About this file

This Non-Competitive Memorandum for Simplified Acquisition Actions documents an urgent HVAC replacement requirement for the Federal Correctional Institution (FCI) Safford in Arizona. The agency needs to replace HVAC units in the Special Housing Unit (SHU) and Health Services areas, which have failed and become inoperable, with an estimated contract value of $17,669.99. The units are critical for maintaining mandatory health and safety temperatures for staff and inmates, and current temporary solutions include multiple portable heaters.

The memorandum justifies a non-competitive procurement through statutory authorities 41 U.S.C. 253 and 41 U.S.C. 1901(e), citing the urgent need due to the units' age, lack of replacement parts, and potential safety risks during winter months. The contract (No. 15BBNF26P00000013) will be awarded to American Refrigeration Supplies Inc. (UEI: SNS1LSNM9R31), with the contracting officer certifying the accuracy and completeness of the justification. The document emphasizes the compelling nature of immediate action to ensure operational stability and comply with health and safety standards at the facility.

NON COMPETITIVE MEMORANDUM FOR

SIMPLIFIED ACQUISITION ACTIONS

FAR 13.106-3(b)(1)

1. REQUIRING AGENCY – DOJ/Bureau of Prisons, Federal Correctional Institution Safford

2. NATURE/DESCRIPTION OF ACTION BEING APPROVED – Urgency

3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS The agency urgently requires the replacement of the Special Housing Unit (SHU) & Health Services HVAC units to maintain mandatory health and safety temperatures for staff and inmates. Currently the institution has temporarily placed multiple portable heaters in these areas to provide temporary climate control. The estimated value of the requirement is $17,669.99.

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION – 41 U.S.C. 253; 41 U.S.C. 1901(e)

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE

NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED:

The Federal Correctional Institution (FCI) Safford, located in Arizona, currently has HVAC units that provide both heating and cooling for climate control in the Special Housing Unit (SHU) and Health Services. Both units have failed and are inoperable, resulting in the facility's inability to maintain the mandated temperature standards outlined in Program Statement 4200.12, which are essential for the health and safety of both staff and inmates. Due to their age and the end of their operational lifecycle, the units have deteriorated beyond repair. Additionally, critical replacement parts and components are no longer available, making immediate replacement the only viable solution. Given FCI Safford's geographic location and the extreme cold temperatures experiencing during the winter months, the absence of functional HVAC systems poses a significant health and safety risk. Failure to restore proper climate control may lead to unsafe living and working conditions for both staff and inmates and could escalate into a broader failure of the facility’s HVAC infrastructure. The replacement of these HVAC units is both urgent and compelling to ensure compliance with health and safety standards and to safeguard the well-being of inmates and staff. Immediate action is essential to mitigate further risks and to maintain operational stability in the institution.
