Statement of Work for Non-Jefferson Laboratories Complex Design Services
FDA Project No: OC-2024-120420 AAP No.: CNTL-24-C-0121
1. INTRODUCTION
The Office of Facilities Engineering Management and Services (OFEMS) is responsible for planning, design, acquisition, construction, maintenance, operation, and disposition of U.S.
Food and Drug Administration (FDA) owned and leased facilities across the agency. Within OFEMS, the Engineering and Management Branch (EMB) plays a pivotal role in this process.
EMB is currently in need of design services and is actively seeking the expertise of multiple Architectural-Engineering (A/E) firms. The primary objective is to secure crucial architectural, mechanical, electrical, structural, and engineering design services for FDA-owned facilities, excluding Jefferson Laboratories Complex (JLC) facilities in Jefferson, Arkansas. A/E services performed may include studies, evaluation, design, engineering services, architectural services and as services specified within this Statement of Work (SOW), and as more defined within the resultant task orders.
These services will facilitate the seamless completion of essential design tasks, which will subsequently be implemented in the construction phase, should funding allow. It's important to note that the scope of this work is limited to design services only, no construction shall be performed under this requirement. The resultant contract shall span a total period of performance of 5-years, with a minimum guarantee of $2,000 per IDIQ and aggregate maximum dollar value of $10M over the life of the contracts.
1.1. Background Information
OFEMS, committed to nationwide work environment improvement, collaborates with FDA laboratories personnel to manage diverse facility-related tasks. Within the organization structure of OFEMS, EMB oversees and manages various facility functions, such as space planning, furniture support, and engineering support for a range of facility-related activities.
These activities encompass facility-related studies, pre-design work, project design, post-design and the oversight of construction and alteration projects. EMB primarily focuses on project management, technical assistance, and oversight for design, construction, repair, and renovation efforts, as well as studies and other related support, all aimed at ensuring the fulfillment of OFEMS' mission.
As the demand for architectural and engineering support within FDA facilities increases, EMB recognizes the need of securing qualified support for a range of facility-related services. As a result, this SOW outlines the anticipated scope of work to be performed collectively; while individually awarded Orders will include more defined Statement of
Works, which will incorporate contractor defined technical plans, specific labor positions, deliverables and timeframes for the task, along with obligated funded.
1.2. Objective
The purpose of this procurement is to procure the services of a qualified architectural and engineering firm, within the geographical states of Alabama, California, Massachusetts, Maryland, and the U.S. territory of Puerto Rico. This requirement seeks facility-related services for FDA-owned properties managed by OFEMS. These services encompass a broad spectrum of disciplines, including but not limited to structural engineering, civil engineering, mechanical engineering, electrical engineering, fire protection engineering, plumbing engineering, utility systems engineering, data collection and analysis, and other engineering and science disciplines. The scope of work may also necessitate the involvement of other specialized professional disciplines, depending on the specific requirements and complexity of each individual task, but is anticipated to remain prominently under the scope of A/E services.
2. SCOPE OF WORK
The contractor shall provide professional services for all awarded tasks as outlined in this document. Awarded orders will be issued for various A/E design projects, within the following facility categories:
Laboratory (Lab) o Research laboratory o Specialized lab
Animal Research Mechanical / Electrical / Plumbing / Special Utilities / Central Utilities Plant (Utilities) General Purpose Facilities o Offices/Administrative o Public building and spaces o Site and grounds o Storage.
The A/E shall perform services in the following but not limited to site investigations, reports, evaluations, planning, programming, site surveys, design concepts, tentative design, working drawings and specifications, shop drawing reviews, preservation plans, post-design materials, and related document review.
Work may require drawings, design, specifications, study, cost estimates, reports and/or other services including, but not limited to: Programs of Requirements, Bridging Documents, Architectural and Engineering designs, Special Studies, Investigations, Acoustics Design, Historic Preservation Design/Management, Surveying and Mapping, Master Plans, and Design services as it relates to fire protection, sustainable design, environmental, survey, soil testing, geotechnical testing, and energy and water conservation. Design submittals may require building information modeling (BIM) as applicable on a per project basis. Other ad hoc A/E specialty services not mentioned may be required to design a complete project.
Services have been categorized into primary and secondary focuses. The primary category comprises most service types, all to be provided by the A/E. The secondary services may involve other professional disciplines as necessary, depending on the scope of any given project. The A/E shall oversee the delivery of these services, utilizing either in-house staff or engaging consultants/subcontractors as required. The A/E is expected to provide expertise in most of the primary types of services listed and at least half of the secondary services listed below. All services under primary are anticipated to be funded in the base year and subsequent years, as federally appropriated. Additionally, it is essential to note that a Program Manager is required for the overall management of contract vehicle, and Project Managers shall be designated for each specific order. Each order will identify the detailed required services.
2.1. Primary Services
The primary types of services the A/E may perform shall include the following:
a. Design Services: Shall furnish design services at specified submittal stages, determined by individual orders. These stages may include Program of Requirements, Special Studies, Schematic Design, Design Development/Conceptual Design, Post-Design, Design submittals, as relevant to each project, and must incorporate the current BIM, along with a mandatory construction cost estimate.
Additionally, the Contractor shall conduct specialized studies aligned with the order's scope of work. These encompass feasibility, pre-design, and pre-transfer studies, as well as subsurface and soil studies and other facility-related assessments.
In the design phases, the Schematic/Concept Design stage involves delivering foundational documents, such as schematic site plans, floor plans, elevations, and sections, including 3D views and a basis of design report. Progressing to the Design Development phase at completion level introduces additional elements like site grading and drainage plans, landscape plans, and detailed floor plans for each design discipline.
b. Planning Services: Shall include but is not limited to real estate analysis, programming, innovative strategies, project communications, building feasibility studies, development and performance of facility condition assessments, master planning, evaluations and surveys, and site planning.
c. Architectural/Civil Design Services: In addition to architectural and civil study and design, shall include but is not limited to code review and analysis, value engineering (VE), life cycle cost analysis, concept through design construction documents and specifications, innovative strategies, project communications, post occupancy evaluations, architectural renderings, and related services, Leadership in Energy and Environmental Design (LEED) analyses and quality control.
d. Structural Engineering Services: Shall include but is not limited to new and retrofit structural design, repairs, modification and modernization of existing and historic structures, feasibility and comparative systems studies, ground penetrating radar services, seismic studies and design, design of blast protection, value engineering, and related services.
e. Mechanical Engineering Services: Shall include but is not limited to performance of building evaluations, surveys, studies, design, calculations and documentation of heating, ventilating and air conditioning systems, hydronic piping systems, steam systems, chilled water systems, oil and alternative energy systems, design of facility management and control systems, creation and editing of specifications, Computational Fluid Dynamics modeling and analysis, energy modeling and analysis, LEED analyses;
code reviews, value engineering, life cycle cost analysis, quality control, and related services.
f. Electrical Engineering Services: Provide electrical engineering services for the study, design, of normal and emergency electrical distribution systems, uninterruptible power supplies, data centers, lighting systems (interior, exterior, and architectural), grounding, lightning protection, power monitoring, control systems, and underground utility infrastructures.
2.2. Secondary Services
The secondary types of services the A/E may perform shall include the following:
a. Electronic Engineering Services: shall provide technical services in the form of electronic system engineering design and technical support for specialties in the following areas.
Services shall include the generation of studies, construction documents (drawings and specifications). These services may be provided by more than one company for the market areas listed below, however all shall be independent of manufacturers.
b. Plumbing Engineering Services: shall include but is not limited to performance of building evaluations, surveys, studies, design and documentation of plumbing systems including domestic hot and cold water, sanitary (waste and vent) drainage, storm drainage and stormwater re-use, compressed air and natural gas, specification of plumbing materials and equipment such as domestic water heaters, booster pump systems, sewage ejectors, sump pumps, fixtures, and interceptors and related services, LEED analyses, value engineering, life cycle cost analysis, code reviews and quality control.
c. Design-Acoustical, Audio-Visual Engineering Services: shall include but is not limited to evaluation of room acoustics, design of sound isolation, environmental noise impact assessments, equipment noise reduction, testing and measurements, modeling and simulations, LEED analyses and audio-visual systems design and documents.
d. Envelope Design Services: shall include but is not limited to visual inspections and conditions surveys, roofing and waterproofing failure investigations, vegetative roof design, roofing, air and water infiltration, and waterproofing failure design reviews, construction documents and specifications for new construction, repair and replacement and related services.
e. Sustainable Design Services: shall include but is not limited to review specifications and plans, make recommendations for additions or changes to support the achievement of FDA sustainability and energy goals, credit achievement of LEED Certification, achievement of Guiding Principles requirements, experience with integrating building energy modeling into the design process to help drive scenarios analyses and understand the outputs given, in support of sustainable design, provide renewable energy feasibility studies and design, including technologies (such as photovoltaics, geothermal, solar hot water, wind energy systems and alternative fuel vehicle refueling or charging stations), and/or identification and evaluation of Energy Conservation Measures in existing buildings.
f. Commissioning Services: shall provide thorough evaluations and tests on mechanical, electrical, lighting, plumbing, building envelope, and elevator systems to ensure their readiness for operational use. This involves assessing proper installation, calibration, and integration, addressing any potential issues to prioritize efficiency and safety.
Additionally, the services cover commissioning planning, process management, testing, and troubleshooting for optimal system performance.
g. Fire Protection Services: shall provide analyses of building occupancy classification, means of egress, fire alarm system, water-based fire extinguishing system(s), non-water-based fire extinguishing system(s), smoke control system(s). Design of all fire protection and life safety systems, including, but not limited to fire alarm system, water-based fire extinguishing system(s), smoke control systems and stair pressurization systems.
h. Industrial Hygienist (IH) and Certified Industrial Hygienist (CIH) Services: shall be responsible to collect samples as required by the sampling method for the material of concern, provide oversight on asbestos and lead removal activities, evaluate sample results, prepare, and deliver timely reports on oversight projects and response actions, identify industrial hygiene concerns, and recommend solutions.
i. Security Assessment and Design Services: shall include but not limited to vulnerability assessments, feasibility studies, security master planning, resilience planning support (Continuity of Government); Physical Security and Force Protection engineering;
industrial security standards and policy development, commissioning, and systems engineering, access control, video surveillance, intrusion detection, intercom, duress communications, security and emergency operations centers, emergency communications systems; instrument controls engineering; data center engineering and efficiency; bulk fuel storage and distribution; infrastructure analysis; population movement and egress modeling.
j. Roofing and Waterproofing Services: shall include but is not limited to visual inspections and conditions surveys, roofing and waterproofing failure investigations, vegetative roof design, roofing and waterproofing failure design reviews, construction documents and specifications for new construction, repair and replacement, and related services.
k. Environmental Planning, Studies, and Design Services: shall include but is not limited to environmental assessments and impact statements. Environmental design, integrating environmental considerations into the design of a project, which could include creating designs that are environmentally sustainable, energy-efficient, and ecologically responsible. These services aim to ensure that a project is developed with careful consideration of its environmental impact, adhering to regulations, and incorporating sustainable practices.
Cost Estimating Services: shall provide pre-design and design stage estimates prepared by an independent construction cost estimating consultant using estimating software and utilizing specified electronic cost databases. Estimates may be require utilizing the specific FDA work breakdown structures within FDA templates and running FDA specific cost reports and macros.
Services delineated above will be described in more detailed specifics and site visits conducted prior to the award of resultant Orders.
3. ANTICIPATED ORDER TYPES
Resultant orders are anticipated to be awarded as Firm Fixed Price (FFP), Labor Hour (LH) or Time and Materials (T&M).
4. IDIQ PERIOD OF PERFORMANCE
Base year plus four (4) one-year options, for a total of five (5) years to be exercised annually at the Government’s discretion.
5. FUNDING
Funding will be obligated at the order level.
6. PLACE OF PERFORMANCE
Work will be performed at or in support of five (5) FDA-owned sites located in Alabama, California, Maryland, Massachusetts, and Puerto Rico. The addresses are as follows:

Due to the volume of work anticipated at certain locations, the FDA has established three regions” for which an IDIQ award is anticipated.
Region 1: Supports the Winchester, MA and Laurel, MD. To be eligible for award, the Contractor must have a physical home office (Headquarters) or a major regional office within a 200-mile radius of the Muirkirk Complex in MD, as well as the availability to hire subcontractors (or have regional offices) within a 100-mile radius of the Winchester laboratory in MA. A home or major regional office is defined as an office where policy is established and where management and control functions for all or a significant part of an Offeror’s business are performed.
Region 2: Supports the Dauphin Island, AL and San Juan, PR. To be eligible for award, the Contractor must have a physical home office (Headquarters) or a major regional office within a 200-mile radius of the Dauphin Island Complex, as well as the availability to hire subcontractors within a 100-mile radius of the San Juan laboratory in Puerto Rico. A home or major regional office is defined as an office where policy is established and where management and control functions for all or a significant part of an Offeror’s business are performed.
Region 3: Supports the Irvine, CA. To be eligible for award, the contractor must have a physical home office (Headquarters) or a major regional office within a 200-mile radius of the Irvine Complex. A home or major regional office is defined as an office where policy is established and where management and control functions for all or a significant part of an Offeror’s business are performed.
Working Hours: All field work shall be performed Monday through Friday from 6 A.M. to 5 P.M.
local time unless otherwise denoted or agreed upon (where applicable). No work shall be performed on Federal holidays or on days that the Government is closed unless otherwise denoted or agreed upon.
Federal Government Holidays: The Government hereby provides notification that Government personnel observe the listed days as holidays:
(1) New Year's Day (7) Labor Day
(2) Martin Luther King's Birthday (8) Columbus Day
(3) President’s Day (9) Veterans' Day
(4) Memorial Day
(5) Juneteenth (10) Thanksgiving Day
(6) Independence Day (11) Christmas Day
In addition to the days designated as holidays, the Government observes the following days:
• Any other day designated by Federal Statute
• Any other day designated by Executive Order
• Any other day designated by the President’s Proclamation
When any such day falls on a Saturday, the following Monday is observed. Except for designated around-the-clock or emergency operations, Contractor personnel will not be able to perform on-site under this contract with FDA on holidays set forth above. The Contractor will not charge any holiday as direct charge to the award.
It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation except as set forth within the award.
Nothing in this term abrogates the rights and responsibilities of the parties as it relates to stop work provisions as cited in the contract terms and conditions.
7. PROGRAM MANAGEMENT REQUIREMENTS
All efforts, material and work performed in support of this SOW must comply with applicable federal codes based on the requirements of the current edition of recognized and accepted building standards, codes, and regulations, including, but not limited to International Building Code (IBC), National Fire Protection Association (NFPA) and National Electric Code (NEC). It must also comply with the most current Health and Human Services (HHS) Sustainable Design Requirements (including Measurement and Verification (M&V), if applicable, such as for Green Building certification), HHS Program Manual Volumes 1 and 2, Executive Orders, if applicable and as noted in the order requirements, NIH Design Requirements Manual (DRM), and the FDA Supplementary Design Guidelines (SDG) to the NIH DRM. Any conflicts or ambiguities within or among the referenced standards and criteria documents, or any deviations from requirements contained in the documents, must be reported to the Contracting Officer in writing, for determination as to applicability.
Also as required by Federal Acquisition Regulation (FAR) 36.6, the A/E Contractor shall be permitted by applicable State law to practice the professions of architecture or engineering.
Programmatic tasks the A/E shall perform:
Coordinate all project related activities including documentation through the Project
Officer/Contracting Officer’s Representative (PO/COR) for approval unless otherwise denoted.
Provide timely and appropriate communication to and coordination efforts with the EMB team working, facility managers, as available, and the PO to avoid disruption of facility operations while performing contract work such as meetings, proposed phasing plans, outage notifications, etc. (where applicable).
Provide to the PO a list of employees and sub-contractors who require access to the FDA premises per project with projected duration.
Perform all associated project work in accordance with Executive orders, Energy Policy Act (EPACT), Energy Independence and Security Act (EISA), Sustainable design, and Federal Regulations; Local City, County, and State building codes and regulations;
National Fire Protection Association (NFPA) and National Electric Code (NEC), American Society of Mechanical Engineers (ASME), Occupational Safety and Health Administration (OSHA), American National Standards Institute (ANSI), and Institute of Electrical and Electronics Engineers (IEEE) rules and regulations and standards; and all other applicable industry standards.
Provide all necessary drawings, documentation, and literature for all required items where applicable.
Be responsible for the safety of their contractor personnel and shall follow all applicable health and safety code requirements.
Ensure compliance with personnel and physical security requirements, common access card requirements, and all other security measures instructed by the Agency. Personnel and badge use will be determined at the Order level.
8. FURNISHED MATERIALS AND/OR EQUIPMENT
To be determined at the order level.
8.1. Government Furnished Material and/or Equipment
The availability and extent of Government Furnished Material and Equipment (GFM/GFE) can differ depending on the specific order and the type of work being carried out. The provision of GFM/GFE is contingent upon request and is subject to obtaining the required clearances and approvals, as outlined in the individual orders.
8.2. Contractor Furnished Materials/Equipment/Resources
The Contractor shall provide all materials, equipment, and/or software required to execute the scope of work under the awarded Orders.
9. DELIVERABLES
Specified deliverables and/or reports will be identified at the Order level. At a minimum, the following deliverables will be required:
a. Project Meetings The A/E shall attend and document all meetings attended by the Project Team and/or other approved parties, to include technical issues, procedures, progress, problems, coordination, scheduling and other appropriate matters. The A/E shall participate in meetings including, but not limited to:
• Progress meetings
• Review meetings
Meetings will be held at location(s) specified by individual orders and/or mutually agreed by the Project Team. The A/E shall prepare and provide minutes, in the format determined by the Order Project Officer, within seven (7) working days for all meetings, or as otherwise directed at the Order level.
For the purposes of this requirement, the meetings stated above shall be described as follows:
1) Progress Meetings: The purpose of the progress meeting is to review the progress of the project in accordance with the schedule, status of submittals, and resolve any outstanding issues. Frequency of progress meetings shall be specified by individual task orders. The progress meetings shall be held virtually (MS Teams, Zoom) or per conference call unless otherwise denoted or agreed upon.
2) Review Meetings: The Review meeting may be scheduled by the Order PO to clarify review comments from various disciplines. The Government will provide appropriate representatives authorized to make technical and programmatic decisions necessary to maintain progress. The A/E shall send appropriate representatives consistent with the level of development and the nature of review. The representative(s) shall be qualified and authorized to make the technical decisions as required to maintain effective progress.
The Contractor shall participate in additional meetings (such as review meeting) when prevailing issues require their input or resolution.
b. Master Project Schedule The Contractor must assist FDA in the development and maintenance of a master project schedule used to coordinate stakeholder responsibilities for the project. The Contractor assistance includes recommendations on stakeholder integration and a logic-based schedule with the activities for which the Contractor is responsible to perform per this contract. The master project schedule must conform to the milestones and durations provided in the Project Schedule.
c. Monthly Status Report The A/E shall provide, at a minimum, the following status updates per Order monthly:
• Monthly Status Report per Order: The Contractor must provide monthly schedule updates to FDA, showing progress on and completion of all required work. The Contractor must immediately notify FDA of any anticipated delay in performance of any work. As work progresses, the contractor will provide monthly updates to FDA for the FDA Master Project Schedule.
• Funding status per Orders
• Milestones and accomplishments and personnel assigned.
The Contractor shall ensure effective communication and coordination among the Program Manager and Order level Project Managers to guarantee the timely, accurate, and complete submission of the required deliverables in accordance with the timelines stipulated in the order.
d. Database/Tracker of Project Activities The A/E must utilize an information tracking or database system to ensure the timely receipt and processing of all submittals, as well as to monitor project activities. This system should be based on a detailed work breakdown structure schedule outlining the completion timeline for all Design Stage activities, tasks, submissions, design meetings, workshops, and review durations as specified herein, leading up to and including the final design development submission(s). Furthermore, the Contractor is responsible for diligently reviewing all activities, including the order's activities and deliverables log, to ascertain the specific deliverables expected for each individual project. These deliverables may encompass a range of items such as studies, reports, narratives, specifications, estimates, drawings, and any other project-specific documentation as explicitly outlined in the order.
e. Transition Plan Before starting work, and during the initial evaluation, the A/E shall provide a Transition Plan that outlines a structured approach for effectively managing changes, minimizing disruptions, and ensuring a smooth progression from one project phase to the next. This plan is a critical component of project management, aiding teams in adapting to changes while upholding project objectives and meeting client expectations.
Additionally, the capacity of the Contractor and proposed subcontractors to execute the work within the stipulated time frame is crucial. The A/E firm must exhibit the capability for timely responses and deliverables, even while concurrently handling multiple task orders involving various engineering disciplines. The A/E is expected to provide expertise in most of the primary services/tasks identified in the Order. The Contractor must also demonstrate their capacity to provide sufficient and qualified management/admin/technical personnel to support the accomplishment of at least four (4) individual A/E design tasks from the primary services and the identification of proposed subcontractors for the services it will not provide for orders estimated between $10,000 and $1,000,000.00 simultaneously.
f. Management Plan The A/E shall provide a narrative describing the company’s approach to manage the overall success of all awarded orders, ensuring flexibility and capacity is maintained in the selection of order project teams to ensure successful execution of individual and potentially multiple projects simultaneously. The management approach shall demonstrate:
a) effective and adequate selection procedures for staffing, managing & coordinating in-house disciplines and consultants over the duration of the order, individually and collectively,
b) adherence to Project Management responsibilities including the draft and maintenance of detailed records and documentation of the project for submittal to FDA, and
c) a detailed methodology /procedures for assuring quality control throughout the design process.
The A/E shall also provide an organizational chart with the names of the individuals assigned to the overall management of the project and for each order. After an order is awarded, substitutions for key personnel or changes to the subcontractors will not be accepted unless approved by the Contracting Officer. The Contractor shall appoint a Project Manager who will be the Government’s primary point of contact and provide all necessary project representation for the successful accomplishment of the work. The Project Manager shall be thoroughly familiar with all requirements and schedules. The Project Manager and any key personnel identified at the Order level must be reviewed and approved by the Government prior to the Order award.
Attachment 1 – Labor Categories provides the minimum years of experience, education, and certification for proposed positions that may be applicable.
10. DELIVERABLE FORMAT/ACCEPTANCE CRIETRIA
The content requirements, to include format and the due dates, will be identified in each order or where no dates are denoted will be mutually agreed upon by the Order assigned COR and the Contractor after Order award.
Deliverables specified to be in electronic form may be delivered via designated method in accordance with FDA IT security requirements. All deliverables, including the electronic copy, which shall be written in an approved and supported application which FDA can access.
The CO and/or COR will accept or reject deliverables within thirty (30) calendar days after delivery. If rejected, the Contractor shall make corrections as specified and resubmit the deliverable for review and approval within the agreed upon timeframe, or not later than fifteen
(15) calendar days from notification of the rejected deliverable and at no additional cost to the Government for re-work.
11. DATA RIGHTS AND RELEASE OF INFORMATION
All data rights associated with the deliverables, reports, studies, drawings, CAD, images, and any other project-specific documentation produced shall become the property of the Government. The Contractor shall transfer ownership of these materials to the Government promptly upon completion, and the Government shall have the right to use, reproduce, distribute, and modify them as deemed necessary for official purposes.
All documentation shall be the property of FDA. Documentation and information shall not be released to any other agency (government, private, or individual) without the prior approval of the Contracting Officer and COR.
12. PROGRAM ADMINISTRATION
The Government’s points of contact will be the assigned Contracting Officer and the delegated Contracting Officer’s Representative of record. The Contracting Officer is the only individual with the authority to modify the terms and conditions of the resultant contract/order.
