About this file
This document contains federal contract provisions and evaluation criteria for a Request for Quotation (RFQ) to procure an FTIR (Fourier Transform Infrared Spectroscopy) Integrating Sphere and Components System.
The solicitation will be awarded on a competitive best value basis using a trade-off methodology, with non-price factors combined being more important than cost or price, except when offers are essentially equal on non-price factors. Quotations will be evaluated on three primary factors: (1) Technical Approach—assessing the offeror's understanding of requirements, system capabilities meeting or exceeding minimum technical specifications (signal-to-noise ratio, working range, system flexibility for varied samples), and post-delivery support; (2) Experience—evaluating the offeror's recent manufacture and delivery of similar products, with up to three project examples from the last five years required, including project details, complexity, customer references, and measurement data; and (3) Schedule—conformance with Statement of Work (SOW) requirements, with more efficient schedules evaluated favorably when quality standards are maintained. Price will be evaluated for reasonableness but not scored. The NAICS code is 327390 (Other Concrete Product Manufacturing) with a small business size standard of 500 employees. Standard FAR provisions are included addressing inverted domestic corporations, delinquent tax liability or felony convictions, small business program representations (including EDWOSB, SDVOSB, WOSB, and HUBZone concerns), Buy American Certificate requirements for domestic end products, and place of manufacture disclosure for statistical purposes.

FAR 52.209-2 Prohibition on Contracting with Inverted Domestic Corporations- Representation
(a) Definitions. "Inverted domestic corporation" and "subsidiary" have the meaning given in the clause of this contract entitled Prohibition on Contracting with Inverted Domestic Corporations ( 52.209-10).
(b) Government agencies are not permitted to use appropriated (or otherwise made available) funds for contracts with either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation, unless the exception at 9.108-2(b) applies or the requirement is waived in accordance with the procedures at 9.108-4.
(c) Representation. The Offeror represents that-
(1) It □ is, □ is not an inverted domestic corporation; and
(2) It □ is, □ is not a subsidiary of an inverted domestic corporation.
FAR 52.212-2 Evaluation- Commercial Products and Commercial Services
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Responses received to this RFQ will be evaluated on a Trade-Off Basis.
The award will be made on a competitive best value basis, using “tradeoff” among price-cost and non-price-cost factors. All evaluation factors other than cost or price, when combined, are more important than cost or price. However, cost or price may become a critical factor in source selection in the event that two or more offers are determined to be essentially equal following the evaluation of all factors other than cost or price.
Each quotation will be evaluated in strict conformity with the evaluation factors, utilizing written critiques. The evaluation will be based upon the demonstrated capabilities of the prospective contractor in relation to the needs of the project as set forth in the RFQ.
The following factors shall be used to evaluate quotations:
(1) Technical Approach: The Government will evaluate the quoter’s proposed technical approach and capabilities for providing an FTIR (Fourier Transform Infrared Spectroscopy) Integrating Sphere and Components System that meets or exceeds all requirements specified in the Statement of Work (SOW). The Government will assess the extent to which the technical volume demonstrates the quoter’s overall understanding of the Government’s requirements and the effectiveness, efficiency, and feasibility of the proposed approach. The evaluation will consider, as applicable, the extent to which the proposed system and components meet the technical, performance, functional, and compatibility requirements identified in the SOW; and the quoter’s proposed approach to delivery, installation, technical support, warranty, training, or other post-delivery support requirements identified in the SOW.
In addition, the Government will evaluate the extent to which quotations exceed the minimum technical specifications defined in the SOW. Therefore, system capabilities in https://www.acquisition.gov/far/52.209-10#FAR_52_209_10 https://www.acquisition.gov/far/9.108-2#FAR_9_108_2 https://www.acquisition.gov/far/9.108-4#FAR_9_108_4 the following categories will also be considered: potential to exceed minimum system specifications (e.g., signal to noise ratio, working range [detector, source, and FTIR]; the ability of the system to function as intended across this working range without manual adjustment and/or recalibration to the system; system flexibility to successfully be applied to samples of varied size, thickness, fragility, and optical properties. Quoters submitting a quotation that exceeds the minimum specifications may be evaluated as superior to quotations that simply meet the minimum specifications.
(2) Experience: The Government will evaluate the extent to which the Quoter has recently manufactured and/or delivered products that are similar and relevant to the FTIR Integrating Sphere and Components System required by this solicitation. The Government will consider the relevance, complexity, and recency of the Quoter’s experience, as well as the extent to which the experience demonstrates the Quoter’s capability to successfully provide equipment and components meeting specialized optical, infrared spectroscopy, laboratory, and measurement requirements.
The Quoter shall provide descriptions of up to three (3) projects completed within the last five (5) years that demonstrate experience manufacturing and/or delivering products similar to those required by this solicitation. Projects involving FTIR integrating spheres, infrared spectroscopy equipment, optical measurement systems, integrating spheres, or other comparable laboratory instrumentation and components are considered relevant.
For each project, the Quoter shall provide:
1. Project title and customer name.
2. Period of performance (month/year completed).
3. Description of the manufactured product(s), including complexity, and intended use.
4. Description of the Quoter's role and responsibilities.
7. Contract or project value, if available.
8. Customer point of contact, including name, title, email address, and telephone number (if available).
9. Examples of measurement data from the proposed system (i.e., spectrally-dependent measurements of sample emissivity and transmissivity)
The Government will consider the recency, relevance, scope, complexity, and similarity of the referenced projects when evaluating the Quoter's experience. Greater consideration may be given to projects completed within the last five (5) years focused on FTIR integrating spheres, infrared spectroscopy equipment, optical measurement systems, or similar specialized laboratory instrumentation and components, particularly projects involving the integration, testing, calibration, installation, or delivery of equipment for research, testing, laboratory, or other specialized measurement applications.
(3) Schedule: The proposed schedule will be evaluated for conformance with the requirements stated in the SOW. Proposed schedules that do not, at a minimum, meet the stated requirements will be considered unacceptable. Conforming schedules will be considered acceptable. More efficient schedules may be evaluated more favorably when the proposed schedule and associated technical approach are determined to be reasonable and demonstrate the ability to maintain the required level of technical quality.
Price. The Government will evaluate offers for award purposes by making a price reasonableness determination. For a price to be reasonable, it must represent a price to the government that a prudent person would pay when consideration is given to prices in the market. Quoted pricing will be evaluated but not scored. Price evaluation will determine whether the quoted price is complete, fair, and reasonable in relation to the RFQ requirements.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.209-11. Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that–
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that–
(1) It is □ is not □ a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and
(2) It is □ is not □ a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months.
