About this file

This document includes a sole source justification and notice of intent to award a sole source contract to Duff & Phelps, LLC. The Executive Office for United States Attorneys requires NetDocuments Government IT integration services, including repository, cabinet, metadata, and security configuration for its NetDocuments document management system in the Microsoft Azure Government cloud. The services are necessary to meet federal security requirements for storing common productivity files across United States Attorneys Offices. The anticipated one-year contract value was not disclosed. Interested parties had five days from the notice publication date of May 11, 2020 to respond, with responses due to the contracting officer by the close of business on May 16, 2020. A determination to proceed with a sole source award rested solely with the agency.

JUSTIFICATION

The particular brand name, product, or feature is essential to the Government’s requirements. Market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs. Competition is not required per 41 U.S.C.

3304(a)(1).

There is only one responsible source and no other supplies or services will satisfy agency requirement.

Competition is not required per 41 U.S.C. 3304(a)(1).

The need for the supplies or services is of such an unusual and compelling urgency that the Federal Government would be seriously injured unless the number of sources solicited is limited. The contract period will not exceed the time necessary to meet the unusual and compelling requirements of the work to be performed under the contract. The contract period will not exceed the time necessary to enter into another contract for the required goods or services through the use of competitive procedures. The contract period will not exceed one year. Competition is not required per 41 U.S.C. 3304(a)(2).

The procurement will be made through another executive agency or from a specified source that is expressly authorized by statute. Competition is not required per 41 U.S.C. 3304(a)(5), and:

18 U.S.C. 4124. Award will be made to Federal Prison Industries (UNICOR).

44 U.S.C. 501-504, 1121. Award will be made for Government Printing and Binding.

15 U.S.C. 657a. Award will be made under the HUBZone Act of 1997.

15 U.S.C. 657f. Award will be made under the Veterans Benefits Act of 2003.

Disclosure of the agency’s needs would compromise the national security. Competition is not required per 41 U.S.C. 3304(a)(6).
