| I do not know what criteria they use for approval from an IRB to access NCES survey data. If I say that we will apply for the access through the IRB application process, will that be sufficient? | The U.S. Department of Education (Department) may have research needs that require access to restricted-use data license agreements with the National Center for Education Statistics (NCES), with other agencies, and (potentially) with third parties. In the past, the Department has engaged in projects that required a vendor to provide an external (to the Department) Institutional Review Board to be able to review, approve and provide oversight in order to gain permissions to enter into restricted-use data license agreements. This requirement can only be fulfilled if the vendor has an in-house certified Institutional Review Board (IRB), or has the capacity to enter into an agreement with a third party independent Institutional Review Board who will agree to review, approve, and provide oversight for a research project involving data on human subjects undertaken by the vendor. Demonstration of capacity to enter into such an agreement can be achieved by documenting prior experience (precedent) in engaging in a relationship with a third party IRB, or by providing written commitment from a third party certified IRB for willingness to provide full services for the vendor. Of course, the vendor may also document the existence of an ‘in-house’ certified IRB. |
