Evaluation Criteria for Competitive Procurement
Consulting Services for the Development of Complex Regulations
013023 (Revised)
Criteria:
1. Extensive knowledge of the Medicare/Medicaid Programs and Other Health Related Issues and Legislation The bidder must have a thorough understanding of the Medicare & Medicaid programs and other health related Federal programs/issues to evaluate operations and assess the impact of various health care financing factors upon the costs of Federal programs, and their impact on small businesses. This understanding should include comprehensive knowledge of the operations and activities of CMS' interrelationships with other programs to assess the effects of new or changing policy and to determine the effectiveness and extent of accomplishment of projects. The bidder must be able to serve as a senior advisor to the Director on a wide range of policy and regulatory matters. The bidder must have the ability and experience in assessing, advising and negotiating with senior leadership at the Federal level on complex health related legislative, regulatory, and policy issues. The bidder should possess strong communication skills both orally and in writing on healthcare related matters. The bidder must be able to draft language for various portions in the regulatory process (i.e., advance notice of proposal rule making, preamble, or text within the regulation).
2. Technical knowledge and skills related to the Federal regulatory process The bidder must be highly knowledgeable of the Federal regulatory process and have the ability to analyze the economic impact of new or existing regulatory policy on various sectors of the health care industry (e.g. providers, health plans, State agencies and others). The bidder must possess knowledge of the principles and theories of applied economic/econometric methods and techniques to monitor the costs and sources of funding for health care and related services and to analyze and interpret their impact on CMS programs, small businesses, and on the national, state, and local economy. The bidder must be a subject matter expert on health policy and regulatory matters at the Federal level. The bidder must have expertise on various regulatory impact provisions required by statute and or Executive Order (ie Federalism, SEBRFA, PRA, Small Business, state/local governments, tribes, etc.).
The bidder must be expert on the full range of Medicare/Medicaid issues and other healthcare related policies and issues. The bidder must have the ability to communicate concisely both orally and in writing complex issues and solutions. Keen analytical and negotiating skills are a prerequisite.
3. Ability to meet deadlines under strict time constraints
The bidder must have the capability to produce and deliver various documents such as, briefings materials, option papers, regulatory language and the ability to conduct a thorough analysis of new or existing legislation as it relates to any of the specific program areas under the Medicare and Medicaid program on short notice. The bidder must have the ability to work independently and respond on short notice to unforeseen events and issues. The bidder must have demonstrated experience in producing high-quality documents for senior government officials under tight timeframes with less than optimal direction.
4. Depth and Breadth of Experience The bidder must have a wide range of breath of experience of the Medicare & Medicaid program at the federal level, which includes coordinating and collaborating with senior leadership in the healthcare arena. The level of experience should be ascertainable and/or demonstrated in the review of proposals highlighting the bidder’s knowledge, skills, abilities, and experience and can be independently verified.
5. Price and Deliverables
The bidder must be in range of the price for the estimated level of effort and must be able to provide the deliverables upon request of the Director/Deputy Director or project officer.
