About this file
This Non-Competitive Memorandum for Simplified Acquisition Actions justifies an urgent, non-competitive procurement by the Department of Justice Bureau of Prisons for the Federal Correctional Institution (FCI) Safford. The agency requires an immediate replacement of two inoperable HVAC units for the Special Housing Unit (SHU) and Chapel, with an estimated contract value of $29,397.55. The contract will be awarded to American Refrigeration Supplies Inc. (UEI: SNS1LSNM9R31) on an emergency basis due to the critical condition of the existing units, which have deteriorated beyond repair and pose significant health and safety risks for staff and inmates.
The justification highlights the urgent need for replacement based on the facility's geographic location in Arizona, extreme summer temperatures, and the inability to maintain mandated temperature standards outlined in Program Statement 4200.12. The procurement is being conducted under statutory authorities 41 U.S.C. 253 and 41 U.S.C. 1901(e), which permit other than full and open competition. The contract aims to restore proper climate control, ensure compliance with health and safety standards, and prevent potential broader infrastructure failures at the correctional facility.

NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED:
The Federal Correctional Institution (FCI) Safford, located in Arizona, currently has two HVAC units that provide both heating and cooling for climate control in the Special Housing Unit (SHU) and Chapel. Both units are now inoperable, resulting in the facility's inability to maintain the mandated temperature standards outlined in Program Statement 4200.12, which are essential for the health and safety of both staff and inmates. Due to their age and the end of their operational lifecycle, the units have deteriorated beyond repair. Additionally, critical replacement parts and components are no longer available, making immediate replacement the only viable solution. Given FCI Safford's geographic location and the extreme heat experienced during the summer months, the absence of functional HVAC systems poses a significant health and safety risk. Failure to restore proper climate control may lead to unsafe living and working conditions for both staff and inmates and could escalate into a broader failure of the facility’s HVAC infrastructure. The replacement of these HVAC units is both urgent and compelling to ensure compliance with health and safety standards and to safeguard the well-being of inmates and staff. Immediate action is essential to mitigate further risk and maintain operational stability in the institution.
