About this file
This is a permit exemption verification letter issued by the Northwest Florida Water Management District (NWFWMD) to Charles W. Cotton regarding a transportation infrastructure project in Walton County, Florida. The project involves the construction of a northbound right-turn lane at the intersection of U.S. Highway 98 and County Road 393 South in Santa Rosa Beach. The scope of work includes paving approximately 250 linear feet of new turn lane within the existing Walton County right-of-way, drainage enhancements, clearing and grubbing of the project site, and installation of approximately 30 linear feet of retaining wall. The contract duration is 120 days to substantial completion with an additional 30 days for punch list completion.
The District determined that the project is eligible for an exemption under rule 62-330.051(4)(c), meaning no District permit is required pursuant to the specified rule reference. This exemption also constitutes an express waiver of water quality certification under Section 401 of the Clean Water Act, 33 U.S.C. Section 1341, and State Water Quality Certification is waived for the exempt activity. The applicant remains responsible for meeting all permit requirements of other agencies beyond the District's jurisdiction. Contact for questions regarding the District's requirements is Ashley Austin at (850) 951-4660.

Re: CR 393 Northbound Right Turn Lane Application # PDEX-131-325821-1 (Please reference the above number on all correspondence)
Dear Charles W Cotton:
The Northwest Florida Water Management District (District) received your application on August 04, 2025 requesting an exemption verification for the referenced project.
Based on the information provided, the District has determined that the project is eligible for an exemption under 62-330.051(4)(c). Therefore, the project will not need a District permit pursuant to rule reference.
This exemption also constitutes an express waiver of water quality certification under Section 401 of the Clean Water Act, 33 U.S.C. Section 1341. Pursuant to Rule 62-330.062, F.A.C., State Water Quality Certification is waived for activities that are exempt under rule 62-330.051 or 62-330.0511, F.A.C.
This exemption verification only applies to the requirements of the District and does not relieve you of meeting the permit requirements of other agencies. Please contact Ashley Austin at (850) 951- 4660 if you have any questions.
Sincerely, Selina Potter, P.E.
