JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)
Pursuant to 10 United States Code (U.S.C.) 2304(c)(1) and Federal Acquisition Regulation
(FAR) 6.302-1 Only One Responsible Source and No Other Supplies or Services Will
Satisfy Agency Requirements, and NASA FAR Supplement Part 1806.3, Other Than Full and Open Competition
For the NASA Open Innovation Support Services for Internal Collaboration
Follow-on Procurement
1. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:
This justification provides the rationale for contracting by other than full and open competition with InnoCentive, Inc. (InnoCentive) to provide an Internal Collaboration Support Platform to launch challenge-based competitions for NASA employees to collaborate within and across the NASA organization. This is a follow-on contract to the current Open Innovation Support Services for Internal Collaboration Support Platform and Intermediary contract NNJ11HA48C, with a period of performance ending September 30, 2016.
2. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the Agency’s needs (including the estimated value):
The Government requires an Internal Collaboration Support Platform to provide the capability for NASA employees to launch challenge-based competitions that NASA civil servants and contractor employees can use to gather ideas, end-point solutions, or expertise within or across all NASA organizations. The user interface shall maintain the current platform, user community, and integrate with the current agency employee authentication system. The Internal Collaboration provider, in addition to providing the platform, serves as an intermediary between the NASA challenge owner and the solver community and provides assistance with platform program management, organizational planning, training, and challenge administration and execution.
The proposed contract is a Firm-Fixed-Price Indefinite-Delivery Indefinite-Quantity contract with a 5-year ordering period, including a 2-year base and three 1-year options. The estimated Not-to-Exceed value for the entire ordering period, based on an Independent Government Estimate (IGE), is approximately $1,500,000.
3. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:
The applicable statutory authority permitting other than full and open competition for this proposed contract is 10 U.S.C. 2304(c)(1) and FAR 6.302-1(a)(2)(iii)(A), “services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.”

4. FAR 6.303-2(b)(5)&(9) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited and any other facts supporting the use of other than full and open competition:
InnoCentive developed, customized, maintains and owns the copyright to the software for NASA@Work. All of the computer software that collectively makes up the current NASA@Work existing platform technology infrastructure is licensed to the Government. The software platform integrates into NASA's existing authentication system. The software as it exists in its customized format is uniquely tailored to the Government requirements and only available through the InnoCentive software platform.
In addition to the proprietary computer software, InnoCentive has in-depth knowledge of the various types of NASA internal collaborations and challenges to include insight into the community of solvers abilities and participation levels. Using this knowledge InnoCentive has cultivated specialized expertise in the developing industry of internal collaboration available to NASA through support services referred to as “challenge development.”
Use of any other platform would require duplication of work and loss of infrastructure that cannot be recovered through competition without substantial duplication of time, costs, and risk to timely and successful implementation.
5. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
A synopsis for this proposed contract action was posted on the Government-wide Point of Entry (GPE), http://www.fedbizopps.gov, in accordance with Subpart 5.2. The synopsis opened on February 16, 2016, for 10 days, and closed on February 26, 2016, at 4:30 pm Central. There were no responses to the synopsis.
6. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The contractor’s proposed price will be evaluated in accordance with FAR 15.404-2. The Contracting Officer (CO) will work closely with the Contracting Officer Representative
(COR) to determine if InnoCentive’s proposed price is fair and reasonable. This includes development of an IGE prior to receipt of the proposal and performing a technical evaluation.
InnoCentive’s proposal will be compared against the IGE. A technical evaluation will also be performed to analyze the basis of estimate for each cost element proposed to assess if InnoCentive’s proposal is adequate to meet the requirements of the Statement of Work.
As requested in the proposal, individually identified Fixed-Price services will be analyzed using historical prices, internal governmental data, and data requested from the offeror. The CO will review the results of the technical and cost analysis to identify any major issues or concerns. Any proposal issues or concerns will be addressed during fact finding and resolved prior to negotiations. InnoCentive will also be required to submit a certificate of current cost or pricing data for any task order that meets or exceeds the $750,000 threshold upon completion of negotiations.

7. FAR 6.303-2(b)(8) – Description of the market survey conducted, and the results, or a statement of the reasons a market survey was not conducted:
The market was surveyed through multiple means. A synopsis of the proposed contract action was posted on the GPE on February 16, 2016. There were no responses to the synopsis. The secondary method of market research included an informal survey of the industry by the COR that found there were no other responsible sources that either had or could build an internal collaboration support platform capable of interfacing with NASA's existing authentication system without substantial duplication of cost and unacceptable schedule delays.
8. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition, such as:

There were no responses to the synopsis of this proposed contract action.
10. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
The Agency will continue to assess the industry capabilities and remove or overcome any barriers to competition before any subsequent acquisition for these services is required. To do so, the technical office is actively performing an in-depth analysis of the barriers to future competition, existing resources available for customization, and monitoring developing industry capabilities that could enable future competition of these specialized requirements.
The responsible procurement office is a partner in this ongoing effort and will support the effort with formal and informal methods of publication as required. The technical office will continue to monitor industry capabilities by attending related seminars and industry forums, as well as review relevant technical journals, Government and commercial databases, and internet resources for relevant information.
