(End of provision FAR 52.212-1)

(IX) Provision 52.212-2, Evaluation-Commercial Products and Commercial Services applies to this procurement. The evaluation criteria included in paragraph (a) of the provision are as follows:

EVALUATION CRITERIA

The Government intends to award a single firm fixed price purchase order (PO) from this solicitation utilizing simplified acquisitions procedures in accordance with FAR part 13.5. The Government reserves the right not to award a PO and to make an award without exchanges based solely upon initial quotes. Contractors are strongly encouraged to submit their best technical solutions and price in response to this RFQ.

Basis for Award:

The Government will award a firm fixed price purchase order resulting from this solicitation once the Contractor is verified as responsible and the quotation conforming to the solicitation is found most advantageous to the Government, price and other factors considered. The Government will evaluate quotations based on the following evaluation criteria factors: 1) Technical Capability, 2) Experience 3) Past Performance, and 4) Price. Technical Capability, Experience, and Past Performance are more important than price. As non-price factors become more equal among offerors, price may become the determining factor.

An Offeror's failure to address any factor may be considered indicative of the Offeror's lack of understanding of the Government's requirements and may result in the offer being determined unacceptable.

Once the government determines the apparent successful quoter, the government reserves the right to communicate with only that contractor to address any remaining issues, if necessary, and finalize a purchase order with that apparent successful quoter. These issues may include technical and price. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Contracting Officer, the government reserves the right to communicate with the next best-suited contractor based on the original analysis and address any remaining issues.

Evaluation Factors:

Factor 1- Technical Capability:

This procurement is for commercial items. Therefore, prototypes or demonstration models will not be accepted. Additionally, used or refurbished instruments will not be considered. Evaluation of technical capability shall be limited to the information provided in the quotation and will reflect the Government’s assessed level of confidence that the quoter will successfully perform the requirement.

Evaluation of this factor is a subjective evaluation of the vendor's demonstrated resources, capability, and methods to meet all requirements. This may include the authority to provide the required items (i.e. authorized dealer/seller/reseller), authority to provide maintenance and repair services, and the capability and method to successfully meet all the requirements in the requirements and specifications document. Quotations that do not demonstrate that the proposed equipment meets or exceeds all requirements will not be considered further for award. If an offeror’s technical description and/or product literature does not indicate whether its proposed equipment meets a certain minimum requirement, NIST will determine that it does not meet the requirement.

Schematic drawing of proposed solution required. Stronger consideration will be given to the quotes that exceed the following specifications:

Specification
Submission Requirement

From specifications section 1.3. X-ray optics shall enable transmission and capillary measurements, incorporate computer controlled divergent slit and anti-scatter slit assemblies (incident and receiving), as well as collimators, beam stops, and equivalent capabilities for reducing parasitic background scattering on both incident and detector sides.

Stronger preference shall be given to instruments with their optics additionally featuring Johansson monochromator Ag Ka1 radiation with step-motor computer-controlled adjustments.

From specifications section 1.6, the instrument must be configuration with a sample changer for capillaries.

Stronger preference will be given to solutions which include a sample changer for at least 5 capillaries permitting the capillary spinning during measurements. Additionally, stronger preference will be given to solutions that integrate control of the same changer in the instrument software.

Likewise, stronger preference will be given to solutions offering an optional sample stage(s) enabling variable-temperature measurements of a pair-distribution function. The temperature range of interest is between 85 K and 1773 K.

From specifications section 1.4, the detector should be 1D with equal or greater than 40 % efficiency for silver radiation, single photon counting capability, a dynamic range greater than 10,000,000 cps, pixel size less than 60 microns, readout time less than 100 microseconds, and the ability for energy discrimination against fluorescence.

Stronger preference will be given to solutions that provided detector efficiency to silver radiation greater than >80 % and minimum two-theta coverage of 15 degrees at a fixed detector position.

Quoter should provide details of timelines and delivery of final product in quote.

Quoter shall specify if their incident-beam optics includes a Johansson monochromator. If no Johansson monochromator is available, the quote should specify the residual Kalpha2 fraction.

Quoter shall specify the capacity of the capillary sample changer, the acceptable capillary diameter range, the ability of the sample changer to enable spinning of the capillary during measurements, and the ability to control the sample changer using the instrument software. Quoter shall include options for variable-temperature pair-distribution functional measurements, including the capillary diameter range.

Quoter should specify the detector efficiency for silver radiation and the minimum two-theta coverage at a fixed detector position.

Factor 2- Experience:

This factor involves assessing the vendor’s experience in similar scope, size, and complexity on recent and relevant projects to evaluate the vendor's capability to successfully meet the requirements of the request for quotation. Experience as a prime contractor will be considered more relevant than experience as a sub-contractor and may receive a higher level of confidence rating.

Evaluation of this factor is a subjective evaluation of the vendor’s provided experience working with similar requirements to assess the capability of the vendor to successfully meet the requirements of this request for quotation. The Government is more interested in the quality and similarity of the experience examples than the quantity of examples. The vendor shall include the name and contact information of a reference that can substantiate the example and results. The information shall be sufficiently detailed so that the evaluators can determine whether the example(s) demonstrate the contractor’s experience. The Government will review a maximum of three (3) experience project data submittals in the order of submittal (in addition to a maximum of 3 submittals for each sub-contractor). Any projects submitted beyond three (3) for each of the prime contractors and each subcontractor will not be considered. Experience Project Data Sheet (Attachment 3) for these submissions should l be used. .

The Government will evaluate the Offeror's experience information and, if appropriate, its proposed subcontractors' experience to determine its recency and relevancecy to the current requirement and the extent to which it (a) demonstrates that the offeror has successfully completed relevant projects in the past three (3) years.

Factor 3- Past Performance:

The basis of evaluation is a subjective evaluation of how well the Vendor performed on recent and relevant projects regarding the RFQ requirement. This factor will be evaluated on a Confidence Rating basis as follows; receiving a past performance evaluation rating of ‘Very Good’ or better would be rated as higher confidence, receiving a past performance evaluation rating of ‘Satisfactory’ would be rated as some confidence, and receiving a past performance rating of ‘Marginal’ or less would be rated as low confidence. Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably in past performance and will receive a Neutral rating. If no recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will receive a neutral rating. Past performance submittals are limited to a maximum of three (3), this includes any subcontractor work. Projects in excess of three (3) will not be considered.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include but are not limited to, past performance information retrieved through the CPARS, Federal Awardee Performance and Integrity Information System (FAPIIS) using all CAGE / UEI numbers of vendors. The Government reserves the right to contact any other source of information that may have knowledge or information on a vendor’s relevant past performance history. The Past Performance Questionnaire (Attachment 4) is available for past performance submittals.

Evaluation Rating The evaluation of the non-price factor (Factors 1) may be done holistically with a rating scale of "high confidence," "some confidence," and "low confidence," representing the Government’s confidence that the Quoter is technically capable.

Confidence Ratings:

High Confidence
The Government has high confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing with little or no Government intervention.
Some Confidence
The Government has some confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing with some Government intervention.
Low Confidence
The Government has low confidence that the Quoter understands the requirement, proposes a sound approach or will be successful in performing even with Government intervention.

All quotes shall be evaluated in accordance with the factors and criteria established above.

All quotes shall be evaluated by the Department in accordance with the factors and criteria established above.

Factor 4 - Price: The proposed price will be evaluated. The evaluation will determine whether the proposed prices are reasonable in relation to the solicitation requirements. A price realism analysis will not be conducted. Prices must be proportionate with the technical portion of the quotation.

(End of provision 52.212-2)

(X) Offerors shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Products and Commercial Services (DEC 2022), with its offer. The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.
