INTRODUCTION

THIS IS A COMBINED SYNOPSIS/SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME).

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested, and a separate written solicitation will not be issued.

The solicitation number is 75N98026Q01173-05004. This solicitation is issued as a Notice of Intent (NOI) for a non-competitive combined synopsis/solicitation to award a contract or purchase order without providing for full and open competition (including brand-name, if applicable). This is intended to be a firm-fixed price contract and awarded using a lowest price technically acceptable approach.

REGULATORY AUTHORITY

The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-99-1, July 16, 2018. This acquisition is conducted under the procedures as prescribed in FAR 12.603 at an amount not exceeding the simplified acquisition threshold ($350,000).

STATUTORY AUTHORITY

This acquisition is conducted under the authority of FAR 12.603, Streamlined Solicitation for Commercial Products or Commercial Services, and is not expected to exceed the simplified acquisition threshold. Additional authority includes 41 U.S.C. 1901 and FAR 6.302-3(a)(2)(ii).

GENERAL INFORMATION

1. Title: Orbital Shaker Variable-Temperature Incubator Background Information: The purpose of this request is to procure an Orbital Shaker Variable-Temperature Incubator. The Nuclear Magnetic Resonance (NMR) Group at the National Institute of Environmental Health Sciences (NIEHS) requires an additional orbital shaker incubator with variable-temperature and cold-temperature incubation capabilities to support ongoing research activities.

The NMR Group produces proteins and other biological materials for research using recombinant technology and bacterial cell cultures. Controlled-temperature orbital shaking is an essential component of these workflows. Multiple research projects frequently require bacterial cultures to be incubated simultaneously under different temperature conditions. The NMR Group therefore requires a variable-temperature orbital shaker incubator with cold-temperature incubation capability. The additional system will increase available culture capacity and allow multiple recombinant protein production and other biological research activities to proceed concurrently.

Laboratory space is also limited. To maximize available space, the requested incubator should be capable of being safely stacked with the existing INNOVA incubators. A stackable configuration will allow the Group to increase incubation capacity without requiring additional floor space and will facilitate placement of the equipment in an existing shared equipment room with appropriate ventilation and electrical power.

Safety is an important consideration for the proposed configuration because the equipment contains rotating and moving components and may be positioned above floor and waist height when stacked. The requested system should therefore have manufacturer-supported stacking capability and appropriate safety features, hardware, and accessories to ensure stable and safe operation in the stacked configuration.

M4x7 screws Period of Performance: This is a one-time supply acquisition with the duration of the maintenance agreement as specified in the resulting contract or purchase order.

CLOSING STATEMENT

This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a technical proposal, a cost-price proposal, the period of performance, the Unique Entity ID (UEI), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.

A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.

· FAR 52.204-7, System for Award Management, applies to this acquisition.

· The provision at FAR 52.212-1, Instructions to Offerors—Commercial Items, applies to this acquisition. Add any additional instructions as required.

· The provision at FAR 52.212-2, Evaluation—Commercial Items, applies to this acquisition.

· A written notice of award or acceptance of an offer, issued to the successful offeror within the time specified in the offer, shall result in a binding contract without further action by either party.

The Government reserves the right to accept any offer (or part of an offer) before the expiration date, whether or not discussions are conducted, unless a written notice of withdrawal is received prior to award. Add additional evaluation criteria as required.

· FAR 52.212-4, Contract Terms and Conditions—Commercial Items, applies to this acquisition.

· Additional contract requirements or terms and conditions, as determined necessary by the Contracting Officer and consistent with customary commercial practices: None.

· The Defense Priorities and Allocations System (DPAS) is not applicable to this requirement.

Submission Requirements: Responses must include sufficient information to demonstrate the respondent’s capability to provide the required product or service. Price quotations shall include, at a minimum: unit price, list price, shipping and handling costs, delivery timeframe after award, delivery terms, prompt payment discount terms, F.O.B. point (destination or origin), product or catalog numbers, product descriptions, and any other relevant information. Evaluation factors may include, but are not limited to: Equipment Capability, Equipment Warranty and Maintenance Coverage, Delivery, Price, past performance, technical capability, special features, trade-in considerations, expected lifecycle, warranty, maintenance availability, and environmental or energy efficiency considerations.

Respondents claiming to be manufacturers or authorized resellers of a specified brand-name product must provide:

(a) Product, catalog, model, and/or part number(s);

(b) Product description;

(c) Documentation demonstrating that the offered item meets all required salient characteristics;

(d) Quantity;

(e) Estimated price or cost;

(f) Shipping, handling, and/or installation charges; and

(g) Delivery timeframe after receipt of order.

Responses must also include the Unique Entity Identifier (UEI), Taxpayer Identification Number (TIN), and business size certification. All offerors must be actively registered in the System for Award Management (SAM) at www.sam.gov.
