About this file

This is a solicitation document from the State of Maine, Division of Purchases, for the procurement of heavy-duty dry cell alkaline batteries for the Central Warehouse. The solicitation requests bids on five battery types: 9-volt, AA 1.5-volt, AAA 1.5-volt, C 1.5-volt, and D 1.5-volt batteries under commodity code 45006. Bids were due August 21, 2008, with the contract term set to commence approximately September 1, 2008, and expire August 31, 2009. The State reserved the right to renew the contract for two additional one-year increments at its discretion. Vendors were required to deliver orders within 10 days of receipt to the Central Warehouse on 40 x 48 non-exchangeable pallets.

Awards were to be made to the lowest responsible bidder based on best value considerations including quality, conformity with specifications, and delivery dates. The estimated annual contract value is approximately $45,000. Pricing must be net and inclusive of all transportation charges, F.O.B. Destination, with the State accepting Procurement Card payment at no surcharge. Vendors must bid only on approved brands—Duracell, Eveready, Ray-O-Vac, Panasonic, and Energizer—and all products must comply with Maine Title 38, Section 2165, which limits mercury content to no more than 0.025 percent for alkaline manganese batteries and prohibits added mercury in batteries manufactured after January 1, 1996. Vendors must provide Material Safety Data Sheets for all hazardous chemical products. The State is committed to environmentally preferable procurement under Governor's Executive Order #12 and reserved the right to adjust quantities by up to 10 percent and reject any or all bids at its discretion.
