About this file
Northern Ireland Fair Employment Practices Disclosure
This is a Northern Ireland Fair Employment Practices Disclosure form required by the City of Cleveland, Ohio under Codified Ordinance Sec. 181.36 for contractors and subcontractors with more than fifty percent interest in proposed contracts. The disclosure requires all contractors to certify their engagement status regarding business or trading activities in Northern Ireland prior to contract award. Contractors must check one of three applicable options: attestation that neither the contractor nor any controlling shareholder, subsidiary, or parent corporation conducts business in Northern Ireland; acknowledgment of business engagement in Northern Ireland; or certification that all identified enterprises are taking lawful and good faith steps to engage in fair employment practices consistent with the MacBride Principles for Fair Employment in Northern Ireland. Documentation demonstrating compliance with fair employment standards may be submitted in lieu of written certification.
False statements on the disclosure form result in contract default and automatic exclusion from bidding on City of Cleveland goods and services contracts for a two-year period. The form defines "controlling shareholder" as any shareholder owning more than fifty percent of corporate stock or more than twenty-five percent of stock if no other shareholder holds a larger share. A copy of the MacBride Principles is available from the Office of the Commissioner of Purchases and Supplies. The disclosure applies to the City of Cleveland's request for qualifications for an Owner's Advisor to administer design and implementation of facility resiliency and energy efficiency improvements for Public Safety facilities, specifically the City's Fire and Emergency Medical Service Stations.
