About this file

This is an anti-lobbying certification document required by the County of Orange, Sheriff-Coroner, in California for a competitive bidding solicitation for packaging of food and personal care items for re-sale. The certification serves as a material representation of fact and a prerequisite for bid submission, requiring the contractor's authorized official to affirm under penalty of perjury that no federal appropriated funds have been or will be paid to influence any officer or employee of a federal agency, member of Congress, or congressional employee in connection with the awarding of the contract. The document establishes that all subrecipients and subcontractors at all tiers must include identical certification language in their award documents and must certify and disclose accordingly to maintain compliance with federal requirements.

The certification is mandatory under 31 U.S.C. Section 1352 and carries significant penalties for non-compliance, including civil penalties ranging from $10,000 to $100,000 per failure to file. Contractors who submit false certifications are subject to the provisions of 31 U.S.C. Chapter 38, which addresses administrative remedies for false claims and statements. The contractor must complete the certification document by providing the company name, signature of an authorized official, the official's name and title, and the submission date. This certification is a standard federal requirement applicable to any procurement involving federal funds or federal participation.
