About this file

This is a Service Level Agreement (SLA) document for the Michigan Department of Corrections (MDOC) Online High School Diploma program, effective June 1, 2018, under RFP #171-180000000963. The document outlines five key performance metrics for the contractor providing online high school education services to prisoners: Educational Functioning Level Gains, Educational Outcomes, LEIN compliance, Timely Reporting, and Staff Related Downtime. The contractor must ensure 50% of prisoner students achieve appropriate grade level Educational Functioning Level gains and score at a 10th grade level in reading and math or pass a High School Equivalency Test.

The SLA establishes specific financial penalties for failing to meet performance standards. Credits range from $500 to $48,000 for Educational Functioning Level deficiencies, and $5,000 to $90,000 for Educational Outcomes shortfalls. Additional $500 penalties apply per occurrence for LEIN compliance failures, late or inaccurate reporting, and staff coverage issues. Student progress is measured through TABE assessments at three intervals: pre-test, six-month assessment, and final post-test. The agreement includes detailed sliding scales for penalties based on the number of participating students, which can range from 30 to 400 students.

Metric 1: Educational Functioning Level Gains

Definition and Purpose

The Contractor must ensure 50% of prisoner students who start the program achieve appropriate grade level Educational Functioning Level (EFL) gains toward achieving a high school degree in accordance with Exhibit A, Project Scope, Section 3, Purpose and Attachment A – National Reporting System Benchmarks for EFL Level Gains.

Data Source:

Test of Adult Basic Education (TABE) Pre-test TABE six month interval assessment TABE Post-test (12 months) National Reporting System EFL Benchmarks

Methodology:

The State Program Manager will conduct individual TABE assessments to verify prisoner students’ progress toward grade level EFL gains achieved towards a high school degree.

The State program manager will also determine those prisoner students who were removed by MDOC or dropped out of the program as these prisoner students will not be counted within the metric.

Each prisoner student will be assessed at three set intervals after the prisoner student start date. The three set intervals are: Initial TABE Pre-test, TABE six month interval assessment and final TABE Post-test.

Acceptable Standard:

The Contractor must ensure that prisoner students who participate achieve appropriate grade level EFL gains towards a high school degree. 49% or lower prisoner student overall program grade level EFL gains will be considered an occurrence.

Service Level Credit

A credit to the State will be assessed for each range of prisoner students not achieving 50% EFL gains. The SLA credit will apply to the appropriate range as demonstrated in the provided table. Any credit assessed will be deducted from a subsequent payment.
