About this file

This is a Notice of Proposed Sole Source Purchase issued by Mississippi State University for the procurement of five Teledyne ISCO TIENet 350EX Area Velocity sensors with 10-foot measurement range and 32-foot cable. The sensors will support research projects conducted by the Mississippi Water Resources Research Institute (MWRRI) focused on evaluating management practices designed to reduce runoff and nutrient transport from Midsouth production systems. The 350EX sensors measure water level and flow velocity during runoff events, enabling quantification of runoff volume and associated sediment and nutrient sampling. The sole source justification emphasizes equipment continuity and compatibility with existing Teledyne ISCO flow monitoring equipment, connection cables, software, and hardware already deployed at MWRRI research sites. No specific response deadline, due date, site visit, or bidders' conference information is provided in the notice.

The estimated total cost for the five sensors is $10,120, or $2,024 per unit, plus $295 for shipping and handling, totaling $10,415. Mississippi State University determined that Teledyne ISCO is the sole manufacturer of the required equipment, and C.C. Lynch & Associates, Inc. is the authorized exclusive sales representative and distributor for Teledyne ISCO in Mississippi. The university requested a quote from C.C. Lynch & Associates, Inc. to obtain the best possible price; competitive bids from other vendors were not pursued due to the manufacturer-specific nature of the equipment and exclusive territorial distribution arrangement. Objections to the sole source designation must be submitted in writing to Jennifer Mayfield, CPPO Director of Procurement Services, with detailed explanations of why alternative sources exist.

Mississippi State University Notice of Proposed Sole Source Purchase

Mississippi State University anticipates purchasing the item(s) listed below as a sole source purchase. Anyone objecting to this purchase shall follow the procedures outlined below.

1. Commodity or commodities to be purchased (make, model, description):

5 each, Teledyne ISCO TIENet 350EX Area Velocity sensor - 10ft measurement range with 32ft cable.

The 350EX sensor is mounted in the flow stream to measure flow stream average area velocity and liquid level. It measures average velocity using continuous ultrasonic sound waves to produce a doppler effect. The liquid level is measured using an internal differential pressure transducer that is built into the sensor.

2. Explanation of the need to be fulfilled by this item(s), how is it unique from all other options, and why it is the only one that can meet the specific needs of the department:

These items will help MWRRI meet the deliverables of current research projects focused on evaluating management practices designed to reduce runoff and nutrient transport off field from Midsouth production systems. The Teledyne ISCO 350EX Area Velocity sensor is required to measure water level and flow velocity during runoff events, allowing for the quantification of runoff volume and associated sediment and nutrient water samples.

This item is unique because it is specifically designed for compatibility with the Teledyne ISCO flow monitoring equipment and associated infrastructure currently deployed at MWRRI research sites. Equipment continuity is necessary to maintain compatibility with existing flow meters, connection cables, software, and hardware. It also ensures consistent data collection across experimental units and runoff events.

3. Name of company/individual selling the item and why that source is the only possible source that can provide the required item(s):

Teledyne ISCO is the sole manufacturer of Teledyne ISCO automatic water and wastewater sampling and flow monitoring equipment and associated components. C.C. Lynch & Associates, inc. is the authorized exclusive Teledyne ISCO sales representative and distributor in Mississippi. Therefore, procurement of the specified Teledyne ISCO 350EX Area Velocity sensor through C.C. Lynch & Associates, Inc. is necessary to maintain compatibility with MWRRI’s existing monitoring system and meet the specific technical requirements and deliverables.

4. Estimated cost of item(s) and an explanation why the amount to be expended is considered reasonable:

The estimated cost is $2,024 per sensor, for a total of $10,120 plus $295 shipping and handling for five sensors. This is a reasonable amount because it is similar to the individual cost of the thirty-five additional Teledyne ISCO 350/350EX Area Velocity sensors in use throughout many of our passive sampler research sites. Furthermore, this is reasonable because Teledyne ISCO is the sole manufacturer of the Area Velocity sensor that is compatible with Teledyne ISCO flow monitoring equipment.

5. Explanation of the efforts taken by the department to determine this is the only source and the efforts used to obtain the best possible price:

The department reviewed manufacturer information provided by Teledyne ISCO to verify the availability of the required equipment. Teledyne ISCO is the sole manufacturer of its water and wastewater sampling and flow monitoring equipment, and C.C. Lynch & Associates, Inc. is the authorized exclusive Teledyne ISCO sales representative and distributor for Mississippi.

Therefore, alternative authorized distributors are not available with the designated sales territory.

To obtain the best possible price, MWRRI requested a quote from C.C. Lynch & Associates Inc.

Because the equipment is manufacturer-specific and distributed exclusively with the designated territory, competitive quotes from other authorized vendors were not available.

Any person or entity that objects and proposes that the commodity listed is not sole source and can be provided by another person or entity shall submit a written notice to:

Jennifer Mayfield, CPPO Director of Procurement Services, Chief Procurement Officer jmayfield@procurement.msstate.edu Subject Line must read “Sole Source Objection”

The notice shall contain a detailed explanation of why the commodity is not a sole source procurement. Appropriate documentation shall also be submitted if applicable.

If after a review of the submitted notice and documents, MSU determines that the commodity in the proposed sole source request can be provided by another person or entity, then MSU will withdraw the sole source request publication from the procurement portal website and submit the procurement of the commodity to an advertised competitive bid or selection process.

If MSU determines after review that there is only one (1) source for the required commodity, then MSU will appeal to the Public Procurement Review Board. MSU will have the burden of proving that the commodity is only provided by one (1) source.
