About this file
This is a Sole Source Justification Form submitted to the Procurement Clearinghouse Unit (PCU) by the Colorado Department of Public Health and Environment (CDPHE), Air Pollution Control Division (APCD), Mobile Sources Program for the DETC System Maintenance project with Onterris Air Quality Services, LLC. The project involves migrating and modernizing CDPHE's legacy diesel emissions tracking systems, specifically the DOIP, DFSCP, DR2365 Vehicle Evaluation database management systems, and phone call records management system to cloud-based infrastructure aligned with modern industry best practices. The services include transitioning antiquated Visual Basic 6.0 applications from desktop-based systems to centralized web-based platforms to enable secure real-time data access across multiple locations. The contract term runs from July 1, 2022, through June 30, 2027, representing a five-year engagement with an initial approval of $150,000 and a current modification request increasing the total to $190,000 to accommodate Phase 2 renewal and additional work requirements.
The sole source justification is based on Onterris Air Quality Services, LLC's unique qualifications and institutional knowledge regarding these legacy systems, combined with their extensive experience in migrating obsolete programming languages and hardware infrastructure to modern platforms. The vendor is positioned as the only contractor capable of efficiently executing this work due to their over 20 years of experience with Visual Basic 6.0 applications and successful completion of similar migrations. A cost and price analysis comparison with the state's Office of Information Technology (OIT) demonstrated significant savings through the sole source approach, with Onterris proposing $111,000 total ($48,500 redesign, $2,500 one-time hosting, and $12,000 annual maintenance for five years) compared to OIT's estimated $502,500 ($155,000 redesign and $69,500 annual hosting and maintenance). The modification was approved and posted on the VSS as Intent to Sole Source VSS# 2027000033, with David Moreau and Steve McCannon serving as the division contact and program manager respectively.

A formal solicitation is required. Complete a Purchasing Determination Form.
Submit all required documents via the PCU Request Site.
B. Explain in terms of 1 through 4, above, the basis for your identifying this as a sole source?
A sole source is justified in the instance that this is the only vendor - not what the program may determine to be the best vendor. Is this the only vendor? Explain (See form instructions)…
The Diesel Emissions Tracking systems were built in Visual Basic 6.0. Microsoft officially ended support for this technology over 14 years ago (April 8, 2008) posing a significant challenge in supporting the systems as they will not run on modern machines. With over 20 years of experience working with these antiquated programming languages, Onterris Air Quality Services, LLC has the unique knowledge and skill set to support these systems and provide a successful transition.
With both software and hardware experience, Onterris Air Quality Services, LLC will be able to migrate the existing VB 6.0 application from a desktop client app to a centralized web-based platform.
Transitioning to a web application will enable secure real-time data access from all locations via any web browser.
Onterris Air Quality Services, LLC also has extensive hardware and networking experience. Since VB
6.0 does not work on modern machines, Onterris Air Quality Services, LLC’s unique combination of hardware and software experience is critical to an effective transition of these applications. Having successfully performed multiple similar migrations in the past, and completed much of the work already, Onterris Air Quality Services, LLC is qualified and positioned to efficiently manage this project.
The potential components of the contract include the system redesign cost of $48,500, a $2,500 one-time hosting cost, and annual ongoing hosting and maintenance of $12,000 for five years. This totals $111,000 for redesign and maintenance of the system. A cost comparison with OIT is $155,000 for the system redesign and $69,500 annually for hosting and maintaining the system for five years. This totals $502,500 for redesign and maintenance of the system.
The sole source modification request is proposed due to the organizational and operational risk associated with the current system(s) that is/are not completely functional, or interfaced with other existing ETC data management functions. The division needs to harmonize DOIP, DFSCP, phone call data and DR2365 Vehicle Evaluation database management systems into cloud network alignment, and bring them up-to-date with modern industry best practices as quickly as possible to maintain critical business continuity for vehicle evaluations & emissions test record/vehicle registration continuity.
C. What makes this good or service unique to meeting your needs?
The skills of the contractor, their unique understanding of the system based on institutional knowledge that no longer exists due to employees no longer being with the state, and their ability to execute faster than any other contractor or the state’s OIT.
Sole Source Justification 3 Version A2021
This service captures, records & maintains motor vehicle test records, fleet inventories, & vehicle evaluation data required in statute and regulation for vehicle registration and IM Program management.
D. Is the Good or Service Proprietary (product or technology entirely owned by the individual/company and usually protected by trademark or copyright)?
Yes ☐ No X
E. What type of required, specific and exclusive experience, certifications, licenses etc. are possessed by this vendor that directly relate to the good or service to be procured?

With both software and hardware experience, Onterris Air Quality Services, LLC will be able to migrate the existing VB 6.0 application from a desktop client app to a centralized web-based platform. Having successfully performed multiple similar migrations in the past, Onterris Air Quality Services, LLC is uniquely qualified and positioned to efficiently manage this project.
F. What research has the program conducted to justify this sole source?
We worked with OIT to develop a cost/price analysis to determine if they could do this work at a better rate and quickly to address the time sensitive nature of this project. Their price is higher for the project and their timeline will take longer. In addition, we tried to reach out to the original designer of the original system and they are out of business. There were also discussions amongst staff to determine if anyone could recommend a company that could work with the antiquated language used for the applications and this is the only company that was mentioned.
G. Do you have an actual or potential conflict of interest in this purchase?
(For example, is an individual from the Department or a family member affiliated with the vendor as an employee, board member, volunteer, etc.?)
Yes ☐ No X
If Yes: Please Explain. (This space is limited – please provide additional documentation if applicable.)
