About this file
This is a Request for Proposal (RFP) document for an operational audit of the Town of Los Gatos Fleet, issued by the Town of Los Gatos Parks and Public Works Department in California. The audit will evaluate fleet operations performance, focusing on vehicle usage, assignment, and maintenance practices rather than financial auditing. The Town manages 91 vehicles and equipment assets, including construction equipment, work trucks, police interceptors, administrative and undercover vehicles, trailers, off-road UTVs, and radar trailers. The Town completed an initial fleet assessment in 2024, which serves as a baseline for the audit scope. Specific response dates, due dates, site visits, bidders' meetings, and award dates are not detailed in this summary document excerpt, though proposers are expected to reference the attached 2024 assessment in their submissions.
The RFP does not specify pricing terms, contract amounts, funding sources, or set-asides in the available documentation. There is no incumbent contractor referenced, and the contract duration and renewal options are not outlined in the provided file excerpt. The audit represents the Town's effort to evaluate operational efficiency and effectiveness of its fleet management program as overseen by Parks and Public Works. Interested bidders should obtain the complete RFP package, including the 2024 assessment attachment, to understand detailed scope requirements, evaluation criteria, and submission instructions.

During the performance of this Agreement, the Consultant and its subcontractors shall not unlawfully discriminate against any employee or applicant for employment because of race, religion, color, national origin, ancestry, physical handicap, medical condition, marital status, age (over 40) or sex. The Contractor and subcontractors shall ensure that the evaluation and treatment of their employees and applicants for employment are free of such discrimination. The
Consultant and subconsultant shall comply with the provisions of the Fair Employment and Housing Act (Gov. Code, Section 12990 et seq.) and the applicable regulations promulgated thereunder (California Code of Regulations, Title 2, Section 7285.0 et seq.). The applicable regulations of the Fair Employment and Housing Commission implementing
Government Code, Section 12990, set forth in Chapter 5 of Division 4 of Title 2 of the California Code of Regulations are incorporated into this contract by reference and made a part hereof as if set forth in full. The Consultant and subconsultant shall give written notice of their obligations under this clause to labor organizations with which they have a collective bargaining or other agreement.
The Consultant shall include the nondiscrimination and compliance provisions of this clause in all subcontracts to perform work under the contract.
In the event the Town, as a result of supervising the Consultant's performance under the Agreement or after investigating a complaint by a third party, finds that the Consultant is or has been in violation of its agreement to comply with these Equal Employment Opportunity Conditions, notice of such violations shall be filed with the Town
Representative and given to the Consultant by depositing same in the United States mail, postage prepaid, addressed to the last known business address of the Consultant, with return receipt requested. Not later than 15 calendar days after the filing of said notice with the Town, a hearing shall be held by the Town Council for the purpose of ascertaining whether the charges contained in the notice are true, and, if true, whether the Consultant has failed to make a reasonable and substantial effort to comply with these Equal Employment Opportunity Conditions. Notice of the time and place of said hearing shall be given to the Consultant not less than 5 days prior thereto in the same manner as the notice of violations is given. During said hearing, the Town Council shall receive and consider any evidence offered by the Town Representative, the Consultant, and any third party. At the conclusion of said hearing, the Town Council shall determine the matter and its determination shall be final.
If after the hearing described above, the Town Council determines that the Consultant has failed to comply with these
Equal Employment Opportunity Conditions and has failed to make a reasonable and substantial effort to comply with said conditions, the Consultant shall be deemed in material breach of the Contract. It is understood that the Town will have suffered damage by virtue of said breach; and it being impractical and unfeasible to determine the amount of actual damage, it is agreed that the Consultant shall pay the Town, as fixed and liquidated damages, and not as a penalty, the sum of $100.00 for each calendar day during which the Consultant is found to have been in noncompliance.
Such monies may be recovered from the Consultant and its Surety. The Town may deduct any such damages from monies due the Consultant.
A finding by the Town Council that the Consultant has failed to comply with these Equal Employment Opportunity
Conditions and has failed to make a reasonable and substantial effort to so comply, or a finding of willful violation of the nondiscrimination provisions of the State of California Fair Employment Practices Act, or similar provisions of Federal law or Executive Order, in the performance of work on the project shall be deemed a basis for determining the
Consultant to be not a "Responsible Proposer" as to future contracts for which the Consultant may submit proposals. A finding of willful violation of the nondiscrimination provisions of the State of California Fair Employment Practices Act shall be deemed to have occurred upon receipt by the Owner of written notice from the California Fair Employment
Practices Commission that it has investigated and determined that the Consultant has violated said Fair Employment
Practices Act and has issued an order under Government Code §12970, or obtained judgment and order of enforcement under Government Code §12973.
7.11. ADHERENCE TO ALL LOCAL, STATE, AND FEDERAL LAWS
