J&A No.: J&A6.302-1-16-MV01
DEPARTMENT OF THE NAVY
NAVAL RESEARCH LABORATORY
4555 OVERLOOK AVE SW
WASHINGTON, DC 20375-5320
IN REPLY REFER TO:
7 November 2016
JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION
1. CONTRACTING ACTIVITY
Naval Research Laboratory (NRL), 4555 Overlook Avenue, SW, Washington, DC 20375-
5000.
2. DESCRIPTION OF THE ACTION BEING APPROVED
The action requiring approval is a sole source contract to Leidos, Inc. (Leidos) (CAGE:
5UTE2). This justification and approval (J&A) authorizes and approves the issuance of a Cost
Plus Fixed Fee (CPFF) contract.
3. DESCRIPTIONS OF SUPPLIES/SERVICES
The contract is to provide R&D and technical support for the United States Navy’s Sonar
Dome Reliability Program. The goal of the contract is to publish the results of the research and development, and to improve the reliability of sonar dome rubber windows, sonar rubber domes, and sonar composite domes, including new designs for sonar domes. The contract will have a period of performance of one (1) base year with four (4) option years, for a total of five
(5) years. If exercised, each option would extend the period of performance by an additional
12 months. Individual CLINs shall specify the period of performance for each option year.
The estimated dollar value of the NRL is detailed below:

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
The statutory authority permitting other than full and open competition is:
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and
No Other Supplies or Services Will Satisfy Agency Requirements.
5. RATIONALE JUSTIFYING USE OF CITED AUTHORITY
The incumbent provided research and development and technical support for the United States
Navy’s Sonar Dome Reliability Program. FAR 6.302-1(a)(2)(iii) provides situations in which services may be deemed to be available only from the original source in the case of follow-on contracts. The incumbent is the only company that has a qualified engineer in the United
States who can perform the tasks as described in the Statement of Work (SOW). This effort has been competed over the last 30 years and no other proposal has ever been received.
The primary engineer performing the work has developed the necessary expertise for this program over the course of almost 30 years. The following tasks required by the SOW can only be performed by this person: Sonar Dome Radiography, Sonar Dome Failures analysis;
Existing Design of Sonar System and Related Ship Components; Evaluate New Designs and
Materials for Sonar Domes and Related Ship Components; and Field Testing and Other
Support. Thus far, competition simply does not exist for the required capability.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY
OFFERORS AS PRACTICABLE
A Request for Information (RFI) was posted to the Governmentwide Point of Entry (GPE) on
27 January 2016 with a closing date of 16 February 2016. The Statement of Work (SOW), DD Form 1423 Contract Data Requirements List (CDRLs), Personnel Qualifications, and list of Government Furnished Property (GFP) were included with the listing. NRL received only one capabilities statement during the response time of the RFI, which was submitted by
Leidos, Inc. The capabilities statement was reviewed and evaluated by the Technical
Cognizance on 24 February 2016; Leidos was determined to be technically capable of fulfilling the Government’s requirement.
7. DETERMINATION OF FAIR AND REASONABLE COST
The Contracting Officer has determined that the anticipated cost to the Government of the
R&D support covered by this J&A are fair and reasonable through the use of cost analysis and cost-realism analysis under FAR 15.404-1.
8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION
The NRLMCB will require the delivery of a technical data package that will provide the
Government with the following information:
• Radiograph Inspection Report,
• Task Report,
• Pressurization Simulation System Simulation Software, and
• Final Report.
This data package will provide the Government with the technical knowledge necessary to eliminate aspects of the R&D for the Sonar Dome Reliability Program that restrict competition. In addition to the data package, this acquisition introduces training for
Government personnel on sonar dome radiography, and requires a written syllabus and lecture notes to be delivered by the Contractor. Through the acquisition of this data package and the training, the Government will have the ability to read and analyze the radiographs of the sonar domes. This is imperative because the ability to read the radiographs allows for the
Government identify the directions for the R&D to progress. Furthermore, in order to promote full and open competition in the future, This will provide the Government the knowledge to assess and measure damage revealed by sonar dome radiographs. In future contracts, sonar dome radiography will not be the central R&D support being acquired; this will allow for full and open competition on future contracts.
