About this file
This document is a Justification for an Exception to Fair Opportunity (JEFO) for a modification to the NIAID/OCICB Chief Information Officer (CIO) Management Support Program (CMSP) task order 75N98119F00014 under contract HHSN316201200160W.
The CMSP task order is a hybrid contract with a firm fixed price task for task order management and time and materials tasks to provide CIO management services, including policy and governance support, budget and financial analysis, IT strategy and planning, program and project management, IT investment management, and enterprise architecture support. The task order was originally awarded competitively under the CIO-SP3 Small Business contract vehicle in 2019 for a 12-month base period and four 12-month option periods, with a total period of performance from April 1, 2019 through March 31, 2024.
This JEFO is required to extend the CMSP task order for up to six additional months using FAR clause 52.217-8 to prevent a lapse in services while the follow-on requirement is recompeted under a GSA schedule by the Department of Interior assisted acquisition office. An increase to the ceiling of the task order is required for the extension period, but no new tasks will be added. The CMSP task order provides critical services for NIAID's IT governance, financial management, and operations that cannot be interrupted.

Justification for an Exception to Fair Opportunity “Source Selection Information – see FAR 2.101 and 3.104”
(PMO) Support; Data Analysis and Visualization; and Technology Management and Assessment. To accomplish the CIO’s mission, NIAID requires a state-of-the-art CMSP initiative. NIAID relies heavily on highly skilled personnel to support scientific research, management and administrative processes. NIAID recognizes that most of its systems, projects and activities require skills from multiple specialties.
Project background
CMSP solutions are currently being performed by NTT DATA FedHealth through task order 75N98119F00014, issued against NIH Information Technology Acquisition and Assessment Center (NITAAC) CIO- SP3 Small Business Government-Wide Acquisition Contract (GWAC) HHSN316201200160W, with a period of performance of a 12-month base period and four (4) successive 12-month option periods. The entire period of performance is from April 1, 2019, through March 31, 2024. The CMSP task order is a hybrid contract type; one task is firm fixed price and all other tasks are time and materials. The CMSP task order was awarded competitively, with all eligible contract holders on the CIO-SP3 Small Business vehicle receiving a fair opportunity to compete for the task order under solicitation C-46629-SB.
The primary objective of this Task Order SOW is to provide the NIAID CIO with access to contract personnel that have the required advisory subject matter expertise (SME) and skill sets appropriate to assisting in discharging the unique and specialized duties for the execution of the NIAID OCIO’s Chief Information Officer (CIO) Management Services Program (CMSP). The program supports NIAID programs of research and research training involving causes, diagnoses, treatment and prevention of emerging and re-emerging immunologic and infectious diseases and bio defense. The program is required for OCICB’s portfolio and systems to be developed in the most effective, efficient, and forward-thinking manner that allows for a high degree of system/technology compatibility and functionality. Support that OCICB services continue to meet the needs of NIAID and all other stakeholders through on-going system enhancements, new development, and support. This support must reasonably anticipate emerging needs through all aspects of the Capital Planning and Investment Control (CPIC) process and Solution Delivery Framework (SDF), which heavily depends on an agile approach to systems development.
Work on the CMSP task order falls under the following tasks:
Task Order Management to provide the technical and functional activities necessary for the management of the requirement and resulting contract activities.
The contractor employs a technical approach, organizational resources, and management controls to achieve cost, schedule, and performance requirements.
CIO Management Service Support includes the following subtasks:
1. Policy, Governance and Organizational Alignment Support to ensure that NIAID’s policies and organizational structures related to information resource management are aligned with the Institute’s broader mission, functions, policies and procedures.
2. Budget, Financial Management and Acquisition Analysis Support to include developing, updating, tracking, and reporting allocated, obligated, capitalized, and expense funds, as well as conduct analyses to provide budget financial and acquisition recommendations.
3. Information Resources Management (IRM) Strategy and Planning Support to design, develop and implement disciplined processes related to IRM strategy and planning.
4. Program Management, Agile and DevOps Support to assist the NIAID CIO to implement a comprehensive, fully integrated approach to program and project management.
5. Health IT Investment Management and Emerging Trends Analysis Support to assist the OCIO to implement and maintain an on-going ITIM process that fully complies with Federal and HHS/NIH guidance.
6. Enterprise Solutions Architecture and Special Projects Support to define, develop and implement an Institute-level architecture that complies with the Federal Enterprise Architecture Framework (FEAF) and HHS/NIH Enterprise Architecture guidance.
Any interruption of service would negatively impact any of the tasks under the CMSP task order. However, the most severe and adverse effect would be evident and immediately visible to the program management and financial management support.
Program management support under the CMSP task order provides services that run the Control Advisory Board (CAB) and DevOps operational support. These functions are critical in briefing NIAID Leadership for their consideration and approval of all proposed changes and deployment in Information Technology (IT) infrastructure, security, and software engineered solutions. This IT governance practice supports the Gramm-Leach-Bliley Act (GLBA) and Sarbanes-Oxley Act, as well as HHS Strategic Goal 5 – Advance Strategic Management to Build Trust, Transparency, and Accountability. NIAID policy requires this mandatory function for IT change management - even critical IT changes would not be allowed without some form of governance.
Budget, Financial Management, and Acquisition Analysis support under the CMSP task order is also extremely critical at this moment because a majority of NIAID OCICB labor support contracts are expiring. These contracts are either being extended or awarded, and any lapse in budget and financial support would severely impact NIAID’s ability to award these new follow-on contracts. In addition, the processing of equipment purchases, license renewals, and other procurements needed in IT infrastructure operations and maintenance, would be negatively impacted by any lapse in service under the CMSP task order. The CMSP task order provides support for day-to-day financial management to include, but not limited to, developing, updating, tracking, reporting (allocated, obligated, capitalized, and expensed funds), as well as conducting analyses to provide budgetary financial recommendations. A lack of proper financial management would cripple NIAID OCICB functional operations.
There are no further options available on the current CMSP task order 75N98119F00014.
Therefore, this JEFO proposes to extend the CMSP task order via three 2-month options under FAR 52.217-8 to prevent a lapse in service if the follow-on procurement is protested or takes longer to award than anticipated.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value).

CIO-SP3 - NIAID/OCICB Chief Information Officer (CIO) Management Support Program (CMSP) Task Order
Project description.
This requirement is to extend support for the NIAID/OCICB Chief Information Officer Management Support Program (CMSP) task order, 75N98119F00014, under contract HHSN316201200160W with NTT DATA FedHealth utilizing FAR 52.217-8. FAR 52.217-8 was incorporated into the C task order; however, pricing associated with the option was not evaluated for the award; therefore, this JEFO is required. The task order under CIO-SP3 Small Business, has a base year, and four one-year option periods.
The overall period of performance is April 1, 2019, to March 31, 2024, including all options. The proposed extension under FAR 52.217-8 is to prevent a lapse in service while the follow-on requirement is recompeted under the General Services Administration (GSA) schedule by the Department of Interior (DOI) assisted acquisition office.
An increase to the ceiling of the task order is required for the extension period. Task order 75N98119F00014 contains predominately time and materials (T&M) tasks and one firm fixed price (FFP) task for task order management. The proposed extension will not change the contract type of the existing tasks, nor will new tasks be added to the task order.
