SECTION C - Description/Specifications

1. TITLE

Technical Assistance for Commercial Nuclear Power Plant Probabilistic Risk Assessment (PRA) Tasks

2. OBJECTIVE

The objective of this contract is to expand and update Probabilistic Risk Assessment (PRA) methods used in nuclear regulatory activities, in compliance with the 1995 Nuclear Regulatory Commission (NRC) policy statement for implementing risk-informed regulation.

3. BACKGROUND

In 1995 the United States Nuclear Regulatory Commission (NRC) issued a policy statement for implementing risk-informed regulation. The statement said that Probabilistic Risk Assessment (PRA) methods were to be used in nuclear regulatory activities.

Since then, the NRC has been using PRA to estimate risk by addressing three questions: what can go wrong, how likely is it, and what are its consequences? Thus, PRA provides insights into the strengths and weaknesses of the design and operation of a nuclear power plant (NPP). Risk-informed decision-making uses these PRA insights, combined with other data sources, including deterministic assessments and engineering judgment, to support an integrated decision making process.

The purpose of this contract is to obtain technical assistance for addressing a number of current challenges in the development of PRA models and tools to support risk-informed decision-making. It is envisioned that this assistance would involve support in the areas of severe accident induced steam generator tube rupture modeling, severe accident PRA modeling (including accidents involving more than one major site radiological source), consequence modeling, external hazard modeling, low power and shutdown modeling, and PRA data analysis.

4. APPLICABLE DOCUMENTS AND STANDARDS

PRA Policy Statement (60 FR 42622, August 16, 1995): The Nuclear Regulatory Commission's (NRC's) policy for implementing risk-informed regulation was expressed in the 1995 policy statement on the use of probabilistic risk assessment (PRA) methods in nuclear regulatory activities. The policy statement states:

The use of PRA technology should be increased in all regulatory matters to the extent supported by the state-of-the-art in PRA methods and data and in a manner that complements the NRC's deterministic approach and supports the NRC's traditional defense-in-depth philosophy.

PRA and associated analyses (e.g., sensitivity studies, uncertainty analyses, and importance measures) should be used in regulatory matters, where practical within the bounds of the state-of-the-art, to reduce unnecessary conservatism associated with current regulatory requirements, regulatory guides, license commitments, and staff practices. Where appropriate, PRA should be used to support the proposal of additional regulatory requirements in accordance with 10 CFR 50.109 (Backfit Rule).

Appropriate procedures for including PRA in the process for changing regulatory requirements should be developed and followed. It is, of course, understood that the intent of this policy is that existing rules and regulations shall be complied with unless these rules and regulations are revised.

PRA evaluations in support of regulatory decisions should be as realistic as practicable and appropriate supporting data should be publicly available for review.

The Commission's safety goals for nuclear power plants and subsidiary numerical objectives are to be used with appropriate consideration of uncertainties in making regulatory judgments on the need for proposing and backfitting new generic requirements on nuclear power plants licensees.

The risk-informed regulatory-decision making process used at the NRC also utilizes several key regulatory guidance documents and consensus standards. These include (but are not limited to):

Regulatory Guide (RG) 1.174, “An Approach for Using Probabilistic Risk Assessment in Risk-Informed Decisions on Plant-Specific Changes to the Licensing Basis”

RG 1.175, “An Approach for Plant-Specific, Risk-Informed Decisionmaking: Inservice Testing”

RG 1.177, “An Approach for Plant-Specific, Risk-Informed Decisionmaking:

Technical Specifications”

RG 1.178, “An Approach for Plant-Specific Risk-Informed Decisionmaking for Inservice Inspection of Piping”

RG 1.200, “An Approach for Determining the Technical Adequacy of Probabilistic Risk Assessment Results for Risk-Informed Activities”

NUREG-0800, “Standard Review Plan for the Review of the Safety Analysis Reports for Nuclear Power Plants,” Section 19, “Use of Probabilistic Risk Assessment in Plant-Specific, Risk-Informed Decisionmaking: General Guidance,”

Consensus standards documents such as ASME/ANS RA-Sa-2009, “Standard for Level 1/Large Early Release Frequency Probabilistic Risk Assessment for Nuclear Power Plant Applications”

5. REQUIRED TECHNICAL AND MANAGEMENT SKILLS

This contract requires personnel who have experience in actually doing Nuclear Power Plant (NPP) Probabilistic Risk Assessment (PRA) analyses rather than reviewing NPP PRA analyses. Doing a NPP PRA analysis is a judgmental art that requires an experienced practitioner to apply knowledge of engineering, mathematics, systems, components, and the interaction of systems and/or components with their operating environment.

Doing NPP PRA analyses involves the following activities: (1) Identifying system dependencies; (2) Performing plant and system walk downs; (3) Reviewing and evaluating plant data, and then estimating parameters; (4) Conducting expert elicitation to determine event probabilities for which data are unavailable; (5) Developing event trees (graphical representations showing systemic risk resulting from an initiating event) and fault trees (graphical representations showing the chain of events leading to a specific fault or failure); (6) Formulating key modeling assumptions for success criteria, common cause failures, and human actions; and (7) Estimating radionuclide release and transport with consequential health, environmental, and economic effects. For personnel to qualify as having done NPP PRA analyses, documentation must be provided that they performed these activities. Reviewing NPP PRA analyses may or may not capture one or more of these elements, depending on the depth of review.

Additionally, contractor personnel shall be technically credible, based on their in-depth knowledge of NPP PRA analysis resulting from their education and work experience, to respond to technical questions during presentations to the NRC’s Advisory Committee on Reactor Safeguards (ACRS) and other NRC entities.

The contractor labor categories required for this project are listed below; including their descriptions. For these labor categories, the contractor shall prepare a technical and project management quality assurance plan that:

Contains names and biographical information of the key personnel who would be doing the needed high quality work, including the alternate(s).

Describes how the alternate(s) will quickly assume the contractual responsibilities of key personnel in the event of their extended or permanent absence.

Senior Engineer/Analyst (or equivalent) Individuals that are proposed to work under this labor category shall possess a minimum of 10 years of technical experience and 5 years of project management experience. The minimum educational requirements are a Ph.D. or Master's degree in a recognized engineering or scientific field from an accredited program of study. Equivalent experience in a science or engineering field may be considered. These individuals shall also have multiple scientific publications and have extensive peer recognition as an authority in their field of study.

Technical experience shall consist largely of the in-depth knowledge and expertise discussed in this section, and should also include technical experience with applied research, technical analysis, technical support activities, and independent problem solving. Project management experience shall include experience with directing work under technical projects and with multiple personnel. Experience with directing PRA projects is required.

Engineer/Analyst (or equivalent) Individuals that are proposed to work under this labor category shall possess a minimum of 3 years of technical experience and a Master's degree or a minimum of 5 years of technical experience and a Bachelor's degree. The academic degree shall be for a recognized engineering or scientific field from an accredited program of study. An Engineer/Analyst is expected to perform detailed PRA analyses with some direction from the Senior Engineer/Analyst, but should possess enough understanding of the development of PRAs to make independent technical decisions.

Extensive technical knowledge and experience is required in developing models and performing analyses for a PRA. Specifically, the contractor personnel shall have extensive and demonstrated experience in doing work in the following PRA related areas:

7. SPECIFIC TASKS

The contractor shall provide technical assistance for the following commercial nuclear power plant (NPP) probabilistic risk assessment (PRA) tasks. Additional tasks may be added later as required.

Consequential Steam Generator Tube Rupture (C-SGTR) Probabilistic Risk Assessment (PRA) o The NRC conducted research to develop additional products to facilitate development and review of future risk assessments involving consequential steam generator tube rupture (C-SGTR) in operating pressurized water reactor (PWR) nuclear power plants with subsequent radioactive release to the environment.

The results of this research currently reside in a draft NUREG report that includes additional thermal-hydraulic and structural analyses, characterization of steam generator (SG) flaw distributions, and improved probabilistic risk assessment (PRA) modeling.

o Task 1 of this contract is being issued so that technical assistance is provided to ensure that:

The draft NUREG report is finalized as a NUREG report and issued in a timely manner.

NRC offices are instructed on how to use the C-SGTR PRA methodology.

Multi-source Integrated Site PRA o The NRC is presently performing a full-scope integrated Level-3 PRA at a commercial nuclear power plant (NPP) site.

This can provide valuable insights into the relative importance of various contributors to radioactive release by assessing risks involving one or more major site radiological sources, including:

reactor units, spent fuel pools (SFPs), and dry cask storage (DCS).

o Task 2 of this contract is being issued so that technical assistance is provided to support the NRC in development of a multi-source integrated site PRA model.

This model shall encompass all major site radiological sources for a specified commercial nuclear power plant site, including all operating reactor units, SFPs, and DCS.

Development of Integrated Level-1 and Level-2 PRA Models Within the NRC’s SAPHIRE Computer Code Environment o The NRC uses PRA to estimate risk by computing real numbers to determine what can go wrong, how likely it is, and what are its consequences. Thus, PRA provides insights into the strengths and weaknesses of the design and operation of a NPP. Within the NRC, most NPP PRA analysis is done using the SAPHIRE (Systems Analysis Programs for Hands-on Integrated Reliability Evaluations) computer code in conjunction with the agency’s SPAR (Standardized Plant Analysis Risk) models.

o A future task of this contract may be issued so that technical assistance is provided to support the integration of Level-1 and Level-2 PRA models within SAPHIRE.

Development of PRA Models and Assessment of Radioactivity Release Mitigating Measures, Including Use of Filtered Containment Venting, for Nuclear Power Plants o Assessments following the Fukushima Dia-ichi accident have indicated that containment release mitigation strategies may have potential to reduce public health and safety impacts following a severe accident (e.g., NRC Near Term Task Force Recommendation 5.2).

o A future task of this contract may be issued so that technical assistance is provided to support the assessment of containment radioactivity release mitigation measures.

Development of PRA Models for Hazards Such as Wind, Seismic, Fire, and Flooding o Continued development of SPAR models for these hazards became extremely important after the Japan Fukushima Dia-ichi accident of March 11, 2011, when the NRC implemented a three-tiered prioritization of actions to enhance U.S. nuclear reactor safety.

o A future task of this contract may be issued so that technical assistance is provided to support future development of these SPAR models.

Development of PRA Models for Low Power and Shutdown Plant Operating States o Human error plays a more significant role in NPP accidents during low power and shutdown operating states than in other NPP accidents.

o A future task of this contract may be issued so that technical assistance is provided to support development of PRA models that better define the risk associated with NPP accidents during low power and shutdown operating states.

Operating Experience Data Analysis and Parameter Estimation in Support of PRA and Risk-informed Decision-making o Supports NRC Management Directive, 8.7, “Reactor Operating Experience Program,” which requires that the NRC collect and assess operational data from U.S. nuclear power plants.

o A future task of this contract may be issued so that technical assistance is provided to support:

Special studies that incorporate data currently contained in the NRC’s Integrated Data Collection and Coding System (IDCCS), maintained at the Idaho National Laboratory (INL), in support of current risk-informed regulatory functions.

Recommendations on what new operational data or metrics may be collected and developed to improve PRA accuracy and agency risk-informed initiatives.

Recommendations on what to add or improve in the data provided to NRC via the INPO (Institute of Nuclear Power Operations) ICES (INPO Consolidated Events System) of component failure events.

On-going staff efforts directed towards improving common cause failure estimation methods.

(b) If one or more of the key personnel, for whatever reason, becomes, or is expected to become, unavailable for work under this contract for a continuous period exceeding 30 work days, or is expected to devote substantially less effort to the work than indicated in the proposal or initially anticipated, the contractor shall immediately notify the contracting officer and shall, subject to the concurrence of the contracting officer, promptly replace the personnel with personnel of at least substantially equal ability and qualifications.

SECTION H - Special Contract Requirements

2052.209-72 CONTRACTOR ORGANIZATIONAL CONFLICTS OF INTEREST. (JAN

1993)

(a) Purpose. The primary purpose of this clause is to aid in ensuring that the contractor:

(1) Is not placed in a conflicting role because of current or planned interests (financial, contractual, organizational, or otherwise) which relate to the work under this contract;

and

(2) Does not obtain an unfair competitive advantage over other parties by virtue of its performance of this contract.

(b) Scope. The restrictions described apply to performance or participation by the contractor, as defined in 48 CFR 2009.570-2 in the activities covered by this clause.

(c) Work for others.

(1) Notwithstanding any other provision of this contract, during the term of this contract, the contractor agrees to forego entering into consulting or other contractual arrangements with any firm or organization the result of which may give rise to a conflict of interest with respect to the work being performed under this contract. The contractor shall ensure that all employees under this contract abide by the provision of this clause.

If the contractor has reason to believe, with respect to itself or any employee, that any proposed consultant or other contractual arrangement with any firm or organization may involve a potential conflict of interest, the contractor shall obtain the written approval of the contracting officer before the execution of such contractual arrangement.

(2) The contractor may not represent, assist, or otherwise support an NRC licensee or applicant undergoing an NRC audit, inspection, or review where the activities that are the subject of the audit, inspection, or review are the same as or substantially similar to the services within the scope of this contract (or task order as appropriate) except where the NRC licensee or applicant requires the contractor's support to explain or defend the contractor's prior work for the utility or other entity which NRC questions.

(3) When the contractor performs work for the NRC under this contract at any NRC licensee or applicant site, the contractor shall neither solicit nor perform work in the same or similar technical area for that licensee or applicant organization for a period commencing with the award of the task order or beginning of work on the site (if not a task order contract) and ending one year after completion of all work under the associated task order, or last time at the site (if not a task order contract).

(4) When the contractor performs work for the NRC under this contract at any NRC licensee or applicant site,

(i) The contractor may not solicit work at that site for that licensee or applicant during the period of performance of the task order or the contract, as appropriate.

(ii) The contractor may not perform work at that site for that licensee or applicant during the period of performance of the task order or the contract, as appropriate, and for one year thereafter.

(iii) Notwithstanding the foregoing, the contracting officer may authorize the contractor to solicit or perform this type of work (except work in the same or similar technical area) if the contracting officer determines that the situation will not pose a potential for technical bias or unfair competitive advantage.

(d) Disclosure after award.

(1) The contractor warrants that to the best of its knowledge and belief, and except as otherwise set forth in this contract, that it does not have any organizational conflicts of interest as defined in 48 CFR 2009.570-2.

(2) The contractor agrees that if, after award, it discovers organizational conflicts of interest with respect to this contract, it shall make an immediate and full disclosure in writing to the contracting officer. This statement must include a description of the action which the contractor has taken or proposes to take to avoid or mitigate such conflicts.

The NRC may, however, terminate the contract if termination is in the best interest of the Government.

(3) It is recognized that the scope of work of a task-order-type contract necessarily encompasses a broad spectrum of activities. Consequently, if this is a task-order-type contract, the contractor agrees that it will disclose all proposed new work involving NRC licensees or applicants which comes within the scope of work of the underlying contract.

Further, if this contract involves work at a licensee or applicant site, the contractor agrees to exercise diligence to discover and disclose any new work at that licensee or applicant site. This disclosure must be made before the submission of a bid or proposal to the utility or other regulated entity and must be received by the NRC at least 15 days before the proposed award date in any event, unless a written justification demonstrating urgency and due diligence to discover and disclose is provided by the contractor and approved by the contracting officer. The disclosure must include the statement of work, the dollar value of the proposed contract, and any other documents that are needed to fully describe the proposed work for the regulated utility or other regulated entity. NRC may deny approval of the disclosed work only when the NRC has issued a task order which includes the technical area and, if site-specific, the site, or has plans to issue a task order which includes the technical area and, if site-specific, the site, or when the work violates paragraphs (c)(2), (c)(3) or (c)(4) of this section.

(e) Access to and use of information.

(1) If, in the performance of this contract, the contractor obtains access to information, such as NRC plans, policies, reports, studies, financial plans, internal data protected by the Privacy Act of 1974 (5 U.S.C. Section 552a (1988)), or the Freedom of Information Act (5 U.S.C. Section 552 (1986)), the contractor agrees not to:

(i) Use this information for any private purpose until the information has been released to the public;

(ii) Compete for work for the Commission based on the information for a period of six months after either the completion of this contract or the release of the information to the public, whichever is first;

(iii) Submit an unsolicited proposal to the Government based on the information until one year after the release of the information to the public; or

(iv) Release the information without prior written approval by the contracting officer unless the information has previously been released to the public by the NRC.

(2) In addition, the contractor agrees that, to the extent it receives or is given access to proprietary data, data protected by the Privacy Act of 1974 (5 U.S.C. Section 552a (1988)), or the Freedom of Information Act (5 U.S.C. Section 552 (1986)), or other confidential or privileged technical, business, or financial information under this contract, the contractor shall treat the information in accordance with restrictions placed on use of the information.

(3) Subject to patent and security provisions of this contract, the contractor shall have the right to use technical data it produces under this contract for private purposes provided that all requirements of this contract have been met.

(f) Subcontracts. Except as provided in 48 CFR 2009.570-2, the contractor shall include this clause, including this paragraph, in subcontracts of any tier. The terms contract, contractor, and contracting officer, must be appropriately modified to preserve the Government's rights.

(g) Remedies. For breach of any of the above restrictions, or for intentional nondisclosure or misrepresentation of any relevant interest required to be disclosed concerning this contract or for such erroneous representations that necessarily imply bad faith, the Government may terminate the contract for default, disqualify the contractor from subsequent contractual efforts, and pursue other remedies permitted by law or this contract.

(h) Waiver. A request for waiver under this clause must be directed in writing to the contracting officer in accordance with the procedures outlined in 48 CFR 2009.570-9.

(i) Follow-on effort. The contractor shall be ineligible to…
