About this file

This Addendum No. 1 document, issued by R G Architects, LLC on behalf of the State of Delaware Division of Facilities Management, provides clarifications and revisions to the selective demolition package for the Old Sussex County Family Court Building located at 22 The Circle, Georgetown, Delaware 19947 (OMB/DFM Contract No. MJ0208000003). The project scope includes interior demolition work with selective removal of non-bearing walls, floor finishes, ceilings, interior doors and frames, and select mechanical, electrical, and plumbing fixtures, while fixed casework elements such as judges' benches and security desks are included in the demolition scope. Sealed bids must be submitted through the Bonfire Portal by April 15, 2026, at 1:00 p.m., with public bid opening and reading occurring at 2:00 p.m. the same day at the Haslet Armory in Dover, Delaware. A mandatory pre-bid meeting was held on March 24, 2026, with substitution requests accepted until April 6, 2026, at 4:00 p.m., and written questions accepted until April 8, 2026, at 4:00 p.m. The addendum specifies that all subcontractor lists must identify mechanical, plumbing, electrical, and elevator contractors, with restrictions on listing multiple subcontractors per discipline unless representing second or third-tier contractors. The project requires compliance with Delaware prevailing wage rates and includes a General Owner's Allowance of $25,000 for owner-elected changes.

The asbestos NESHAP inspection report attached to the addendum, prepared by Harvard Environmental, Inc. in August 2025, identifies two materials as presumed asbestos-containing: fire doors and elevator brake pads, both requiring further intrusive investigation for confirmation. All other materials tested, including fireproofing, drywall, joint compound, ceiling tiles, floor tiles, and mastics, tested negative for asbestos under polarized light microscopy analysis. The contractor must comply with State of Delaware prevailing wage requirements, craft training affidavit submissions during the award phase, and waste management standards requiring a minimum 75 percent diversion of construction and demolition waste from landfills. No liquidated damages clause is included in the contract; however, all conditions specified in the written contract will be enforced. Bid security of ten percent of the bid amount is required, and the successful contractor must provide performance and payment bonds equal to 100 percent of the contract price within 20 days of award. The solicitation includes equal employment opportunity requirements and ensures full bidding opportunities for Minority Business Enterprises, Disadvantaged Business Enterprises, Women-Owned Business Enterprises, and Veteran-Owned Business Enterprises.

INTRODUCTIONS AND EXECUTIVE SUMMARY

Harvard Environmental, Inc. herein presents data associated with inspections performed at the facility located at 22 The Circle, Georgetown, Delaware 19947. This inspection was performed to provide compliance with 40 CFR Part 61, “Asbestos NESHAP. These Environmental Protection Agency, (EPA), regulations require inspections to be performed by certified asbestos building inspectors prior to renovations and/or demolition of facilities. This effort was made at the request of Robert Purnell, DFM.

This project was performed to identify asbestos containing materials that would be impacted during future renovation of the interior of the building. Harvard Environmental Inc. assessed the impacted building materials which would be considered suspect asbestos containing. A listing of locations, systems and/or materials which were not assessed may be found under “Non-Assessed Conditions” found further in this report.

Based on the information provided to Harvard Environmental, coupled with field inspections and laboratory analysis of samples collected, asbestos containing materials were presumed to be associated with the interior of the specified structure during this inspection. However, fire doors within the building are presumed to contain asbestos materials.

Sampling was limited to accessible locations associated with the structure. If other suspect asbestos containing materials not presented in this report are encountered, Harvard Environmental should be contacted to schedule further intrusive investigations.

Provided is a summary listing of materials assessed under this inspection and testing. The detailed inspection data is provided as appendices further in the report.

This report is intended to provide “basic data” only. It is assumed that individuals reading and interpreting the sample locations and results, methods of analysis, and hazards associated with the materials are knowledgeable in all areas of discussion. Should any questions arise regarding the content of the information presented, contact should be exclusively to Harvard Environmental, Inc., at 302.326.2333.

In the event of changes to the condition of the materials or surfaces tested or changes to the scope of materials proposed to be impacted, Harvard Environmental should be contacted for additional testing and evaluation.

SUMMARY OF FIELD METHODS

Harvard developed field schematics to assist in documenting field assessments and to provide insight as to the location of suspect materials which may be associated with the structure.

To best document the assessment, Harvard Environmental, Inc. assessed the layout and design of locations requiring assessment and assigned each geographic area a unique alpha/numeric “grid” identifier. These identifiers are specific locations of the assessment and are the basis for orientation of the data.

The inspection was performed on 08/14/2025. The conditions described within this document are accurate as of the date of last visit. Mr. Leonard Woerner was the employee responsible for Harvard Environmental, Inc. employee who led the field efforts associated with the work.

OVERVIEW OF ASBESTOS INSPECTION

Representative sampling of suspect asbestos containing materials was performed on impacted materials. The sampling effort was conducted in accordance with EPA regulations and industry accepted standards.

Asbestos analysis was completed utilizing Polarized Light Microscopy, (PLM). PLM utilizes an optical microscope equipped with a polarizing lens through which trained microscopist can identify asbestos fibers according to their crystalline structure. This method of analysis is recognized throughout the industry as standard practice. Prior to

Harvard Environmental, Inc. 4 determining the type of fiber, the sample was placed under a “Stereo Microscope” at approximately 150X magnification for purposes of visual estimation. Various fiber types were pulled from the sample and oils applied to determine refractive indices under the polarized light microscope.

This recognized method of analysis has a detection limit of 1% by volume. Percentages of asbestos < 1% are reported as “trace” and are not considered asbestos containing materials under EPA regulations.

Non-organic binder type materials were typically manufactured with asbestos fibers milled to specifications which are smaller in size. These types of materials generally include roofing products, adhesive type materials and sealants. Often PLM analysis will not detect these fibers and as such produces “false-negative” asbestos results. Some degree of uncertainty still exists regarding the definition of non-asbestos materials. Per State of Delaware regulations, transmission electron microscopy (TEM) analysis is not required for non-organic binder floor tile and floor tile mastic type building materials which test negative for asbestos utilizing standard methods of analysis. TEM analysis provides higher magnification levels which will detect smaller fibers that would normally be undetected utilizing PLM analysis.

Based on the information provided to Harvard Environmental, Inc., coupled with field inspections and laboratory analysis of samples collected, asbestos containing materials were not identified to be associated with the interior of the building. However, fire doors within the building are presumed to contain asbestos materials. This inspection was performed non-intrusive in order to confirm quantities and asbestos content additional destructive inspections will need to be performed.

Provided is a summary listing of materials assessed under this inspection. The detailed inspection data is provided as appendices further in the report.
