About this file
This document is a justification for other than full and open competition for an emergency demolition contract. The General Services Administration Region 5 plans to award a sole source contract for architectural, engineering, and construction services to provide temporary facade bracing and demolish a building at 208-212 South State Street in Chicago, Illinois due to imminent structural failure. During a site visit on March 3, 2023, two areas of partial collapse were observed along with areas of incipient collapse and ongoing water infiltration, creating a threat to public safety. An initial award will be made as soon as possible for temporary facade bracing and design services, followed by a modification for construction services to demolish the site once design is complete. The estimated contract award value is $2,006,884 to an as-yet unidentified vendor, with an anticipated award date of March 22, 2023.

GENERAL SERVICES ADMINISTRATION
Region 5
230 S. Dearborn Street, Ste 3500 Chicago, IL 60604
Project Name: 208-212 S State Street Emergency Demolition
JUSTIFICATION AND APPROVAL
1. Contracting Agency and Activity. The General Service Administration,Region 5 plans to contract by means other than full and open competition. Select One option below.
☐Brand Name Justification (BNJ) Sole Source Justification (SSJ) ☐Other: (Identify LSJ)
If SSJ, Annotate the following: Vendor Name: UEI: Cage:
Vendor has not yet been identified.
2. Nature of Action Being Approved & Description of Supplies or Services:
During a site visit to assess building conditions on March 3, 2023 at 208-212 South State Street two areas of partial collapse were observed, areas of incipient collapse, as well as ongoing water infiltration. Structural failure is imminent. Failure or collapse of the building may impact the adjacent sidewalk and State Street. This has created a threat to public safety.
Therefore, a Design-Builder is necessary to provide architectural, engineering, and construction services for temporary facade bracing and demolition of the building as well as protection and stabilization of the adjacent properties, all of which are in the Loop National Register Historic District.
Due to the urgency of the situation to protect the public, an award will be made as soon as possible for temporary facade bracing and an allowance for design services for demolition of the site. Followed by a modification for construction services to demolish the site once the design has been completed.
3. The Estimated Design Build Cost at Award is $2,006,884.00.
4. If Sole Source, does Sole Source vendor hold a GSA Schedule (Utilization of FAR Part Eight (8))? ☐ Yes ☑ No ☐ N/A (If the answer is No or N/A, skip to No. five (5).
4a. If action will utilize FAR Part 8 FSS/GSA schedule, identify which circumstance justifies the LSJ action:
FAR 8.405-6(a)(1)(i)(a-c)☐A (Unusual and Compelling Urgency) ☐B (Only one source Identified) ☐C (Logical Follow-on to FSS order)
5. An identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)).
Authority for this action is provided at 41 U.S.C. 253 (c) (2) and FAR 6.302-2 Unusual and Compelling Urgency. The regulation states to use this authority in those situations where “an unusual and compelling urgency precludes full and open competition” and “delay in award of a contract would result in serious injury, financial or other, to the Government”.
6. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority (FAR 6.303-2(b)(5)).
Due to the risk of public safety, it is imperative that demolition of 208-212 South State Street be completed as soon as possible.
Structural failure has already commenced on the third and ground floors, was observed in its incipient stage in various other parts of the building, and active water infiltration is ongoing throughout. 208-212 South State Street is located in a high traffic urban area. Due to the height of the building, collapse of the structural elements may lead to failure of the facade onto the adjacent sidewalk and State Street. The building is not safe to be occupied. Portions of the ground floor and third floor have collapsed. It is believed roof failure is imminent, although the roof cannot safely be accessed due to the other structural failures, but through observation of visible sagging and water ingress. In its current condition the building poses a threat to public safety and must be demolished as soon as possible. Long term building stabilization is not viable.
7. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR
5.202 applies (FAR 6.303-2(b)(6)).
The Region 5 Project Team, with assistance from the Project Program’s Division (PPD), will identify a design build firm with the capabilities to complete this project. The team will review the company’s qualifications using their website, past performance, and CPARS to help select the firm to work with directly. The Region 5 Project Team will then participate in a capabilities meeting with the firm to ensure that the firm is available, understands the program of requirements, and can take immediate action.

8. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7)).
Prior to award of the proposed contract and subsequent modification, the prices will be negotiated and will result in a bilateral contract, agreed to by both parties. A Government Cost Estimate will be utilized to sufficiently determine that the cost to the Government of the proposed actions will be fair and reasonable.
9. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)).
Other than the selection method as stated in Part Seven (7), no additional market survey will be conducted in the selection of proposed contractors because of the urgency to procure these services. It is the belief that there are multiple companies that could perform the services needed. However, using traditional procurement methods will be counter intuitive to the emergency nature of this project.
10. Any other facts supporting the use of other than full and open competition (FAR 6.303-2(b)(9)).
All facts have been documented in Part Six (6). There are no additional facts to be reported in this section.
11. A listing of any sources that expressed a written interest in the acquisition (FAR 6.303-2(b)(10)).
None.
12. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated (FAR 6.303-2(b)(11)).
Given the unique and unusual circumstances of the situation, there are no actions that could be taken to remove or overcome barriers to competition.
13. Research to support the facts presented for the justification above.

RE: 208-212 SOUTH STATE STREET – HAZARDOUS CONDITIONS
TT Project No. C22207.00
Dear Mr. Young, On Friday March 3, 2023, Thornton Tomasetti (TT) accessed the building at 208-212 South
Street with Interactive Design Architects to review and document the existing condition. While onsite, two areas of partial collapse were observed, areas of incipient collapse were also observed as was ongoing water infiltration.
At the ground floor, a temporary ‘hallway’ is constructed, clad in plastic sheeting, that leads from the entrance to the stair to the upper floors. This ‘hallway’ is directly over one location of partial collapse and should not be used. While the subfloor and plywood covering the floor remain relatively intact, the joists below have collapsed (Photo 01).
At the second floor, TT observed a significant portion the third-floor framing in the easternmost bay of the building had collapsed (Photo 02). Additional framing at the boundary of the collapse were wet and at the incipient stage of collapse. TT observed the roof framing above the collapsed area from the second floor and it was also wet, however, close observations were not possible. A portion of the façade is now unbraced for two stories. A failure of the roof framing in this area could result in collapse of the street facing façade, as could a wind event in its current state.
Also at the second floor, the third-floor framing in the northwest corner of the building was visibly sagging with water actively moving through the floor system.
Mr. Charles Young
RE: 208 - 212 SOUTH STATE STREET
March 14, 2023 Page 2 of 4
Although not specifically observed, TT anticipates additional areas of deterioration at the roof level based on the noted ingress of water observed at each floor. Based on the conditions observed from below, the third floor was not accessed.
TT recommends that access to the building remains restricted, it is not safe to occupy. Under no circumstances should the roof be accessed. TT further recommends that a sidewalk scaffold is erected as soon as possible, continuous with the adjacent sidewalk scaffold at 214 South State and the canopy at 202 South State. Pedestrian access within the zone of 208 -212 South State should also be restricted. Due to the height of the building, a failure or collapse of the façade may also impact the street, therefore TT further recommends protection of the street through lane closures or other means. All protective measures should remain in place until the building can be demolished. Due to ongoing deterioration, further destabilization of the structure is anticipated.
Very truly yours, THORNTON TOMASETTI, INC.
