Permit to operate a marine industrial support facility located at 4000 Cost Guard Boulevard, Portsmouth, Virginia 23703.

This permit supersedes your permit dated May 17, 2010.

INITIAL COMPLIANCE DETERMINATION

Condition #43: Stack Test Initial performance tests shall be conducted for NOx and VOC from the peak shave generator (Ref. No. EG-1) using the appropriate EPA Reference Methods to determine compliance with the emission limits contained in Condition 30. The tests shall be performed and reported and demonstrate compliance within 60 days after the permit is issued. Tests shall be conducted and reported and data reduced as set forth in 9VAC5-50-30, and the test methods and procedures contained in each applicable section or subpart listed in 9VAC5-50-410. The performance test shall include a test method performance audit (PA), where applicable. The details of the tests are to be arranged with the Tidewater Regional Office (TRO). The permittee shall submit a test protocol at least 30 days prior to testing. One copy of the test results shall be submitted to the Tidewater Regional Office within 60 days after test completion and shall conform to the test report format enclosed with this permit:

INSTRUCTIONS FOR USE OF NOTIFICATION FORM:

Your permit requires that you notify the Tidewater Regional Office of DEQ of various milestones in the construction/expansion of your facility. This form is designed to assist you in meeting the requirements. You are not obligated to use this form; it is for your convenience. If you generate your own notification, be sure to include the document certification as shown above; it is a regulatory requirement. Notifications postmarked by the deadline are considered to be on time.

Make copies of the form, one copy for each notification required by the permit. Fill-in the date and send to DEQ before the deadline. Address: DEQ - TRO, Air Compliance Section, 5636 Southern Blvd., Virginia Beach, VA 23462.

"Start up" means the setting in operation of an affected facility for any purpose. 9 VAC 5-10-20 "Commence," as applied to the construction of an emissions unit, means that the owner has all necessary preconstruction approvals or permits and has either:

1. Begun, or caused to begin, a continuous program of actual on-site construction of the unit, to be completed within a reasonable time; or

2. Entered into binding agreements or contractual obligations, which cannot be canceled or modified without substantial loss to the owner, to undertake a program of actual construction of the unit, to be completed within a reasonable time. 9 VAC 5-80-1110.C.

9 VAC 5-80-1120.A. No owner or other person shall begin actual construction of, or operate, any new stationary source or any project subject to this article without first obtaining from the board a permit under the provisions of this article [if not exempt from having to obtain a permit].

"Begin actual construction" means initiation of permanent physical on-site construction of an emissions unit. This includes, but is not limited to, installation of building supports and foundations, laying of underground pipework, and construction of permanent storage structures. With respect to a change in method of operation, this term refers to those on-site activities other than preparatory activities which mark the initiation of the change. With respect to the initial location or relocation of a portable emissions unit, this term refers to the delivery of any portion of the portable emissions unit to the site. 9 VAC 5-80-1110.C.
