(VI) Description of requirements is as follows:
1) Organization: The Northwest Fisheries Science Center (NWFSC) National Oceanic and Atmospheric Administration (NOAA) of the Department of Commerce (DOC) is a government agency charged with the mission of stewardship for living marine resources.
2) Background: The NWFSC has provided safety net rearing of Snake River Sockeye Salmon listed as Endangered under the United States Endangered Species Act since 1991. The Burley Creek Hatchery has been the freshwater rearing station for these ESA-listed salmon since 2001. These captively-reared fish are critical to the recovery of this salmon population in the wild. The Burley Creek Hatchery requires liquid oxygen to maintain fish health during culture and for production of ozone required for biosecurity protocols.
3) Objective: The objective of this SOW is to upgrade the requirement for storage and delivery of liquid oxygen. Liquid oxygen (LOX) is used for either emergency life support (during interruptions of water flow) or for oxygen supplementation. At present, there is a rented 500 gallon bulk LOX tank on site with an automatic telemetry station. The telemetry station notifies the vendor to schedule deliveries when the tank is depleted to a specific volume. The LOX is converted to oxygen gas which flows 24 hours per day/seven days per week at variable flow rates, depending upon demand. Disruption to the oxygen supply is not acceptable for these critically endangered fish. Oxygen usage will vary by season, and by the number of fish under culture. Typical usage to the fish has been around 3,200 CCF per year. The vendor must be able to accommodate varying delivery amounts and schedules. Typically, the months of June to November have required more oxygen, while November to June have required less.
In 2022, a new ozone system at Burley Creek Hatchery will be brought online, requiring a greater volume of LOX than the current tank can supply. Estimated future LOX usage could potentially be up to 29,000 CCF per year in some years, but this volume is not required to be met or it can exceed this amount.
This Statement of Need is to replace the current tank and provide a variable supply of LOX required by changing operations at the Burley Creek Hatchery:
a) Replace the current 500-gallon LOX tank with a new minimum 1,500-gallon tank.
b) Determine if existing concrete pad will accommodate the new tank. If it won’t, provide an estimate to increase pad dimensions. The current pad measures approximately 11’ by 14’ with a fenced enclosure.
c) Complete removal of old tank (coordinated with the current vendor if current vendor is not selected) and existing equipment on the concrete pad where the tank is located. This includes providing cranes, labor, and equipment needed to move both tanks. Return old tank and equipment to current vendor in good shape.
d) Installation of an appropriately-sized (minimum 1,500 gallons) new tank, replace existing aged NOAA equipment, valves, and gauges within the concrete pad area, and connect to facility piping at the edges of the concrete pad area, to be within current NFPA 55 standards.
e) Test newly installed equipment for leaks.
f) Provide and install an automated telemetry refill-ordering system, to be monitored daily.
g) Quote should list the costs of monthly tank rental, including any fees (please note this is Washington Sales Tax exempt).
h) Quote should state the cost per CCF, and fees, for tank refills of LOX as needed.
i) Submit for the Washington State Boiler Tank Permit and/or any other permits needed. Perform installations per all Federal, State, and Kitsap County requirements.
j) Include quotes for option years.
Tank replacement and filling of the new tank must be completed by 1 June 2022. The tank and connecting piping and gauge replacements must be coordinated so it is done within a reasonable amount of time (ideally within 2 days). Vendor must connect a supplemental oxygen supply to the facility to maintain an uninterrupted oxygen supply to any fish currently housed in the facility, and preparations must be made to minimize time fish are without oxygen during the connection swap.
There is no power supply at the oxygen tank pad, located outdoors in a secure fenced area. The telemetry must be self-powered, i.e. solar, etc. Vendor will provide a lock to secure the gate to the oxygen tank, and will provide NOAA Burley Creek Hatchery with a copy of the key.
Vendors must properly train their employees in all aspects of driving their trucks and operating the LOX filling station/equipment. Delivery truck drivers must be able to safely negotiate a ninety-degree turn from the single-lane access road through an 18-foot wide gate opening, avoiding an access-card reader post located approximately ten feet inside the gate (see photos). There is normally plenty of turn around space inside the gated area.
4) Deliverable: Approximately 29,000 CCF of liquid oxygen per year (may exceed or may not meet this amount in any given year) and the tank rental fee for each period of performance year. An automatic telemetry refill level notification device is required for continuity of LOX supply.
5) Location: Northwest Fisheries Science Center’s Burley Creek Hatchery located at 11421 Bethel-Burley Road, Port Orchard, WA 98367. (NOTE: Burley Creek Hatchery is part of the Manchester Research Station, but is physically at a different location.). A site visit is strongly encouraged before submitting a quote.
6) Period of Performance: Base period is date of award through 1/31/23. Vendor should also include quotes for four additional option years. Tank rental fee should be pro-rated for a partial month at the beginning of the contract, if needed.
(a) Date of award to 1/31/23 for base year
(b) 2/1/23 to 1/31/24 for option year 1
(c) 2/1/24 to 1/31/25for option year 2
(d) 2/1/25 to 1/31/26 for option year 3
(e) 2/1/26 to 1/31/27 for option year 4
7) Work Hours: As the facility is gated and secured when no personnel are present, the Vendor shall coordinate weekdays when personnel are present to perform work and/or deliver oxygen. Normal business hours are 8:00 a.m. to 4:00 p.m.
(VII) Liquid Oxygen will be delivered to National Marine Fisheries Services NWFSC Burley Creek Hatchery, 11421 Bethel Burley Road SE, Port Orchard, WA, 98367 and the tank replacement is at the same address and to be completed within 90 days or sooner after award.
Base Year: Date of award through 1/31/2023 Tank rental fee should be pro-rated for a partial month at the beginning of the contract, if needed.
Option Year 1: 2/1/2023 through 1/31/2024 Option Year 2: 2/1/2024 through 1/31/2025 Option Year 3: 2/1/2025 through 1/31/2026 Option Year 4: 2/1/2026 through 1/31/2027

Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)
(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
