PROPOSAL INSTRUCTIONS

GENERAL INFORMATION

The NTSB solicits your proposal of brand name or equal 5.11 Tactical Cotton Pants as described in the Statement of Work (SOW). This solicitation will result in the award of one firm fixed-price Requirements-type contract to one (1) Contractor for one 12-month base year and up to four 12-month option years for a total period of performance of up to five (5) years.

Item descriptions provided for the requested brand name or equal 5.11 Tactical Cotton Pants as described in the SOW are provided to identify a desired standard of performance and quality. This reference shall not be construed as limiting competition. Items proposed must be equal to or better than what’s identified. Offeror’s must specify each brand of the item being proposed.

NOTICE AND INSTRUCTIONS TO OFFERORS

Offerors are required to meet all the requirements of the RFP, including but not limited to instructions, conditions/notices, and requirements in the SOW. Offerors must above all, show that, if selected for award, they will be able to provide high quality brand name or equal 5.11 Tactical Cotton Pants in accordance with the SOW.

The NTSB will evaluate proposed equal products on the basis of the evaluation factors listed in this solicitation and the information furnished by the Offeror or identified in the offer and reasonably available to the NTSB. THE NTSB IS NOT RESPONSIBLE FOR LOCATING OR OBTAINING ANY INFORMATION NOT IDENTIFIED IN THE OFFER. Include manufacturer’s name(s), model number(s), and specifications in your offer.

Proposals should address each factor and sub-factor as described below. Proposals that fail to address the essential requirements of this RFP or are unrealistic in terms of technical content, schedule commitment, or price will be deemed to have an inherent lack of technical competence or indicative of a failure to comprehend the requirements, or the complexity and risks associated with the requirements. Stating that the supply meets the requirements of the solicitation is not sufficient. The Government may reject any proposal that is so lacking in competence or in understanding the requirements that without a major reformation of the proposal it is not adequate for evaluation purposes. Alternate/conditional proposals may result in a proposal being rejected as non-responsive. The Government reserves the right to award without discussions. Offerors are cautioned that they must submit a best offer with the initial proposal.

In responding to this RFP, Offerors shall submit one (1) proposal addressing the following factors:

1. Part I – Technical Approach

2. Part II – Price

PART I – TECHNICAL APPROACH

This section describes the Offeror’s overall understanding of the requirements. An Offeror’s technical approach describes the degree to which the Offeror’s technical capability satisfies all the requirements in the SOW and demonstrates that the Offeror has a clear understanding and knowledge of the SOW requirements and how to achieve them in a logical, feasible, and technically effective manner.

a. Sub-factor 1 – Quality of Pants: Offerors must submit the specifications for the proposed brand name or equal 5.11 Tactical Cotton Pants as specified in the SOW with their proposal. Include manufacturer’s name(s), model number(s), and specifications in your offer. An Offeror that is proposing an equal to the 5.11 Tactical Cotton Pants must provide documentation that demonstrates that the proposed items are equal to 5.11 Tactical Cotton Pants. This includes the brand name or equal 5.11 Tactical Cotton Pants sizes, colors, and styles described in the SOW.

After the evaluation of written proposals, the NTSB reserves the right to request samples of the Offeror’s proposed brand name or equal 5.11 Tactical Cotton Pants to be delivered to the NTSB in order to further evaluate the quality of the Offeror’s proposed items. These items will not be returned to the Offeror by the NTSB after evaluation.

PART II – PRICE

The Offeror shall submit the firm fixed-price to provide the supplies as specified in the SOW, including all delivery/shipping costs that may apply into the cost of the items as described in the SOW during the base year and each of the four option years of the contract. Pricing is to be FOB destination. Include shipping in the price of the item or items you are proposing. If you fail to include the shipping cost your proposal may be determined nonresponsive. Refer to the Delivery Locations section of the SOW to review the delivery locations for the items.

For evaluation purposes, the Offeror shall provide the firm fixed-price for an estimated quantity of 130 brand name or equal 5.11 Tactical Cotton Pants in the six (6) tables in the Supplies and Prices Section of the RFP.

For evaluation purposes, prices will be evaluated by adding together the base year price all option year prices in the six (6) tables in the Supplies and Prices section of the RFP. All prices will be evaluated but not scored.

Price will be evaluated to determine reasonableness and realism for the contract requirements. Reasonableness is the degree to which all prices by their nature and amount do not exceed that which would be incurred by a prudent person in the conduct of competitive business. Realism is the degree to which all prices for the contract reflect the proposed approach to fully achieving the contract requirements in a high quality and timely manner. It means that the prices in an offeror's proposal are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the various elements of the offeror’s technical proposal. A price that is found to be unreasonably high or unrealistically low in relation to the proposed work may result in the Offeror’s proposal being rejected if the pricing poses an unacceptable risk to the Government.

EXPENSES RELATED TO OFFEROR SUBMISSIONS

This solicitation neither commits the Government to pay any cost incurred in the submission of the offer nor to contract for supplies or services. Any costs incurred in anticipation of a contract shall be at the Offeror’s own risk.

SUBMISSION OF PROPOSALS

Your proposal must be received no later than 12:00 p.m., Eastern Standard Time (EST), on December 23, 2010. LATE PROPOSALS MAY NOT BE CONSIDERED in accordance with Federal Acquisition Regulation (FAR) provision 52.212-1.

Offers may be transmitted via email to:

Bryan J. Moy
Email: Bryan.Moy@ntsb.gov

The maximum size of an email, including attachments, which the NTSB email server can accept is 5 megabytes (MB). Therefore, the Offeror may choose to send their proposal in separate emails, if the combined file size of any email received by the NTSB email server will exceed 5MB. It is the Offeror's responsibility to ensure that the designated point of contact has received your proposal at the email address of the contact specified above by the proposal due date.

All questions regarding this RFP shall be directed to Bryan J. Moy via email at the email address listed above. ALL QUESTIONS MUST BE RECEIVED BY 4:30 p.m. EST on December 15, 2010.

ELECTRONIC DISSEMINATION OF RFP DOCUMENTS

Access to this RFP and amendments will be posted on the Federal Business Opportunities website: www.fbo.gov. All Offerors are cautioned that it is your responsibility to frequently check back to the website to ensure that you have received all issued amendments.

EVALUATION FACTORS FOR AWARD

EVALUATION OF PROPOSALS

The Government may award one (1) firm fixed-price Requirements type contract to the responsible Offeror whose proposal that conforms to the RFP, will be most advantageous to the Government, price and other price factors considered, such that it provides the best value to the Government. Best value is defined as the procurement process that results in the most advantageous acquisition decision for the Government that is performed through an integrated assessment and trade-off analysis between price and non-price factors.

The Government reserves the right to reject any or all proposals if such action is in the public interest. Under a best value procurement, the NTSB may reasonably determine that the superior solution/approach merits a higher price and, therefore, represents the best value to the Government or the NTSB may reasonably determine that the Offeror with other than the highest rating in non-price factors is the best value. The Government may waive informalities and minor irregularities in proposals. The Government reserves the right to award without discussions. Offerors are cautioned that they must submit a best offer with the initial proposal.

EVALUATION FACTORS

The following factors and sub-factor will be evaluated by the Government in descending order of importance:

PROPOSAL PART #
FACTORS and SUB-FACTORS
TITLE
I
Factor – 1
Technical Approach
Sub-factor 1
Quality of Pants
II
Factor – 2
Price

The Government will evaluate Factor 1 based on the Offeror’s overall understanding of the requirements. Offerors are cautioned that proposals that receive an unacceptable in Factor 1 may be deemed ineligible for award.

All evaluation factors, other than price, when combined, are significantly more important than Price. However, as proposals become more equal in non-price factors, price becomes more important.

Factor 2, Price, will be evaluated but not scored. Prices will be evaluated by adding together the base year price all option year prices in the six (6) tables in the Supplies and Prices section of the RFP. Evaluation of options shall not obligate the Government to exercise the option(s).

As part of its price evaluation, the Government specifically reserves the right to evaluate the risk associated with any pricing schemes.
