Amendment No. 5 June 17, 2010 Project Construction Management Technical Support Services Capital Projects Questions

1. Re: pg 36. item f. Pricing Proposal states: “Offeror shall submit one (1) original Pricing Proposal and four (4) copies of their technical proposals: Pricing Proposals shall be bound in 3-ring binders. Is this correct or do you want 1 original of the Pricing Proposal and 4 copies of the Pricing Proposal?

Answer: f. pg. 36 Pricing Proposal is changed to Offer shall submit one(1) original pricing proposal and 4(4) copies of the pricing proposal.

2. Re: pg 38L.5.4 Factor D – Offerors Past Performance states: “For maximum credit, referenced projects shall be ongoing or have been completed within the past five (5) years. If the referenced projects are outside of the three year period specified, the Offeror shall identify these projects and provide an explanation of why these projects have been provided (e.g. company business decision to stop and restart work in this disciplinary work area; bid but not awarded contracts in this area; etc.). Is the period 5 years or 3 years?

Answer: pg 38 Factor D- Offers Past Performance is changed to: If the referenced projects are outside of the five year period specified, the Offeror shall identify these projects and provide an explanation of why these projects have been provided (e.g. company business decision to stop and restart work in this disciplinary work area; bid but not awarded contracts in this area; etc.).

3. Re: pg 40, item m. lists Small Business Subcontracting Plan: SF 295. Pg 23, H.16

Small Business Subcontracting Plan states: The government requires the adoption of Federal Acquisition Regulation (FAR) 52.219-8, Utilization of Small, Small Disadvantaged and Women-Owned Small Business Concerns, in all purchases/contracts over $25,000 that offer subcontracting opportunities. Our firm provides all of the requested services in-house. Thus, the contract does not offer subcontracting opportunities. Shall we indicate that the Small Business Subcontracting Plan is “not applicable” or must we subcontract some of the work that we provide?

Answer: Pg. 23 the Small Business Subcontracting Plan “is applicable” if the Contractor is a Large Business.

4. Re: pg 40, item k. Agent Authorization Letter: If I read this form correctly it is only “if a third party is utilized by the proposing contractor”. If we are preparing and submitting our proposal without the use of a third party, shall we submit this form marked as “not applicable?”

Answer: The Agent Authorization Letter is only an example. Delete the information that does not apply to your firm. Please submit a letter indicating who the agent (individual (s)) legally authorized to sign the contract and modifications.

5. Re: Attachment 9, Proposal Checklist: The checklist is not included in the document.

Answer: The Proposal Checklist Attachment #9 is attached to this Amendment.

Please note the checklist is not required. The checklist is provided as a courtesy to the Offeror.

Is the only difference between “Hourly Rate” and “Overhead/Profit Rate” wages?

6. Please confirm the “Hourly Rate” includes wages, all overhead, all general & administrative expenses, and profit? If different, please clarify.

Answer: The Gallery is requesting the fully burdened labor rates. Theses rates include direct labor rate (hourly labor rate) and the (Overhead/Profit Rate) which may be all or one of the following: fringe benefits, indirect overhead, G&A, and profit. The Gallery is requesting a discount for Overhead expenses due to the contractor working on site.

7. Please confirm the “Overhead/Profit Rate” includes all overhead, all general & administrative expenses, and profit? If different, please clarify.

Answer: The Overhead/Profit Rate which may be all or one of the following:

fringe benefits, indirect overhead, G&A, and profit. Depending on your firms accounting set up.

8. Is there a difference between “indirect overhead” (included in Amendment 4, page 2, #2) and “overhead” (B.5 page 5 of RFP, #4)?

Answer: Overhead refers also to indirect overhead charges.

9. Is the “Base Year Total” calculated as “Hours” multiplied by “Hourly Rate”?

Answer: The Base Year total is the Hours multiplied by the hourly rate and overhead/Profit total. Alternatively, the Base Year total is multiplied by the total fully burdened labor hour rate. (Hourly Rate and Overhead/Profit Rate)

10. Please clarify whether Pricing Proposal item “l”, Summary of Subcontract Report, SF 295 is required to be submitted with the proposal (from large businesses).

This requirement is stated on RFP page 40, but this form is not included on the proposal checklist. The form’s instructions state it is required to be submitted as a reporting measure for entities holding contracts.

Answer: Yes, the SF 295 is required if the Offeror is a Large Business. The SF

295. Attached is a revised Proposal Check List.

11. Are Technical Proposals and Pricing Proposals required to be packaged separately for shipping/delivery to NGA?

Answer: Yes, Please package the Pricing Proposal separately from the Technical Proposal.

12. L.5.1. Factor E – Pricing (page 40): we understand completion of the tables in

Section B. Our question is in regards to the last sentence of this paragraph. “The Offeror may not deviate from the required elements of the price breakdown format for a firm-fixed price for all services through the base and four (4) option periods.” As this is an IDIQ contract, we cannot establish a level of effort at this time for a firm fixed price. If you still want a firm fixed price, is there a separate form to fill out? We do not see one.

Answer: The fully burdened hourly labor rate is to be a fixed price hourly rate.

The total cost of the task orders are determined at a different date.

13. B Pricing Proposal Format (item d) page 39: What do you mean by pricing proposal? Do you mean the SF 33?

Answer: The Pricing Proposal is Section B.5 Labor hour and Pricing Amount

14. Do we include the “Section B Pricing Tables” in (item d) or (item g)?

Answer: Yes, in (item d) (item g) Please state the percentage of discount for the Overhead/rate. The rates should show the discount and include a statement of explanation of percentage discount rate if any.

15. B Pricing Proposal format (item j) page 40: Are we supposed to fill in the SF30

Amendment Forms and include in our proposal? We are acknowledging receipt of the amendments in the text of our Price Proposal. Is this enough?

Answer: Yes, please fill in the SF 30 Amendment Form and include in the proposal.

Pg. 41 Section L.7 Amendments to the RFP is changed to the following:

If this RFP is amended by the Gallery the amendment will be uploaded on FBP web site (www.fbo.gov) The Offerors are required to acknowledge receipt of the SF 30 Amendment Form and submit a copy with the proposal.
