About this file
This file describes the Orange County District Attorney's Office Public Works Unit, an investigative and prosecutorial unit established in June 2011 within the Workers Compensation Insurance Unit to enforce prevailing wage and workers' compensation compliance on public works projects. The Public Works Unit collaborates with the Department of Industrial Relations, Employment Development Department, California Department of Insurance, and Contractor State License Board to investigate and prosecute contractors and their agents who underpay prevailing wages or commit workers' compensation fraud. The unit focuses on enforcing California Labor Code Section 1776, which requires contractors and subcontractors to maintain certified payroll records documenting employee names, addresses, social security numbers, work classifications, hours worked, and actual wages paid. All payroll records must be verified by written declaration under penalty of perjury and submitted in forms provided by the Division of Labor Standards Enforcement or equivalent computer-generated printouts containing identical information.
Since its establishment in June 2011, the Public Works Unit has filed 42 search warrants, served over 80 warrants, and obtained 4 grand jury indictments against various contractors and subcontractors for prevailing wage violations and insurance fraud. Common charging sections include Labor Code Section 1778 (taking or receiving portions of workers' wages), Penal Code Section 115 (false and forged instruments), Insurance Code Sections 11760 and 11880 (premium fraud and misrepresentation to insurance companies), and Unemployment Insurance Code Sections 2117.5 and 2118.5 (failure to report payroll taxes). Prosecutions have resulted in sentences ranging from 90 days to 7 years 4 months imprisonment, with convictions involving general contractors, subcontractors across multiple trades, and office personnel. Contact information for inquiries includes Deputy District Attorney Raymund Diaz and Investigator Eddie Gomez, with an insurance fraud hotline available at (714) 648-3650.
