services and deliverables. Below is a summary of actions that further support this requirement:

• The GSA contract GS-00F-092CA was awarded to Engility Corporation (DUNS 048341838). The GSA contract GS-23F-0008K was awarded to TASC INC (DUNS 069341972). TASC and Engility completed a merger on February 26, 2015, however TASC (formerly Engility Corp, now SAIC) will continue to operate as TASC, Inc., with the same DUNS, CAGE and TIN, for legal and contractual purposes. Engility Corporation created Engility LLC, but certified on SAM as Engility LLC dba Engility Corporation (DUNs 048341838). GSA contract GS-00F-092CA indicates award to Engility Corporation. TASC, Inc. amended their Articles of Incorporation whereby changing their name to Engility Corporation dba TASC.

• TSA awarded BPA HSTS04-16-A-CT6037 to TASC, Inc. on April 5, 2016. TSA issued an administrative modification to update the vendor’s information to Engility Corporation on May 10, 2016.

• TSA was notified on March 20, 2020 of the novation agreement from Engility Services (formerly Engility Corporation) to SAIC. When modification P00009 was issued to process the novation, it was discovered that the GSA Schedule associated with GSA contract GS-23F-0008K and DUNS 069341972 was cancelled.

As a result, the TSA BPA was cancelled as well.

• The current total estimated value of the BPA is $90M with approximately $75M awarded as April 2020 resulting in approximately $15M remaining under the current estimated value.

SECTION IX: Actions Taken to Remove Barriers to Competition

There were no barriers to competition when TSA originally awarded the BPA for these services. This BPA will permit TSA to meet the urgent need to complete in-progress deliverables and ensure there is no gap in service for essential test and evaluation activities and tasks, while providing adequate time for market research and other steps designed to ensure a full and open competitive contract for award in FY21 for Operational and Acceptance Testing Support Services.
