About this file
This is a certification form required by the United States Department of State for federal procurement actions to ensure compliance with the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year 2019, specifically Public Law 115-232.
The form requires vendors (referred to as "merchants") to make representations regarding covered telecommunications equipment and services. Vendors must answer two key questions: (1) whether they will provide covered telecommunications equipment or services to the Government in performance of any resulting contract, subcontract, or contractual instrument from the solicitation, and (2) whether they use covered telecommunications equipment or services or any equipment, system, or service that uses such covered equipment or services. If vendors respond affirmatively to either question, they must provide additional disclosure information as specified in the Federal Acquisition Regulation (FAR) sections 52.204-24 and 52.204-26, and acknowledge contract clause 52.204-25. The form must be completed and signed by a merchant's authorized representative with binding authority and returned to the contracting officer's designated Contract Specialist. This certification template applies to all federal procurement actions and represents a mandatory compliance requirement under federal contracting regulations.
