Justification for Other Than Full and Open Competition

This document is a Justification for Other Than Full and Open Competition (10 U.S.C. § 3204) filed by the Department of Homeland Security (DHS), United States Coast Guard (USCG), Program Execution Office – Shore, Office of Contracting and Procurement (CG-SHORE-C).

The USCG seeks authority to modify the National Multiple Award Construction Contract (NMACC) III Indefinite Delivery, Indefinite Quantity (IDIQ) contracts to increase the aggregate ceiling from $4,000,000,000.00 to $12,250,000,000.00 across 27 IDIQ contracts organized in three contractor pools. The modification supports mission-critical design and construction projects for USCG and other DHS components funded through disaster supplemental appropriations and the One Big Beautiful Bill Act (Public Law 119-21), which provided $4,379,000,000 in special appropriations for shore facilities recapitalization. The increase ensures sufficient contract capacity to execute time-sensitive projects including facility design, planning, engineering, recapitalization, construction, rebuilding, and program management at DHS installations nationwide. Pool 1 (10 contractors, awarded September 29, 2023), Pool 2 (8 contractors, awarded August 21, 2024), and Pool 3 (9 contractors, awarded August 13, 2024) collectively serve as the DHS Strategic Sourcing Office Portfolio vehicle accessible to all DHS components.

The justification for single-source authority under 10 U.S.C. § 3204(a)(1) rests on six primary factors: continuity of services from fully-vetted current contractors familiar with USCG facilities and processes; unacceptable mission impact if projects are delayed, including recapitalization of family housing, station upgrades, and waterfront facilities; time-sensitive funding constraints tied to strict obligation timelines; need to reserve capacity for unforeseen site conditions and expanded project scopes; significant schedule risk and duplicative administrative costs associated with new full competition; and future on-ramping/off-ramping strategy to periodically add qualified vendors and maintain competitive environment. The contracting officer determines that anticipated prices will be fair and reasonable based on adequate price competition among identified pool members. Public notice will be posted on SAM.gov within 14 days of implementation.
