NATIONAL TRANSPORTATION SAFETY BOARD

Justification for Other Than Full and Open Competition

“WebEOC Software & Maintenance”

1. Program Office / Procurement Request:

Office of the Chief Information Officer, Enterprise Architecture Division (CIO-60) On behalf of the Response Operations Center (ROC) Purchase Requisition (PR) PUR160087

2. Nature of Action:

The purpose of this Justification for other Than Full and Open Competition (JOFOC) is to provide documentation that explains why this specific requirement is to be awarded without competition to ESI Acquisition, Inc., (ESI) a subsidiary of Intermedix Corporation (Intermedix) for WebEOC software and support.

3. Description of Requirement:

The National Transportation Safety Board (NTSB) is a Federal agency mandated by Congress to investigate all aviation accidents, selected accidents/incidents in other modes of transportation, and report the results of those investigations. The real time information flow within the agency during a launch is disparate and uncoordinated.

The agency requires a more efficient means of disseminating information to and among investigation participants.

In addition, the NTSB does not operate a centralized information dashboard for gathering real time investigative data. At present, the information is disseminated via email and telephone, which results in unnecessary redundancy and information loss. The NTSB has a need to acquire a solution that will disseminate accurate and timely information to the intended audiences as soon as the information is generated with auditing capabilities.

The period of performance for the acquisition of the software, installation, on-site configuration, training and technical support is from date of award through twelve

(12) months.

4. Authority Cited:

FAR 13.106-1(b)(2), Soliciting from a single source. Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

This requirement is being procured in accordance with FAR subpart 13.5, Simplified Procedures for Certain Commercial Items.

5. Unique Qualifications / Circumstances of Requirement:

WebEOC will allow the NTSB’s Response Operations Center (ROC) and other investigative offices within the agency to provide a centralized collaborative tool for incident management as well as allow investigative personnel to instantly share critical information during an accident/incident investigation by providing real time data to management, party members, and other affected personnel. WebEOC is the only known “out of the box” software with the capabilities to provide the required functionality of the NTSB with minimal configuration or customization.

WebEOC has the unique ability to collaborate and share data with outside entities to include other emergency response agencies such as the Federal Emergency Management Agency (FEMA), the Department of Transportation (DOT), the Department of Defense (DOD), airlines, and has been implemented in 41 of the 50 U.S. states by their Statewide emergency management agencies and/or public health departments. This unique collaboration ability will allow the NTSB to communicate and gather vital information from various entities during investigations in a more effective and efficient manner. The unique real time collaboration tool is essential to the future workflow of the ROC. This will allow the NTSB to effectively collaborate with mission essential entities, and allow greater information sharing with increased accuracy and reduced redundancy and delays.

WebEOC is the only known incident management software available as a Software as a Service (SaaS), which reduces the footprint on the Agency’s IT infrastructure and resources required to maintain the system. Moreover, the SaaS solution removes the dependency on the NTSB Headquarters for the availability of the tool to users on accident scenes. In the event of a disruption to the Internet service at the Headquarters location, the SaaS will host the data and application in the cloud enabling users with Internet connected devices, such as IPads and IPhones, to communicate and continue with real time updates on the WebEOC dashboards.

The SaaS is critical to the NTSB, as it allows for continued workflow and transmittal of vital real time investigative data.

Intermedix is the sole designer, developer, integrator, manufacturer licensor and supplier of WebEOC, and possesses the requisite knowledge, engineering expertise, and data rights necessary to provide required software and associated system support to meet the NTSB needs. Intermedix has maintained control over all source coding, the WebEOC trademark and all other proprietary rights embodied in the WebEOC Professional software and its companion products since its inception.

Unique proprietary features available in WebEOC like FUSION (Interoperability and sharing of data between federal agencies and airlines) will allow the NTSB ROC to better support personnel on scene at various accident/incident investigations. The WebEOC Professional software includes the following unique tools that will allow the NTSB ROC to be a premier incident management response center:

• WebEOC® Air & Transportations will allow the NTSB to track all activities associated with passengers, families and other family related assistance activities.

• WebEOC® Team Manager will allow the NTSB to perform team administration, activation deployment and tracking of various investigative activities.

• WebEOC® Mapper Professional will allow the NTSB to gauge specific geographic locations of accident/incident sites by creating a dynamic, geographically-based common operating picture without the need for specialized Geographic Information Systems (GIS) or mapping expertise.

• WebEOC® Fusion will allow the NTSB to communicate and share data among other WebEOC equipped investigative entities. By using WebEOC Fusion, the NTSB along with other agencies can easily manage state or national incidents by organizing all of the data in the region under a single incident. WebEOC Fusion will allow the NTSB to make faster more decisive decisions based on improved inter-agency collaboration.

• WebEOC® Resource Request and Deployment Module will allow the NTSB to catalog, request, deploy, and track resources in a manner that is compliant with FEMA’s National Incident Management System (NIMS).

Furthermore, as the only entity with access to the WebEOC source code, Intermedix and its subsidiary (ESI Acquisition, Inc.) are the only entities which may accurately diagnose software errors and defects, issue corrections and fully integrated enhancements, and warrant performance of the software. Thus, further supporting the sole source procurement of the WebEOC Professional Software and Maintenance.

6. Efforts to Determine Only One Source:

In accordance with FAR 5.101(a)(1) a notice of the contract action will be posted electronically on the Government Point of Entry, Federal Business Opportunities, website (www.fbo.gov). The notice will state that all responsible sources may submit a capability statement, proposal, or quotation, which will be considered by the agency.

7. Contracting Officer’s Determination:

I have reviewed the above JOFOC, and determined that based on the information provided, it is accurate and complete, the anticipated cost of any subsequent sole source award would be in the best interest and fair and reasonable to the Government.

8. Market Research:

CIO-60 conducted Internet searches and in-person demonstrations of various market leaders of incident management software. Based on the market research, WebEOC is the only software to meet the NTSB needs based on the functionality and technology capabilities.

Market research also indicates that only Intermedix is authorized and capable of providing WebEOC Professional subscription software and support. Only Intermedix can provide the resources to perform the implementation, installation and configuration of all relevant modules of the software. There a no third party resellers authorized to provide the software or support.

9. Other Pertinent Information:

10. List of Interested Parties:

No other companies/organizations have expressed an interest in this requirement.

11. Efforts to Remove Barriers to Competition:

The NTSB will continue to conduct market research to acquire other sources to meet its requirements.

12. Contracting Officer’s Certification The Contracting Officer certifies that this JOFOC is accurate and complete.
