About this file

This is a Notice of Intent to Sole Source Under SAT issued by Region III Environmental Protection Agency for the acquisition of Apex AIR Pro Multi-Pollutant Environmental Monitoring equipment and consumables. The EPA intends to award a firm-fixed-price commercial contract to Apex Instruments, Inc., located at 204 Technology Lane, Fuquay-Varina, NC 27526, under the authority of RFO Part 13. The procurement objective is to acquire starter package renewal accounts, administrator renewal accounts, and proprietary, factory-calibrated replacement Smart Gas Cartridges.

Market research determined that Apex Instruments, Inc. holds the exclusive North American distribution rights and serves as the certified warranty service provider for this specific hardware and software line, with no other standard commercial distributors or authorized third-party resellers available in the U.S. domestic open market. The Apex AIR Pro platform is uniquely required due to its patented, hot-swappable Smart Gas Cartridge technology that auto-configures without manual field calibration or laboratory downtime, and its seamless compatibility with the EPA's pre-existing proprietary data ingestion and cloud mapping pipelines. Although this is not a request for competitive proposals and no written solicitation will be issued, all responsible sources may submit a capability statement, proposal, or quotation within 10 days of publication. Responses must be submitted to workman.erin@epa.gov no later than 4:00 pm EST on November 3, 2026, and will be evaluated solely to determine whether to conduct competitive procurement.
