OVERVIEW

The OPRD has historically maintained and enhance the functional use and longevity of the facilities and equipment, meet public safety needs and standards, and provide appropriate public recreational uses such as: hiking trails, water use, camping, and fishing. The OPRD continues to promote the protection of the fish and wildlife, hiking trails and water ways by incorporating measures to eliminate the spreading of noxious weeds and other pests that are detrimental to the land, agriculture, public health, soil and water conservation of the reservoir.

RECIPIENT INVOLVEMENT

The OPRD staff will daily operate and maintain Reclamation’s outdoor recreation facilities for the public at Prineville Reservoir. The resource management plan [lease agreement No. 10-07-10-L1766 between Reclamation and OPRD] will incorporate and guide how the reservoir will be managed and maintained by

OPRD.

The operations and maintenance objectives are to:

• monitor, maintain, protect the resource(s)

• provide safe clean facilities and access to the recreational areas of the reservoir

• provide security to the general public

• provide better stewardship of the areas resources through OPRD’s daily presence on the reservoir

• added protection and enhancement of facilities

• improved communication with the public

RECLAMATION INVOLVEMENT

No substantial involvement on the part of Reclamation is anticipated for the successful completion of the objectives to be funded by this award. It is anticipated that Reclamation’s involvement will consist of standard federal stewardship responsibilities such as monitoring project performance, technical assistance at the request of the recipient, etc.

SINGLE-SOURCE JUSTIFICATION

DEPARTMENT OF THE INTERIOR

SINGLE SOURCE POLICY REQUIREMENTS

Department of the Interior Policy (505 DM 2) requires a written justification which explains why competition is not practicable for each single-source award. The justification must address one or more of the following criteria as well as discussion of the program legislative history, unique capabilities of the proposed recipient, and cost-sharing contribution offered by the proposed recipient, as applicable.

In order for an assistance award to be made without competition, the award must satisfy one or more of the following criteria:

(1) Unsolicited Proposal – The proposed award is the result of an unsolicited assistance application which represents a unique or innovative idea, method, or approach which is not the subject of a current or planned contract or assistance award, but which is deemed advantageous to the program objectives;

(2) Continuation – The activity to be funded is necessary to the satisfactory completion of, or is a continuation of an activity presently being funded, and for which competition would have a significant adverse effect on the continuity or completion of the activity;

(3) Legislative intent – The language in the applicable authorizing legislation or legislative history clearly indicates Congress’ intent to restrict the award to a particular recipient of purpose;

(4) Unique Qualifications – The applicant is uniquely qualified to perform the activity based upon a variety of demonstrable factors such as location, property ownership, voluntary support capacity, cost-sharing ability if applicable, technical expertise, or other such unique qualifications;

(5) Emergencies – Program/award where there is insufficient time available (due to a compelling and unusual urgency, or substantial danger to health or safety) for adequate competitive procedures to be followed.

Reclamation did not solicit full and open competition for this award based the following criteria:

(3) LEGISLATIVE INTENT

Single Source Justification Description:

(3) Legislative intent – The language in the applicable authorizing legislation or legislative history clearly indicates Congress’ intent to restrict the award to a particular recipient of purpose.

The OPRD is the non-federal managing partner that has a current managing partner agreement with Reclamation and is responsible for the administration of the outdoor recreation facilities operations and maintenance at Prineville Reservoir for the public. The Prineville Reservoir Resource Management Plan was completed in August, 2003 and projected needs for the next 25 years. This plan was written by the US Bureau of Reclamation and involved federal, state, local government, Tribes and interested members of the public to develop a plan for managing the land and recreation resources at Prineville Reservoir for the public. The operations and maintenance items are included in this plan to be managed and completed by OPRD.

The OPRD is the managing agency that has successfully managed and maintained the outdoor recreation facilities O & M for Reclamation at Prineville Reservoir for the last 7 years and over 50 years under the recreation lease agreement. The reservoir recreation facilities are open year-round to the public, and averages about 600,000 visitors per year for outdoor recreation use that include camping, boating, fishing, swimming, picnicking, sightseeing, and other day use activities which generates over 10 million dollars to the local economy.

STATUTORY AUTHORITY

The statutory authority used to enter into this Agreement is the Pub. L. 89-72 AS AMENDED: Reclamation Recreation Act of 1992, Pub. L. 102-575, Title XXVIII (16 USC 4601-13 et seq.)

16 USC 4601-18 (b): “The Secretary of the Interior is authorized to enter into agreements with Federal agencies or State or local public bodies for the administration of project land and water areas and the operation, maintenance, and replacement of facilities … as will best promote the development and operation of such lands or facilities in the public interest for recreation and fish and wildlife enhancement purposes.”

16 USC 4601-13 requires in order for Reclamation to fund recreation and/or fish and wildlife enhancements at Reclamation reservoirs beyond that of “minimum basic facilities” a non-federal public body must indicate their intent in writing to agree to administer the project land and water areas for

R17AP00033 Page 4 of 4 recreation or fish and wildlife enhancement. This agreement has been designated a “managing partner agreement.”

Further, 16 USC 4601-12 states, “That it is the policy of the Congress and the intent of this Act that (b) planning with respect to the development of the recreation potential of any such project shall be based on the coordination of the recreational use of the project area with the use of existing and planned Federal, State, or local public recreation developments; and (c) project construction agencies shall encourage non- Federal public bodies to administer project land and water areas for recreation and fish and wildlife enhancement purposes and operate, maintain, and replace facilities provided for those purposes.“

Therefore, for Reclamation to fund recreation and/or fish and wildlife enhancement activities at its reservoirs, there must be a non-federal managing partner that has a current managing partner agreement with Reclamation for these activities. Reclamation does not have the discretion to award a financial assistance agreement for cost-sharing to any other entity except the managing partner in accordance with 16 USC 4601-13 et seq.

OPRD and the U.S. Bureau of Reclamation (Reclamation) have entered into a 25 year Managing Partner Agreement No. 10-07-10-L1766, executed on December 15, 2011, [See Tab A.9 in Grant File], for facilities at Prineville Reservoir (Reclamation owned).
